SOLID WASTE DISPOSAL DISTRICT
MEETING MINUTES
The Board of Commissioners of the Solid Waste Disposal District met at the County
Commission Chambers, 1801 27th Street, Vero Beach, Florida, on Tuesday, April 3 , 2012 . Present
were Vice Chairman Peter D . O ' Bryan, Commissioners Wesley S . Davis, Joseph E . Flescher, and
Bob Solari . Chairman Gary C . Wheeler was absent . Also present were County Administrator
Joseph A . Baird , County Attorney Alan S . Polackwich, Sr . , and Deputy Clerk Maureen Gelfo .
Vice Chairman O ' Bryan called the meeting to order at 2 : 13 p . m .

MOTION WAS MADE by Commissioner Solari ,
SECONDED by Commissioner Flescher, to approve
staff' s recommendation.

Attorney Polackwich directed the Board ' s attention to the second page of the proposed
agreement with Florida Power & Light (FPL) , explained why it was no longer necessary to have
the Contractor Indemnification clause, and advised that the paragraph would be removed from
the final contract .
MOTION WAS AMENDED by Commissioner Solari,
SECONDED by Commissioner Flescher, to delete the
Contractor Indemnification clause on page two of the
Lump Sum Relocation Agreement with Florida Power &
Light (FPL) .
The Chairman CALLED THE QUESTION, and by a 4 -0
vote (Chairman Wheeler absent) , the amended Motion
carried . The Board : ( 1 ) approved and authorized the
Chairman to execute the Electrical Power Line Relocation
Agreement with Florida Power & Light, amended to
delete the Contractor Indemnification clause on page two
of the Lump Sum Relocation Agreement with Florida
Power & Light (FPL) ; and (2) granted the non-exclusive
easement in accordance with the easement drawings .
AGREEMENT ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD
ALL BACKUP DOCUMENTATION, RESOLUTIONS , AND ORDINANCES ARE ON FILE IN THE OFFICE
OF THE CLERK TO THE BOARD AND ARE HEREBY MADE A PART OF THESE MINUTES

There being no further business, Vice Chairman O ' Bryan declared the Solid Waste
Disposal District meeting adjourned at 2 : 14 p . m .
