Chairman Graves stated' this meeting was called for the purpose of discussing
:road right-of-way.matters and road budget matters together with such other business as might

,be brought before the Board.
Upon Motion of Commissioner Hamilton, seconded by Commissioner Watts and
tcarried, letters of agreement were authorized relating to obtaining right of way deeds on
State Road 5, Section 8801-691, as follows:

In consideration of your conveyance of the right of way required for this pro-
ject described in the above deed, the County will request the :state Road department and the
contractor to deposit any excess material onto the low spot on your property in the Northeast
corner. In addition, as you already know, we have asked the State Road Department to put a
drainage inlet in on your property to drain your land and this they have agreed to do if such
a drainage culvert would work.
The engineers of the State Road Department tell us there will be very little
excess fill on this job, so I don't hold out too much hope for your getting all of your land
filled, but whatever excess there is, we would like for you to have your fair share.

Dear Mr. and Mrs. Schlitt:
In consideration of your conveyance of the right of way described in State Road Department
Deed No. 142, Section 8801-691, State Road 5, Indian sliver County, Florida, the County
Commissioners have agreed with you as shown by their minutes today as follows, to -wit:
1. The County will pay to you the total sum of $4,600.00 for this right of way.
2. You may salvage any of the improvements on the right of way provided they are taken
and removed before construction of the new road begins.
3. This sum will be paid to you prior to the time possession is taken of the property
described in the deed and until such time as you are paid, you may continue in possession.

State Road 5, Indian giver County
The State Road Department has consented to the shifting of this drainage easement
to the North to avoid your wind -break and the revised easement described above accomplishes
this purpose. lle have a letter from the State Road department advising that the ditch will
be constructed North of the row of pines used as a wind -break and that the wind -break will
not be disturbed.
I wish to further advise you that the County agrees to take up the banana patch and
relocate it in the location that you designate and desire. The County also agrees to rebuild
your concrete bridges or put in -culverts satisfactory to you so that you will have access
across the ditch at the places which you wish.

carried the following Resolution was unanimously adopted:

R E S O L U T I O N--- State Road Department
$75,000.00 •
WHEREAS, the Board of County Commissioners of Indian River County, Florida, has
heretofore entered into an agreement with the State Road department of Florida wherein said
County has agreed to obtain all of the right of way for Section 8801-691, State Road 5,

Indian River County, Florida; and,
WHEREAS, the Board of County Commissioners has appraised the value of all of
the parcels of land in this right of way; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County,
al
Florida, that the total sum of Seventy -Five Thousand Dollars ($75,000.00) is a fair and
reasonable sum and constitutes the fair market value of all of the parcels of property in the
above right of way, including Court costs and attorneys' fees and this Board does herewith
certify to the State Road Department and to the Comptroller of the State of Florida that said
sum is fair, reasonable and adequate for obtaining all of said right of way and this Board
does herewith approve the expenditure of said sum to the account of Indian River County
pursuant to said agreement.
It is agreed that Item V6 under the secondary road program Resolution be
changed in the future to read "from North Relief Canal to State Road 510 (West Wabasso Road)
;: a distance of approximately 3.75 miles".
