made a part of these minutes.
The County Depository filed its monthly statement, showing receipts and dis-
bursements of the various funds, which have been audited, were found to be correct.
There being no further business, on motion made, seconded and carried, the
Board then adjourned until 9:00 A. M. Friday, July 23rd®

The Board of County Commissioners of Indian River County met at the Courthouse

at Vero Beach, Indian River County, on this the 23rd day of July, 1954, at 9:00 o'clock A.M.
in session as an equalization board as provided by law, with the following members present:
W. C. Graves, Jr., Chairman, Aubrey L. Waddell, H. C. 6iatts, J. J. P. Hamilton, and Allison
Marren. Also present were Sherman N. Smith, Jr., Attorney; E. E. Carter, Road & Bridge
Superintendent, L. B. O'Steen, Sheriff; and Douglas Baker, Clerk.

Pursuant to the. foregoing Notice, the Board convened as an equalization Board
and no one appearing as to assessed values, upon Motion of Commissioner Hamilton, seconded
by Commissioner Waddell and carried, the equalization meeting was adjourned until 9:00 o'clock
A. M. Monday, July 26, 1954.
The Board then reconvened in regular session.
A letter was received from E. E. Carter, Road & Bridge Superintendent, dated
July 22, 1954 advising the Board as follows:
"Under date, of June 21, 1954, the firm of Kuster & Kuster filed with your
Board a certified check in escrow for $650.00 to guarantee the completion
of street clearing & etc in Gifford School Park Subdivison as filed in
plat book 3 page 53.
This is to advise that all work has been completed satisfactorily, in this
subdivison and the above mentioned certified check may be returned."
Thereupon on Motion of Commissioner Waddell, seconded by Commissioner Watts and unanimously
carried, Douglas Baker, Clerk was authorized to return said check.
Mr. Donald MacDonald of Roseland presented a petition to the Board signed by Mr. and
0 Mrs. William Maulbetsch together with 99 additional signatures of residents and taxpayers
of the northern part of Indian River County, endorsing the location by the Board of County
Commissioners of the new right-Rf-way for U. S. No. 1 north of the City of Sebastian as being
the most practical from an engineering and safety standpoint and the most economical from the
standpoint of all the taxpayers of Indian River County and respectfully urging that the project
be pushed to completion at the earliest practical date with the understanding that the petition
is not to be considered as taking any side with respect to the location of the dew highway
within the town limits of the City of Sebastian. Said petition was considered and ordered
filed with the Clerk.
Sherman N. Smith, Jr. and Commissioner Allison Warren, who were appointed as a com-
mittee to obtain information as to the cost of purchasing and maintaining radio equipment for
the sheriff's office and information as to the rental cost of automobile radios from the
Southern Bell Telephone Company, advised the Board there was not sufficient information
available at the present time to take immediate action in 1954-1955 budget, and that the matter
would be temporarily -passed.
RESOLUTIQA --- Building Setback Lines

Commissioner Watts introduced the following Resolution and moved its adoption,
as follows, to -wit:
WHEREAS, House Bill No. 477 adopted at the 1953 Session of the Florida Legis-
lature, authorized the Board of County Commissioners of Indian River County, Florida, to adopt,
regulations prescribing building setback lines from any `road, street or highway existing and
proposed; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County,
Florida, that pursuant to the authority of said law, said Board does herewith adopt said
building setback line as follows, to -wit:
1. On State Road 5 (U. S. Highway No. 1) from the intersection of said road
with the South line of Section 28, Township 31 South, Range 39 East, to a point on said road
in Section 8, Township 31 South, Range;39 East, which is 177.33 feet Northerly from the South
boundary of said -Section 8, all in Indian River County, Florida, no building or structure shall
be erected or maintained and no building permit shall issue for the construction of any build-

ing or improvement within the lines and limits of the proposed right of way as set forth and
,contained in the right of way map of the State Road Department of Florida, State Road 5, Sectioh ,
8801, on file with the Clerk of this Board, said right of way line and the building setback
line herewith established being a line parallel to and 78 feet Easterly from the present
.existing center line of said road and said line being parallel to and 42 feet Westerly from the,
present existing center line of said road.
Upon being duly seconded by Commissioner Hamilton, this resolution was unanimous
ly adopted.
Certified copies of resolutions adopted by the Board of Realtors of _Vero Beach,

?Florida and Beach Business Bureau of Vero Beach, Florida, requesting the Board of County
Commissioners to immediately make provision for and acquire a suitable, adequate and proper
site along the Atlantic Ocean in Indian River County, Florida that can be designated and es-
tablished as a bathing beach area for the colored people of this County, were received, consid
,eyed and ordered filed with the Clerk. Sherman N. Smith, Jr., Ottorney was requested to con-
tact Fred Tuerk regarding two or three hundred feet of Ocean Beach property to be used for
the purpose recited in the copies of the resolutions heretofore mentioned.
Upon Motion of Commissioner Waddell, seconded by Commissioner Watts and carried,
'it was ordered that Troy E. Moody, Tax Collector, deposit all revenues received for beverage
and occupational licenses in the Road and Bridge Fund instead of the General Revenue Fund,
until further orders by the Board.

—The Clerk of the Circuit Court (County %uditor) after tentatively ascertaining
';the proposed fiscal policies of the Board for the ensuing fiscal year, from the 1st day of
October, 1954, to the 30th day of September, 1955, prepared and presented to the Board a tenta
tive budget for the ensuing fiscal year for each of the funds, as provided in Chapter 26874,
i Laws of 1951, including all estimated receipts, taxes to be levied, and balances expected to

;be brought forward, and all estimated expenditures, reserves and balances to be carried over
to the end of the year, were ordered spread upon the minutes of the Board and transmit two

copies of each of the tentative budget to the Comptroller of the State of'Florida, said copies
to be certified by the Chairman of the Board of County Commissioners and by the County Auditor
as a true and correct copy of the budget as adopted by the Board of County Commissioners and
!the original to be filed as part of the records of the County, and is in words and figures as j

The Board of County Commissioners of Indian River County met at the Office of
the Clerk of the Circuit Court at Vero Beach, Indian River County, -on this the 26th day of
July, 1954,, at 9:00 o'clock A. M. inradjourned)session as Equalization Board, as provided by
law, with the following members present:. Chairman IV. C. Graves, Jr.; Aubrey L. Waddell;
H. C. Watts; J. J. P..Hamilton;. absent: Allison Warren. Also present were Sherman N. Smith,;
Jr., Attorney; E. E. Carter, Road and Bridge Superintendent; and Katherine Morrison, Deputy
Clerk.
The County Tax Assessor filed with the Clerk to the Board, and there was
presented to the Board, at this meeting, the applications for the tax exemptions set out in
the Resolution next following herein, together with original notice of disapproval of said
applications with entry of service upon the respective applicants, and same were duly reviewed
by the Board together ,with evidence presented to the Tax Assessor upon which the respective
applicants based their, claims for exemption. No applicants appeared in person or by agent..
Thereupon Commissioner_ Hamilton introduced the following Resolution and moved its adoption,
to -wit:
WHEREAS, original notice of disapproval of application for tax exemption with
entry of service upon thexespective applicants therefor, as hereinafter listed, have been
filed with the Clerk of this Board as follows:
