S0017 AMENDMENT NO . 1 THIS AGREEMENT as entered into on the 13 "' day of May, 2002 , between the STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION (hereinafter referred to as the "Department") and the INDIAN RIVER COUNTY BOARD OF COUNTY COMMISSIONERS (hereinafter referred to as "Grantee" or "Recipient") is hereby amended. WHEREAS , after putting the project out for bid, costs to compete the original work plan as described in Attachment A of the original Agreement were in excess of the $ 150, 000 grant amount; and, WHEREAS, the Project Work Plan is being revised to indicate the work that can be completed for the $ 150,000 project total; and, WHEREAS , Indian River County will be responsible for any additional funding required over the original project amount of $ 150,000 ; and, WHEREAS , additional time is needed on the construction phase of the project due to delays in getting through the design and bid phase and locating historically accurate building material to use on the facility ; and, WHEREAS , other changes to the Agreement are necessary. NOW, THEREFORE, the parties hereto agree as follows : -- As of January 7, 2003 , all references in this Agreement to the State Comptroller and the Department of Banking and Finance shall hereinafter be referred to as the State Chief Financial Officer and the Department of Financial Services, respectively . All references to the website for the State Comptroller ' s Voucher Processing Handbook shall hereinafter be referred to as the Department of Financial Services ' Reference Guide for State Expenditures at www. dbf. state . fl . us/aadir/reference guide . -- Paragraph 2 is hereby revised to change the completion date of the Agreement from November 12 , 2003 to February 12 , 2004 . -- Paragraph 3 , the first sentence is hereby deleted in its entirety and replaced with the following : As consideration for the services rendered by the Grantee under the terms of this Agreement, the Department shall pay the Grantee on a cost reimbursement basis in an amount not to exceed $ 150, 000 toward the total project cost estimate of $ 150,000 . The Grantee shall be responsible for all costs over the $ 150 ,000 necessary for the completion of the project. -- Paragraph 10, the last sentence is hereby modified to read as follows : If the Grantee fails to receive a revised copy of Attachment C, Exhibit- 1 , the Grantee shall notify the Department ' s Grants Development and Review Manager at 850/245-2361 to request a copy of the updated information . -- Attachment A is hereby deleted in its entirety and replaced with Attachment A- 1 , Revised Project Work Plan, attached hereto and made a part hereof. In all other respects, the Agreement of which this is an Amendment, and attachments relative thereto, shall remain in full force and effect. Mobilization and site work $25 , 700 (Includes mobilization, traffic maintenance, as-builts, erosion and water pollution control, clearing and grubbing, grading, and fence gates) 2 . Railroad Depot Construction $95 405 (Includes electrical power service) 3 . Landscaping and Sod $ 1 608 (Includes landscaping and sod) 4 . Trail $ 18 ,639 (Includes 4 " cement coquina base and sidewalk) 5 . Exhibits $ 8 ,648 TOTAL CONTRACT: $ 1504000 Purpose: Design and construction of a historical interpretive and educational display called Kitching Station Railhead on the Indian River County North County Regional Park (part of the St. Sebastian River State Buffer Preserve) . The project will educate the public about railroad history, interpret one of the oldest railroad sites in east central Florida, and serve as a trail head for a proposed pedestrian trail along the railroad grade within the county park. Project Tasks : 1 . Providing all materials and labor necessary to design and construct the proposed Kitching Station Railhead to include : a) Constructing a replica of a 1920 ' s era railroad depot containing various exhibits, signs, kiosks, and other media that would allow visitors to view, reminisce, or interact with the area ' s rich and diverse history. b) Providing parking, landscaping, and other amenities as necessary. (Parking to be provided at existing county park facilities) c) Developing a trail system along a section of the railroad grade within the county park utilizing the railroad depot as a trailhead. 2 . Coordinating design and construction of the proposed railhead with Buffer Preserve staff. 3 . Obtaining all necessary permits and approvals prior to initiating construction. 4. Providing administrative oversight of the project, including the preparation of any bid documents, contractor/subcontractor agreements, or other items necessary to complete the project. 5 . Ensuring all tenants of the sublease agreement between the Florida Department of Environmental Protection, Office of Coastal and Aquatic Managed Areas and Indian River County for the North County Regional Park are followed, including any items identified in the approved management plan for the county park.
