Sherman N. Smith, Jr. was requested to obtain an opinion from the Attorney -
General on the foregoing matter of the county contributing to the operating expenses of the
City's operating system used by the sheriff's office.
Chairman W. C. Graves, Jr. received a letter advising the State Association of
County Commissioners would hold their annual convention in Jacksonville, Florida on March 24,
25 and 26, their headquarters being the Roosevelt Hotel, and stated that County Attorneys and
Road and Bridge Superintendents were invited and urged to attend said meeting. Douglas Baker,
Clerk was instructed to make reservations for all commissioners together with the county

Mrs. Maulbetsch and committee, from Roseland appeared before the Board and
stated they were unhappy about their road situation and requested that the Board do something
about it, The Board advised that Mr. Carter, Road & Bridge Superintendent, would look into
the matter and make improvements as soon
such necessary repairs and as possible.
It was announced that the r&merican Legion would sponsor their Third Annual County
wide fair during the week of March 14th which would be located South of DeLeach Bros. place of
business on U. S. 1, and requested cooperation from the Board and sheriff's office, which was
granted.
S. N. Smith, Jr., Attorney, advised the Board that the air corp had never as yet
officially turned over the several acres of land located on the beach referred to as the atomic
land and located North of the old U. S. Coast Guard station.
The Tuerk-Eve-County land deal was again discussed and upon Motion of Commissioner
Hamilton, seconded by Commissioner Marren and carried, the commissioners tentatively approved
the proposed exchange of lands with Fred R. Tuerk, whereby the County would convey to Fred R.
Tuerk the following described land:

Beginning at a point on the East Bank of Indian River,
which point is 2,141 feet South and 237 feet West of
the intersection of the East Bank of the Indian River
with the North line of Township 32 South, Range 39
East, run North 62 degrees East a distance of 100 feet,
thence South 28 degrees East a distance of 40 feet,
thence run South 62 degrees West to the Indian River,
thence Northerly along the waters of the Indian River
to point of beginning;
and whereby.Fred R. Tuexk would convey to the County, the following described land:
From a point where the North line of Township 32 South,
Range 39 East, intersects the East Shore of the Indian
River, run South 2,141 feet, thence West 237 feet to
the shore of the Indian River, thence North 62 degrees
East 100 feet.,, thence South 28 degrees East 100 feet
to the Southeast corner of a bridgehead deeded to
Quay Bridge District as recorded in St. Lucie County
records in Deed Book 46, page 17, and point of beginning,
thence run South 28 degrees East a distance of 40 feet,
thence run South 62 degrees West a distance of 155
.feet, ore or less, to the East Shore of the Indian
River, thence run Northerly along the waters of the
Indian River a distance of 40 feet, more or less,
to the Southwest corner of lands deeded to Quay Bridge
District, thence run North 62 degrees East a distance

and further, that Attorney Smith prepare and have published a notice to this effect and further
stating that the Board proposes to adopt a resolution authorizing the exchange at its meeting
to be held on Tuesday, April 5th at 9:00 o'clock A. M.
Regarding the matter of the Florida East Coast Railway Company urging the
County to proceed with the construction of fences and barriers between the railway right-of-
way and the widening -of U. S. 91 in the vicinity of Vero Beach, to fulfill provisions of the
agreement between the County and the Railroad, entered into on April 1, 1952, the railroad
committee consisting of Allison Warren, Aubrey Waddell, Attorney Smith and Road & Bridge
Superintendent Carter, after having analysdd the cost on all bids submitted on materials
to do this work and after further checking into the matters recommended to the Board that it
would be much cheaper and less troublesome for the County if the Railroad Company would accept
$5,000.00 in full settlement of the agreement between the two. The Board though this was
a good suggestion and instructed Attorney Smith to go with Charles C. Jewett, City Manager
to contact J. 11. Martin, Trustee, df the Florida East Coast Railway Company and make known
to him the County's offer.
Commissioner Warren brought up the Blue Cupress Lake fishing area problems
which were discussed, and the Board agreed to continue to work to�:improve:;these existing
situations and conditions as soon as funds are available.
The possibilities of establishing a county home for the aged, for dependent
children, and for juvenile delinquents were discussed by the Board of County -Commissioners.
Juvenile Judge Otis M. Cobb and Mrs. Anne Christensen, county welfare worker, gave the board
their opinions on the need for such a home. According to their reasons, the home could:
1. Be used to house aged or infirm Persons who are living on very small pensions or
who have no incomes. Either group would fall into the welfare class.
2. Be used as a temporary place to house dependent children until foster homes were
found for them.
3. Be used to quarter juvenile delinquents until their cases were disposed of, or until
they were sent to industrial schools. At present the county jail must be used.
Chairman, W. C. Graves, Jr., appointed a committee to investigate the possibilities are
problems of establishing a county home composed of himself, County Attorney Sherman N. Smith,
Jr., as chairman, Commissioner Allison Marren and Mrs. Anne Christensen.

One of the angles to be investigated will be the possibility of using the old
hospital building an the Vero Beach air base as the county home.
Mrs. Evelyn DeKold and Polly Wagner presented a plat of Sunnyland's S/D which
would not meet the existing plat requirements and specifications.
Commissioners Waddell and Warren together with Road & Bridge Superintendent
Carter and ,Attorney Smith, were .appointe,d as a committee to look into the matter with authority
to act.
Troy E. Moody, Tax Collector appeared before the Board and reported that his
safe had been broken into and robbed sometime during the weekend of February 5, 6 and 7, but that
he did not know the specific time of the robbery. Mr. Moody stated that he knew the amount
of the loss but preferred that Mr. Fred Ballou, State Auditor, provide this information to the
Board in that he had audited the records. S. N. Smith, Jr., Attorney was requested to write
the Attorney General for an opinion as to the tax collectors loss.
l " Chairman Graves stated an addition for the Sunshine Center i& slated to get
under way soon and it was pointed out that the Board had agreed to provide two acres of land
for this project, however, as yet no specific description of the said two acres had been
determined and that this should be done. Therefore, the Board requested Road & Bridge Super-
intendent E. E. Carter to provide the legal description.
It was reported that Billy Richard Harrison,.age 11, drowned in a small lake
in Rivenbark.'s Subdivision just South of .Vero Beach city limits, Attorney S. N. Smith, Jr.
advised the Board that the County was in no way liable in this matter.
The following Notary Public Bonds in the sum of $500.00 each were approved by

Commissioner Waddell and Commissioner''Igarren;together with Attorney, S. N. Smitg,
Jr., were appointed a committee regarding the Porhorsky property and said committee was
requested to contact the Methodist Church regarding same to see if someone was available who
might be appointed guardian so the county could sell the Porhorsky property, which they
supervise and hold a mortgage on.
At the request of Charles C. Jewett, City Manager, it was moved by Commissioner
Warren, seconded by Commissioner Hamilton and carried, that an easement be granted the City
by the County for the installation of the Brae Burn Park sewer system force main, and that the
property in question is described as follows:
The East 50' of the NWY4 of the NEy of Section 11, Township 33 S.,
Range 39 E, and that the 50' dimension is taken from the center
of 16th Ave which is the West boundary of Brae Burn Park.

Upn Motion of Commissioner Hamilton, seconded by Commissioner Watts and
carried, the following Resolution was unanimously adopted:
WHEREAS, there is a total surplus of $12000.00 in the Fine & Forfeiture Fund
of Indian. River County under some items and which surplus exists after the payment of all
necessary expenditures under such items.for the current fiscal year; and
WHEREAS, there is a deficiency in funds necessary'to provide for the proper and
;authorized expenditures under some items in said Capital Outlay Fund; and
WHEREAS, said items mentioned are a part of the same fund and the transfer from
one item to another item in the same fund and is not a transfer from one fund to another
fund; therefore,
BE IT RESOLVED that there is herewith transferred the sum of $1,000.00 from
some items where there is a surplus to the items where there is a deficiency, according to
detailed statement attached, all in the Fine d Forfeiture Fund of the current budget of Indian
River County as provided by law.

The County Depository filed .its monthly statement, showing .receipts and dis-
bursements of the various funds, which have been audited, were Found to be correct.
