ADDENDUM #10 TO CONTRACT DATED JANUARY 21 , 1997 BETWEEN INDIAN RIVER

INDIAN RIVER COUNTY, FL
Indian River County staff & Masteller & Moler, Inc. have been working diligently to advertise for bid and
award a contract for construction of the Phase III portion of CR 512. The Phase III portion of CR 512
extends westward from Roseland Road to approximately the east line of the Sebastian River Middle
School and includes the proposed bridge improvements over the St. Sebastian River. The Phase III
project was bid on April 5 , 2006 and a contract has been awarded for construction.
As part of Addendum # 8 Services, Masteller & Moler, Inc. requested issuance of a new Army Corps of
Engineers (ACOE) pen-nit for Phase III of the project. The originally issued ACOE Nationwide Permit
had expired and could not be renewed as the subject Nationwide Permit Program under which this
project' s permit had originally been issued was terminated by the Federal Government. Our Addendum
98 services included requesting a new ACOE permit based on the original mitigation design proposed to
support issuance of the previous Nationwide Permit. Our services outlined under Addendum 48 did not
include developing additional permit mitigation plans. Upon receipt of the new application, the Army
Corps of Engineers (ACOE) claimed more wetlands than were originally claimed with NWP application
as such, additional permitting and mitigation designs were required to support issuance of the new permit.
During the re-permitting process issues arose relating to ACOE wetlands impacts, U. S. Fish & Wildlife
Services concerns and State Division of Historical Resources concerns. The ACOE took the position that
a new permit would not be issued until all ACOE, USFWS, and Division of Historical Resources
concerns relative to the CR 512 Phase III project were resolved. Masteller & Moler, Inc. , along with our
Environmental Consultant (Environmental Services, Inc. ) provided permitting services beyond the scope
of our contracted services in an effort to resolve the ACOS, USFWS and SUD concerns without formal
authorization to provide these services from the Indian River County Board of County Commissioners.
Masteller & Moler, Inc. proceeded on this basis, in good faith, with Indian River County staff knowledge
and agreement in order to not delay the advertising and bidding of the CR 512 Phase III contract. As a
result of the efforts of Masteller & Moler, Inc. and our environmental sub-consultant, a new Army Corps
of Engineers (ACOE) permit was issued with regard to CR 512 Phase III. It was agreed that the ACOE
would issue a permit contingent upon the fact that the Division of Historical Resources concerns, which
were limited to the Lake E site, are addressed by virtue of ESI conducting an archeological assessment
survey of the Lake E area within the CR 512 right-of-way improvement corridor based upon guidance and
coordination with the Division of Historical Resources.
We are pleased that this situation with regard to re-issuance of permits did not delay the bidding and
award of a construction contract for CR 512, Phase III. We respectfully request that Masteller & Moler,
Inc. and Environmental Services, Inc. be reimbursed for our professional services provided from October,
2005 to May of 2006 which were needed in order to resolve the ACOE re-permitting issues for Phase III.
We also respectfully request your authorization to proceed with the archeological assessment survey of
the Lake E site and report to be provided by Environmental Services, Inc. as our environmental sub-
consultant. We are listing these services and their fees as follows :
In addition to the expanded wetland impact concerns of the ACOE, the ACOE notified our office the
response to concerns expressed by both the U. S . Fish & Wildlife Service (USFWS) and State Division of
Historical Resources (DHR) would need to be addressed.
Task I — Archeological Assessment Survey of Lake E Site & Report
Masteller & Moler, Inc. will provide for Environmental Services to conduct an archeological assessment
survey of the Lake E site within the CR 512 roadway improvements corridor based upon guidance and
coordination with our office and theDivisionof Historical Resources. The goal of this project is to
locate, assess, and report on any cultural resources within the Lake E site. Investigation will include
background research, preparation of a research design, prediction of site probability zones, field
investigation including sub-surface testing at prescribed intervals, preparation of a final report,
coordination with review agencies and preparation of Florida Master Site File Form and a Division of
Historical Resources Survey Log. This task does not include any permit application fees.

Task II — Professional Services Outside the Scope of our Contract Concerning Re-issue of ACOE Permit
Provided in order not to delay the Bidding and Contract Award of CR 512 , Phase III
These services were provided from October 2005, to May 2006 by Masteller & Moler, Inc. and its
environmental sub-consultants, Environmental Services, Inc. in order to resolve re-permitting issues as
described hereinbefore to secure the Army Corps of Engineers permit re-issuance. These services
included telephone conversations and conferences; letters; e-mails; meetings; site visits; pictures;
preparation of plans, exhibits, wetland tables; and numerous strategy sessions by our office and its sub-
consultants. All these services were performed in an expeditious manner and as needed since the bidding
and award of CR 512, Phase Ill was a high priority.
