The County Depository filed its monthly statement, showing receipts and dis-
bursements of the various funds, which have been audited, were found to be correct.
There being no further business, on motion made, seconded and carried, the Boar
adjourned until the next regular meeting.

THE BOARD OF COUNTY COMMISSIONERS of Indian River County met at the Courthouse
in Vero Beach, Florida in a regular meeting at 9:00 o'clock A. M., April 3, 195 6. All
members were present. Also present were E. E. Carter, Road & Bridge Superintendent, Sam
Joyce, Sheriff, Sherman N. Smith, Jr., Attorney and Douglas Baker, Clerk.
Minutes of regular meeting held March 6, 1956, were read and approved upon
Motion of Commissioner Hamilton, seconded by Commissioner Waddell, and carried.
Homer C. Fletcher, Tax Assessor presented a letter from Governor Leroy Collins
giving his permission to close the office of the Tax Assessor in the afternoons until the
1956 tax roll has been completed and presented to the Board of Equalization; subject to the
approval of the Board of County Commissioners and with proper notice being given to the public.
The Board also approved the closing of the Tax Assessor's office as heretofore stated. This
action was taken upon Motion of Commissioner Waddell, seconded by Commissioner Warren and
carried.
Messrs. Peebles, Levine and Murphy of the Florida Forest Service met with the
Board and Chairman Graves read to them a letter directed to the Board of County Commissioners
from Paul R. Robertson, Chairman of the Soil Conservation District of Indian River County, and
Chairman of Supervisors Indian River Farms Drainage District, requesting the return of the
mobile equipment (power wagon) which was removed from Indian River County. Mr. Peebles advised
the Board that other equipment had been shifted to Indian River County when the power wagon
was removed and because of lack of budget funds it was impossible for both units to be in
Indian River County at the same time unless an emergency existed at which time it could and
would be done.
Upon Motion of Commissioner Warren, seconded by Commissioner Waddell, and
carried, the Board gave approval to the tentative Plat on the Second Unit of Country Club
Pointe Subdivision.
Howard Campbell and Janet Showalter appeared before the Board and presented
a list of names of Republicans to serve en the election Board.
Mr. Jack Vickers, Chief of the Sebastian Fire Department appeared before the
Board and stated they were buying a new fire truck and requested $1,000.00 toward the purchase
of a new truck and it was moved by Commissioner Hamilton, seconded by Commissioner Warren and

and carried, that said request be granted.
It was moved by Commissioner Hamilton, seconded by Commissioner Waddell and
carried, that the Board of County Commissioners contribute $250.00 to the American Red Cross
toward the purchase of a new car.
A petition was filed by Humphries and others regarding the proposed right -of -
route for U. S. #1 Highway from the Winter Beach Curve to the Wabasso curve.
Petition #2767, Mrs. Annie Ruffner, R.F.D. #2, Vero Beach, Florida was approved
as a confederate penshioner in Indian River County.
Mrs. Anne Christensen, County Welfare Case Worker, appeared before the Board
and gave a report of her activities for the month of March, and same .was ordered filed with
the Clerk.

A letter was received from DeLoach Bros. Garage calling attention to the fact
that the County agreed to re -connect driveway as it was before U. S. #1 Highwaywas widened,
and was to extend the driveway on the South to the South property line. The matter was referre
to E. E. Carter, Road & Bridge Superintendent to follow through on.
It was moved by Commissioner Waddell, seconded by Commissioner Warren and.
carried that Elmer Harris should attend the Annual State -Wide Service Officers' School and
Conference to be held May 1st through 5th at Daytona Beach and the County would pay $50.00
expenses.
It was ordered that Ranch Road be extended due North along the canal from
Dan Richardsons a distance of approximately lh miles.
It was moved by Commissioner Waddell, seconded by Commissioner Warren and
carried that the Board approve tentative plat of Winn Cove (Wyn Cove) Subdivision with ocean access of
ten feet on the South line with a 50' street with the understanding that maintenance not
accepted by the County. Further if a cross street is provided same is to be designated by a
Committee consisting of Commissioner Warren, Road & Bridge Superintendent, E. E. Carter and
Jack Jennings.
Notary Public Bonds each in the amount of $500.00 were approved
Baker, Clerk as provided by law for the following: Elizabeth Hansen, American
as surety; Vero F. Moore with St. Paul Mercury Indemnity Company as surety; H.
with American Fire & Casualty Company as surety; Ella Mae Harris with American
of New York as surety.
A letter was received from The Bradley Company representing Mr. Sidney Ansin
stating that l'r. Ansin would deed through his land the required road right-of-way and pay
$4,000.00 toward the construction of a bridge across the South Relief Canal. Sam Bradley
was requested to get the right-of-way for the County on the other two pieces of land involved.

Upon Motion made by Commissioner Hamilton. seconded by Commissioner Watts
and carried, the following Resolution was unanimously adopted:
B E IT RESOLVED by the Board of County Commissioners of Indian River County,
Florida, that this Beard does herewith find and determine as follows:
1. That Elizabeth Hansen has filed a petition before this Board on the 3rd
day of April, 1956, at a meeting of said Board, requesting this Board to adopt a Resolution
vacating and abandoning the plat of Winter Beach Estates as recorded in Plat Book 1, page 49,
Indian River County public records, as it pertains to the following described lands situated
in Indian River County, Florida:
Beginning 327.8 feet West of the SE corner of the SWJ of the
SEY4 of Section 3, Township 32 South, Range 39 East; thence
running North 1328.9 feet; thence West 327.8 feet; thence
South 1328.9 feet; thence East 327.8 feet to point of beginning.
2. That Elizabeth Hansen, the petitioner, has published a notice thereof
two times in the Vero Beach Press Journal. a newspaper of general circulation published in
Indian River County, Florida, on March 22, and 29, 1956.
3. That all State and County taxes on the above described land have been paid
that Elizabeth Hansen is the fee simple Owner of the above described ;and; that the vacation

of the above described, land by the said Board will not affect the ownership of persons owning
other parts of said subdivision; that the said subdivision is not located within the incor-
porated limits of any municipality and is located in Indian River County, Florida.
4. That a public hearing thereon has been held by the Board of County"Comm-

County Courthouse, Vero Beach, Florida, on April 3, 1956, at 10:00 A. M.
5. That none of the streets, parks, alleys and roads as shown on the above
plat and as they affect the above described land have ever been opened. up, established or used
as public roads or highways.
BE IT FURTHER RESOLVED that this Board does herewith vacate and abandon all of
the above described plat and does herewith renounce and disclaim any right of Indian River
County, Florida, and the public in and to all of said above described plat.

Upon Motion made by Commissioner Waddell, seconded by Commissioner Hamilton
and carried, the following Resolution was unanimously adopted:
WHEREAS, Indian River County, a political subdivision of the State of Florida,
brought a suit to foreclose certain tax certificates, the suit having been filed January 29,
1944, under Chancery No. 2398 in the Circuit Court in and for Indian River County, Florida,
and
WHEREAS, the said suit foreclosed certain tax certificates, including tax
certificate No. 1529 of the sale of 1941 for 1940 taxes, and Tax Certificate No. 2681,sale of
1942 for 1941 taxes covering property described as:
Tract 6, Section 14, Township 33 South, Range 39 East, according to last
general plat of lands of Indian River Farms Company filed in the office
of the Clerk of the Circuit Court of St. .Lucie County, Florida, in Plat
Book 2, page 25; said land now lying and being in Indian River County,
Florida,
C and, whereas, a Final Decree was entered in the said County foreclosure, dated,Aug. 14, 1944,
recorded August 14, 1944, in Circuit Order Book 11, page 155, public records of Indian River
County, Florida, decreeing the fee simple title to the above described lands to be vested in
Indian River County, Florida; and
Whereas, Indian River County, Florida, by County Deed No. 277, dated Nov. 4,
1947, recorded Nov. 4, 1947, in Deed Book 8, page 321, public records of Indian River County,
Florida, conveyed to Indian River Farms Drainage District, the following described property:
The West 30 acres of Tract 6, Section 14, Township 33 South,
Range 39 East, according to last general plat of lands of
Indian River Farms Company filed in the office of the Clerk
of the Circuit Court of St. Lucie County, Florida, in Plat
Book 2, page 25;
and,
WHEREAS, the County of Indian River also conveyed to the Indian River Farms
Drainage District by County Deed No. 321, dated Dec. 26, 1950, recorded December 27, 1950, in
Deed Book 63, page 171, public records of Indian River County, Florida,
The East 10 acres of Tract 6, Section 14, Township 33 South,
Range 39 East, according to last general plat of lands of
the Indian River Farms Company filed in the office of the Clerk
of the Circuit Court of St. Lucie County, Florida, in Plat Book 2,
page 25; and
WHEREAS, the plat of Indian River Farms Company filed in Plat Book 2, page 25,
St. Lucie County, Florida records shows that Tract 6, Section 14, Township 33 South, Range
39 East, consists of 40.43 acres; and
WHEREAS, it was the intention of Indian River County, Florida, to convey all
of said tract and it was through a mere oversight that this land was not included at that
time; and
WHEREAS, John W. Stellmon acquired from Indian River Farms Drainage District
by Special Warranty Deed dated Nov. 10, 1947, recorded November 22, 1947, in Deed Book 8,
page 435, public records of Indian River County, Florida:
The West 30 acres of Tract 6 (above described) and, by Special Warranty Deed
dated January 4, 1951, recorded January 22, 1951, in Deed Book 63, page 389, public records
of Indian River County, Florida,.
The East 10 acres of Tract 6 (above described) and he is, still, the owner
and holder of these two parcels of land.
BE IT RESOLVED, by the Board of County Commissioners of Indian River County,
Florida, that this Board does herewith find and determine, as follows:
1. That a request has,been made by John W. Stellmon for a deed covering
that parcel of property that was not included in the two deeds which have been conveyed to
the Indian River Farms Drainage District, which is more specifically described as follows:
The West .43 acres of the East 10.43 acres of Tract 6,
Section 14, Township 33 South, Range 39 East,_according
to last general plat of lands of Indian River Farms
Company filed in the office of the Clerk of the Circuit
Court of St. Lucie County, Florida, in Plat Book 2, page
25; said land now lying and being in Indian River County, Florida.
2. That there was an error made when the above deeds were prepared and it was
the intentionof this Board that all of said Tract 6, as above described, should have been
conveyed.
3. That John W. Stellmon, being the apparent record owner. is entitled to
a deed to the above described parcel.
BE IT FURTHER RESOLVED, That this Board is hereby authorized to execute a
deed to John W. Stellmon covering the property described as:
The West .43 acres of the East 10.43 acres of Tract 6, Section
14, township 33 South, Range 39 East, according to last general
plat of Indian River Farms Company filed in the office of the
Clerk of the Circuit Court of St. Lucie County, Florida, in
Plat Book 2, page 25; said land lying and being in Indian River

Upon Motion made by Commissioner Warren, seconded by Commissioner Waddell
and carried, the following Resolution was unanimously adopted:
WHEREAS, the Board of County Commissioners of Indian River County, Flsrida,
did, on October 21, 1955, adopt its resolution designating certain reads in said county for
improvement and paving by the State Road Department of the State of Florida under the Second-

ary Road Program of the State Road Department; and,
WHEREAS, one of the roads so designated for improvement was that road known
as Emerson Avenue extending from St. Lucie County Line North to State Road 60, a distance of
approximately 5.55 miles; and.
WHEREAS, saidroad so designated has been used, established and maintained by
the Board of County Commissioners as a public road for a minimum width of 25.feet on either
side of the centerline of said road for a period of more, than 4 years immediately prior to
the date of the adoption of this resolution; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County,
Florida, that.this Board does herewith certify to the State Road Department of the State of Floiida
that said road above designated has been designated, established, used and maintained by the
Board of County Commissioners of Indian River County, Florida, as a public road for its
entire length as recited above.
BE IT FURTHER RESOLVED that the Board of County Commissioners of Indian River
County does herewith agree to indemnify and save harmless the State Road Department of Florida
fro any claim or demand with respect to the designation, establishment, use and maintenance
of said road as a public road as certified herein.
E. E. Carter, Road and Bridge Superintendent, presented atypical Section for
State Job,8857-150, State Road S-607 (Emerson Avenue) to the Board for approval. Upon Motion
made by Commissioner Waddell, seconded by Commissioner Hamilton and unanimously carried, the
same was approved.
It was moved by Commissioner Hamilton, seconded by Commissioner =addell and
carried, that letters of approval be given on Parcels #55 and 56 regarding I. F. Stinson's
property and also Stinson's portion of parcel #46 regarding right=of-way for U. S. #1 in the
Wabasso - Sebastian area.
The several bills and accounts against the County, having been audited, were
examined and found correct, were approved and warrants issued in settlement of same. Such
bills and accounts being on file in the office of the Clerk of the Circuit Court, the warrants
so issued from the respective funds being listed in the Supplemental Minute Book as provided
by the rules of the State Auditor, reference to such record and the list so recorded being
made a part of these minutes.
