WHEREAS, there is a deficiency in funds necessary to provide for the proper
and authorized expenditures under some items in said Road and Bridge Fund; and
WHEREAS, said items mentioned are a part of the same fond and the transfer
from one item'to another item in the same fund and is not a transfer from one fund to another
fund; therefore,
BE IT RESOLVED that there is herewith transferred the sum of $500.00 from some
items where there is a surplus to the items where there is a deficiency, according to detailed
statement attached, all in the Road and Bridge Fund of the current budget of Indian River
County as provided by law.`

The several bills and accounts against the County, having been audited, were
examined and found correct, were approved and warrants issued in settlement of same. Such
bills and accounts being on file in the office of the.Clerk of the Circuit Court, the warrants
so issued from the respective funds being listed in the Supplemental Minute Book as provided
by the rules of the State Auditor, reference to such record and the list so recorded being
made a part of these minutes.

The County Depository filed its monthly statement, showing receipts and dis-
bursements of the various funds, which have been audited, were found to be correct.
There being no further business, on'motion made, seconded and carried, the
Board then adjourned.

THE BOARD OF COUNTY COMMISSIONERS OF Indian River County met at the Courthouse
1�in Vero Beach, Florida in a regular meeting at 9:00 o'clock A. M., June 5, 1956. All members
1pwere present. Also present were E. E. Carter, Road & Bridge Superintendent, Siam Joyce,
,Sheriff, Sherman N. Smith, Jr., Attorney and Douglas Baker, Clerk.
Minutes of April 3rd, regular meeting and April 20th, special meeting, were
read and the same were approved upon Motion made by Commissioner Hamilton, seconded by Comm-
issioner Waddell and carried.
Mr. E. E. Carter, Road & Bridge Superintendent stated that he had contacted
,Swords Bros, and they are to fix the driveway at DeLoach Bros. Garage according to the County'.s
yagreement with DeLoach.

Mr. Carter also stated that he and Jack Jennings had gone over the proposed
Beach Route on the ground and had taken pictures from the air and had two proposed routes
laid out for A -1-A Highway South of Vero Beach.
A delegation from the Fellsmere Fire Department requesting $1,000.00 from the
Board appeared before the Board and stated they needed the money for the purchase of new
equipment. After considerable discussion in the matter and upon Motion of Commissioner
Waddell, seconded by Commissioner Watts and carried, it was decided that the Board would
appropriate $1,000.00 to the Fellsmere Volunteer Fire Department. $500.00 to be paid in the
present fiscal year and $500.00 by January out of next year's budget. This arrangement was
satisfactory with the Fellsmere Delegation.
Mrs. Robert Ginther, who lives on 20th Avenue, South of Vero Beach city limits,
appeared before the Board and said that the fire on Sunday which seemed to have started at the
County Dump on the Old Dixie Highway, had destroyed some fence and would like the county to'
replace same so that her horses and cattle would not stray. After considerable discussion -in
the matter, it was decided that the County was not liable for any damage and Sherman N. Smith,
Jr., Attorney was requested to write her a letter to this effect.
Larry Maher and Fire Chief Guy Sullivan appeared before the Board and asked
that the county and the city each pay one-half toward the purchase of protective clothing
to be worn to fires. They stated that this clothing should not be more than $500.00 total.
Upon motion of Commissioner Waddell, seconded.by Commissioner Warren and carried it was de -
Bided that the clothing should be purchased and that the county would pay up to but not more
than $250.00 toward the purchase of fire protective clothing.
Minutes of May 1st regular meeting were read and the same were corrected in
order that a paragraph be added to be 43 in the Secondary Road Resolution as follows:
"93. King's Highway from the North Relief Canal to North Winter Beach
Road, being approximately 1.75 miles."

seconded by Commissioner Waddell and carried.
The minutes were then approved as corrected upon Motion of Commissioner Hamilton!
seconded by Commissioner Waddell and carried.
A petition containing 35 names was presented by L. E. Canady as to the North
Gifford Road. Said petition stating: - "We, the undersigned residents of the North Gifford
Road in Indian River County, Florida, respectfully petition your Honorable Board to make the
necessary repairs on the North Gifford Road at your earliest convenience." Mr. Graves, Chair-
man appointed E. E. Carter to work up an estimate as to the cost of repairing this road, so
that something could be done on it next year.
A delegation headed by fir. B. Q. Waddell, Pat Hazel and others, appeared before
the Board with regard to the big fire starting out of the County Dump on Sunday June 3rd.
After quite a lengthy discussion the Board asked Ed Carter to have signs placed at each dump
stating that no -fires should be started, the amount of the fine, and that such pe°rsons would
be prosecuted. They also stated that they were opposed to fires being started in the dumps
at any time. Upon Motion of Commissioner Hamilton, seconded by Commissioner Watts and carried,
the following Resolution was unanimously adopted:

cognizant of the great danger to life, limb and property caused by fires in this County;
Now, therefore,

Florida, that this Board does herewith direct that no fires in County owned dumps or upon
other County owned property and no fires elsewhere shall be started, commenced or maintained
by officers or
employees of this
County
excepting
only
where in each instance the same is
done under the
direct supervision
of the
Florida
Board
of Forestry.
H letter was presented from Mrs. Hagar regarding the fire and same was ordered
filed by the Clerk;
Report was made by the committee checking on the maintenance of the football
field, and they recommended that in case the school board should get in a pinch for someone
to cut the weeds down and other cleanup work, that trustees from the jail could be used under
school supervision.
0 Mr. Graves reported that he had met with the Indian River Farms Drainage
District and that the County would not be required to pay any drainage tax on the Courthouse,
jail property, sunshine center, dumps, etc. (In other words any land which was being used for
a public purpose). He stated that there was only 20 acres of county owned land which was not
being used for a public purpose. Mr. Graves requested Mr. Carter to get a list of County
owned lands so that the next time he had a meeting with the drainage district he would know
just what the county owned. It was also suggested that the county sell the 20 acres not being
used for public purposes and to give the proceeds to the Drainage District.

After considerable discussion, it was decided to take the low bidder on all
Mr. H. E. Kjorswick presented a deed to the county for a right of way for
U. S. 91 -through his property. Said deed was accepted and the Board directed the Clerk to
pay $374.85 to Mr. Kjorswick for his deed.
o�Sherman N. Smith, Jr. and E. E. Carter were requested to work out a Resolution
setting forth specifications for roads in new subdivisions.
Ed Cartet was requested to look into the matter of putting a shed on the Health''
Center Building for the,canvenience of the public taking their children in for shots and to P
report back to the Board as to cost, etc.
Ed Carter was authorized to advertise for bids for materials needed for the J
next six months,

Upon Motion of Commission Hamilton, seconded by Commissioner Watts and carried,`I
it was decided that the County would pay the monthly rent charges but not toll charges for
the civil defense telephone bill.
E. E. Carter stated that Fred R. Tuerk was desirous of continuing Oslo Road
mest for two miles where it would connect in with the new Toll road. He stated that Mr.
Tuerk would authorize the work done and pay for all work on same if it was agreeable with
the County. The Board was agreeable to this suggestion.
Mrs. Anne Christensen, County Welfare Case Worker, appeared before the Board
and gave her report for the month of May, and same was ordered filed with the Clerk.

Mrs. Christensen also told the Board about a new ruling by the State that
any welfare patient being in a Boarding home for over a year and owning property would not

be eligible for a,State Welfare Pension. After considerable discussion it was decided that
Sherman N. Smith, Jr., Attorney, should prepare the necessary papers to start foreclosure
proceedings against Mrs. Porhorsky's property.
Upon Motion made by Commissioner Waddell, seconded by Commissioner Hamilton
and carried the following Resolution was unanimously adopted:

WHEREAS, Fellsmere Development Corporation, a Florida corporation, has requeste
this board to permit its construction of gates across certain County roads hereinafter de-
p scribed; and,
WHEREAS, this board has determined that the County roads upon which such gates
will be erected are for the benefit of lands owned by the said applicant or lands owned by
�h affiliated or associated corporations or individuals, all of whom consent thereto; and,
WHEREAS, this board has determined that, in its opinion, the placing of gates
across the County roads as hereinafter provided will not necessarily interfere with the public
travel; Now, therefore,

Upon Motion of Commissioner Waddell, seconded by Commissioner Watts and
carried, the following Resolution was adopted:
WHEREAS, the Statutes of Florida provide that the tax assessment rolls of the
County shall, on or before the first Monday in July of each year, be submitted by the
Assessor to the Board of County Commissioners for the purpose of hearing.complaints and re-
ceiving testimony as to the value of any property as fixed by the County Assessor and of
perfecting, reviewing and equalizing the assessment; and,
WHEREAS, by virtue of the many changes in ownership of real property during
the past year and of the many changes in values of real property in this County daring the
past year, the Assessor has requested an extension of time for the filing of said tax assess -
meat roll; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County,
Florida, that this Board does herewith extend the time for the completion of said tax
assessment roll and the equalization meeting and for said purpose this Board will meet on
the first _: in August, 1956.

FOR VACATION OF PLAT OF
RIVER TRAIL PARK
TO: THE HONORABLE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA
Comes now the petitioner, ALBERT A. WEIDMAN, and prays that plat of "River
Trail Park" as recorded in Plat Book 1, page 48, Indian River County Records, be vacated.
That petitioner has caused to be published a notice of intention to apply to
the Board of County Commissioners of Indian River County, Florida at the regular meeting of
said board at 9 o'clock A.M. on June 5, 1956 for the vacation of the said plat, which notice
was published in the Vero Beach Press Journal on May 3rd and -May 10th, 1956 respectively,
proof of publication of such notice being attached to and made a part of this petition.
Petitioner further shows that all of the State and county taxes, including
taxes for the current year on said property have been paid, such statement being made under
oath and substantiated by certificate of Indian River County Abstract Company attached to
and made a part hereof.
That the property included in said plat, being described as the South 10
acres of the NWY4 of the SE'4 of Section 12, Township 33 South, Range 39 East, Indian River
County, Florida, is not within the corporate limits of any incorporated city.
That said property was replated into acreage by plat recorded February 17,
1943 in Plat Book 2, page 50, Indian River County Records, but that there has been no formal
vacation heretofore of plat of "River Trail Park" recorded in Plat Book 1, page 48.
That the streets and alleys shown by Plat Book 1, page 48, have not become
highways necessary for the use of the traveling public and have not been used by the travel-
ing public.

simple title to that plat to be vacated, which plat sought to be vacated is described as

The foregoing is the Proof of Publication of Notice requesting the Board of
County Commissioners to Adopt Resolution closing roads, etc, on the plat of EVinter Beach.
Estates. Said Resolution was adopted -- see page 25, Book 5.
The several bills and accounts against the County, having been audited, were

examined and found correct, were approved and warrants issued in settlement of same. Such i
bills and accounts being on file in the office of the Clerk of the Circuit Court, the warrants

so issued from the respectvie funds being listed in the Supplemental Minute Book as provided
by the rules of the State Auditor, reference to such record and the list so recorded being

made a part of these minutes.
The County Depository filed its monthly statement, showing receipts and disburse

menta of the various funds, which have been audited, were found to be correct.
There being no further business, on motion made, seconded and carried, the
Board then adjourned.
