HomeMy WebLinkAbout9/28/1956FRIDAY, SEPTEMBER 28, 1956 i A Special meeting of the Board of County Commissioners of Indian River County was held in the Courthouse at Vero Beach, Florida, at 9:00 o'clock A. M. Friday, September 28, 1956. All members were present; also present were E. E. Carter, Road & Bridge Superintendent, Sherman N. Smith, Jr., Attorney and Douglas Baker, Clerk. Chairman Graves stated this meeting was called for the purpose of considering road right-of-way matters and such other business as might be presented to the Board. Audit Report #4462, accounts and records of the Florida Inland Navigation District for the year ending December 31, 1955 was presented to the Board as provided by Section 125.09, Florida Statutes, and ordered filed as part of the public records of Indian River County. Troy E. Moody, Tax Collector, presented a Supplemental E & I list of personal • property taxes for the years 1927, 1928, 1929, 1930, 1931, 1938 and 1942, and the same was approved upon Motion of Commissioner Waddell, seconded by Commissioner McCullers and carried. A revised map of survey and location of Job #8807-02, State Road A -1-A, Indian River County Right-of-way (A -1-A right-of-way near and North of the old Coast Guard Station) was filed with the board. R E S O L U T I O N --- Sec. 8801, State Road 5 On motion of Commissioner Hamilton, seconded by Commissioner Watts, the follow- ing resolution was adopted: WHEREAS, the State Road Department of Florida has authorized and requested Indian River County to furnish the necessary rights of way, borrow pits and easements for that l portion of Section 8801, State Road No. 5, extending from Wabasso Northwesterly to Sebastian River, which has been surveyed and located by the State Road Department as shown by a map on file in the office of the Clerk of the Circuit Court of said County, and in the office of the said Department at Tallahassee, and WHEREAS, the said Department will not begin construction of said portion of said Section in said County until title to all land necessary for said portion of said section has been conveyed to or vested in said State by said County, and said lands are physically -cleared of all occupants, tenants, fences, buildings and/or other structures and improvements upon or encroaching within the limits of the land required for said portion of said Section; and WHEREAS, the said County is financially unable at this time to provide the necessary funds to acquire said rights of way, borrow pits and easements; now, therefore, be it RESOLVED, that the State Road Department of Florida be and it is hereby requeste to pay for the rights of way, borrow pits and easements for said road, including the removal . of buildings, fences and other structures and improvements thereon, anfi for other expenses of acquiring title to said rights of way, borrow pits and easements by purchase or condemnation, from such funds and under such conditions as are set out in the contract hereto attached; and be it further ;I i or: i RESOLVED, that said County, through its Board of County Commissioners, comply b� with the request of said Department and procure, convey or vest in said State the free, clear and unencumbered title to all lands necessary for said portion of said Section, and deliver to the State Road Department said lands physically clear of all occupants, tenants, fences, buildings and/or other structures and improvements situate upon or encroaching within the r limits of the lands required for said portion of said Section, and that the Chairman and the Clerk of this Board be and they are hereby authorized and directed to execute and deliver on Ihbehalf of said County to said Department the Contract in the form hereto attached; and be it further I, jN RESOLVED, that the attorney for this Board be, and he is hereby authorized and directed to proceed to take the necessary steps for the County to acquire in the name of said County by donation, purchase, or condemnation said rights of way, borrow pits and easements for said portion of said Section, and to prepare in the name of said County by its County Comm-rl issioners all condemnation papers, affidavits and pleadings, and prosecute all condemnation proceedings to judgment; and furnish to the Department the abstract search provided for in said Contract,. Upon Motion of Commissioner Watts, seconded by Commissioner Hamilton and carried, the following letters of agreement were authorized relating to obtaining right of way deeds on State Road 5 or U. S. #1, for the Sebastian - Wabasso area. September 28, 1956 Mr. Raymond Sawyer P. 0. Box 863 Vero Beach, Florida Dear Sir: In re: SRD No. 68 In consideration of your conveyance of the right of way described in the above deed, Indian River County, acting by and through its Board of County Commissioners, agrees with you as follows: 1. The County will move the fruit stand which you have located on the above described property back to the West 35 feet. In connection with moving the fruit stand, the County will clear another 35 feet to the West of growth and trees and will move your driveway and parking area 35 feet to the West. The fruit stand will be set-up and reestablished after moving in as good condition as the same exists before moving, including hooking up your water line and your pwoer line. All:of the above will be done prior to the time the County takes possession of the right of way and you may continue in poss- ession until possession is required for the road construction.' 2. Your signs advertising your business on this property will be moved back off the right of way. 11 This agreement is approved by the Board of County Commissioners at its meeting as shown by its minutes. The County agrees to move your house back off the right of way and set it up and reestablish it in as good condition as the same exists prior to moving.. Box 242 Sebastian, Florida Dear Mr. & Mrs. Redding In re: SRD No. 135 In consideration of your conveyance of the right of way described in the above deed, Indian River County, acting by and through its Board of County Commissioners, herewith agrees with you as follows: 1. The County will fill and level to grade your property for a distance of 30 feet further West than it is now filled and leveled and will then move your house back off the right of way to the West and set it up and reestablish it in as good condition as the same existed at the time of moving. 2. The County will put in an artesian well in the right of way at the point of the line dividing your property and that of W. H. Owens and then will hook up your house to the well to furnish you a water supply with a one inch water line. 3. Electric power, septic tanks and other items necessary to put the house when moved in a liveable condition will be hooked up. This agreement is approved by the Board of County Commissioners at its meeting as shown by its minutes. The County will pay to you the total sum of $1,500.00 for this right of way. This sum will be paid to you prior to the time of taking possession and until possession is taken, you may continue in possession. Before possession is taken, you may remove any im- provements on the right of way as ipou may desire. This agreement is approved by the Board of County Commissioners at its meeting as shown by its minutes. In consideration of your conveyance of the right of way described in the above deed, Indian River County, acting by and through its Board of County Commissioners, agrees with you as follows: 1. In consideration of your conveyance of this right of way, the County will pay to you prior to taking possession the sum of $750.00. You may continue in possession until construction of the road requires possession and prior to the time that construction begins, you may remove from the right of way any improvements which you may desire. This agreement is approved by the Board of County Commissioners at its meeting as shown by its minutes. That the County will pay to you the total sum of $350.00 for this right of way. This sum will be paid prior to the time that possession is taken of the right of way. This agreement is approved by the Board of County Commissioners at its meeting as shown by its minutes. M. October 4, 1956. All members were present. Also present were E. E. Carter, Road & Bridge Superintendent, Sam T. Joyce, Sheriff, George Heath Attorney, and Douglas Baker, Clerk. Messrs. Levine and McLeod, Indian River County representatives of the Florida Board of Forestry appeared before the Board and submitted asfinancial expenditure report refelecting the manner in which $18,539.78 was expended in the fire protection operation in Indian River County for the State fiscal year ending June 30, 1956. Said report was signed by Mr. Henry C. Peeples, District Forester and it was ordered filed with the Clerk. It was moved by Commissioner Waddell, seconded by Commissioner McCullers and carried, that Sam Joyce, Sheriff be authorized to purchase a Chevrolet automobile for the Sheriff's office from the excess fees of said office. r It was moved by Commissioner Hamilton, seconded by Commissioner Watts and carried, that Sam Joyce be authorized to purchase another car radio for the sheriff's office to cost approximately $500.00 or less. James Lester Bishop was appointed a Deputy Sheriff from Precinct #3, Vero Beach by Sam Joyce, Sheriff, and Douglas Baker announced that said appointment had been filed with him. Deputy Sheriff's Bond for James Lester Bishop in the sum of $1,000.00 with St. Paul Mercury Indemnity Company as surety was approved. The sum of $50.00 was authorized for Bob Jennings, County Sanitarian to attend �a 1i the yearly convention of the State Board of Health to be held October 17 to 20th inclusive at Clearwater, Florida. E. E. Carter and D. B. McCullers who were appointed a committee to tabulate bids opened at the September 4th meeting. The following are their recommendations: 1. 28 Thousand Board feet of bridge lumber - Oak lumber was selected over Yellow Pine - John Cashion. 3a and 3b. For materials at plant and applied on road - Swords & Sons. 4. No bids received for creosotes bridge lumber. 5. 210 bbls. of Hi -Early Portland cement - Crosby Builders Supply 6. Three thousand tons of road rock - Naranja Rock Company 7. One thousand tons Grade B Amiesite, Tampa Coal Company F, �o
