PROFESSIONAL CIVIL ENGINEERING SERVICES
AGREEMENT FOR CIVIL ENGINEERING, SURVEYING AND
BRIDGE DESIGN SERVICES
AMENDMENT NO. 2 TO THE PROFESSIONAL ENGINEERING/LAND SURVEYING
SERVICES AGREEMENT BETWEEN KIMLEY-HORN AND ASSOCIATES, INC. AND
INDIAN RIVER COUNTY, FLORIDA.
This is an amendment to the existing Engineering/Land Surveying Services Agreement
(AGREEMENT) dated April Is`, 2003 between Kimley-Horn and Associates, Inc . (ENGINEER)
and Indian River County (COUNTY) . This amendment addresses changes in " Section I - Project
Limits and Description", Section II - County Obligations, "Section III - Scope of Services "
,"Section V - Compensation" and " Section XVI — Duration of Agreement' of the
AGREEMENT.
Amendment Description
This Amendment includes the following:
"SECTION I - PROJECT LIMITS AND DESCRIPTION" is being modified to include
construction phase assistance for the 4`h Street Bridge Replacement Project.
"SECTION II — COUNTY OBLIGATIONS " is being modified to incorporate the following :
It is understood that during the Construction, the COUNTY will undertake the day to day
task of construction observation, which includes but is not limited to the following:
• COUNTY representatives will be on site during construction and responsible for
construction observation.
• Conduct review of implemented maintenance of traffic devices.
• Conduct the weekly progress meetings.
• Work with the Contractor to develop and process monthly pay request.
• Monitor the removal of the existing structure.
• Provide monitoring of the utility improvements associated with the bridge-culvert
construction.
" SECTION III — SCOPE OF SERVICES " is being modified to incorporate the following:
The ENGINEER will provide limited construction services assistance for roadway,

structural, and utility construction elements of the project. The following provides
descriptions of the tasks that the ENGINEER will perform. The general scope of work
will be conducted under a lump sum budget. However, should the COUNTY request
additional services other than those described below, assistance may be authorized under
an hourly budget.
• The ENGINEER will review structural shop drawings to include :
1 . concrete grout and mortar mixes
2 . precast and connection details
3 . utilities saddles and culverts
4 . resubmittals (maximum of one each).
• Observation of the bridge-culvert construction is established to provide limited
observation during the installation of the structure . The ENGINEER effort will
include:
1 . Four site visits to observe spread footing construction, structure construction
phasing and pre-cast member placement.
• The ENGINEER will also perform a pre-final walk through, review the record
drawings, assist in establishing a punchlist, and perform a final walk through and
certification.
• The ENGINEER will assist with shop drawing review and field observation
assistance beyond that described above on an hourly basis, when requested by The
COUNTY.
Roadway Construction Observation Assistance
• The ENGINEER will respond to COUNTY and Contractor Requests for Information
(RFI) .
• The ENGINEER will review the contractor submitted shop drawings.
• The ENGINEER will review as-built drawings provided by the Contractor' s licensed
surveyor.
• The ENGINEER will assist the COUNTY in conducting two, walk through
inspections . One inspection as a final inspection and a second inspection as a follow
up to clear punch list items .
• When requested by the COUNTY, the ENGINEER will review Contractor proposed

plan alternatives. This work will be undertaken as an additional service and the fee
will be calculated at an hourly rate along with expenses.
• The ENGINEER will review the As-Built data as submitted by the Contractor, and
make permit certifications to the St. Johns River Water Management District.
Utility Construction Observation Assistance
• The ENGINEER will review the Contractor submitted shop drawings and material
specification sheets.
• The ENGINEER will respond to COUNTY and Contractor Requests for Information
(RFI), as it relates to the contemplated utility improvements .
• The ENGINEER will review the As-Built data as submitted by the Contractor, and
make permit certifications to the Florida Department of Environmental Protection.
" SECTION V — COMPENSATION" is being modified to incorporate the following:
The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered
pursuant to this Agreement fees inclusive of expenses in accordance with the following:

B . Additional Services Fee
The COUNTY agrees to pay for additional services, which are outside or beyond
the lump sum scope of services identified above in accordance with the revised

" SECTION XVI — DURATION ATION OF AGREEMENT" is being modified to incorporate the
following:
This Agreement shall remain in full force and effect until September 30, 2007 or
until completion of project phases as specified by the Public Works Director, or
unless otherwise terminated by mutual consent of the parties hereto or pursuant to
Section XII of this AGREEMENT.

The AGREEMENT is hereby amended as specifically set forth here in. All other sections of the
AGREEMENT shall remain in full force and effect and are incorporated herein.
This Amendment No. 2 to the AGREEMENT regardless of where executed, shall be governed
by and construed by the laws of the State of Florida.
