HomeMy WebLinkAbout2008-343o to g AMENDMENT NO.9 TO THE PROFESSIONAL ENGINEERING SERVICES AGREEMENT 66TH AVENUE PAVING AND DRAINAGE IMPROVEMENTS BETWEEN SR 60 AND 4TH STREET IRC PROJECT NO. 9810 THIS is an amendment to the existing AGREEMENT dated NOVEMBER 17, 1998, including AMENDMENTS NUMBER 1 through 8, between CARTER ASSOCIATES, INC. (ENGINEER) and INDIAN RIVER COUNTY (COUNTY). The proposed scope of work includes adding an 8 -foot wide concrete sidewalk, a traffic signal at the 16th Street/College Lane intersection with 66th Avenue, plan revisions for a tie-in at College Lane, utility coordination and modification to address Right of Way acquisition conditions. All provisions of the original Professional Engineering Services Agreement including Amendment Nos. 1 through 8 shall remain in full force and effect, unless otherwise specifically modified. This amendment addresses changes in "TIME OF COMPLETION" of the AGREEMENT. SCOPE OF SERVICES See attached letter from Carter Associates, Inc. dated October 10, 2008, which specifies changes in the "SCOPE OF SERVICES" and "COMPENSATION" and "TIME FOR COMPLETION." COMPENSATION This section of the AGREEMENT entitled SECTION V - COMPENSATION shall be revised in response to the Scope modifications set out herein. The charges associated with this AMENDMENT NO. 9 are as follows: Fees for Engineering Services: Lump Sum Amount $40,480.00 Not to Exceed Amount $600.00 TOTAL Amendment No. 9 $41,080.00 The charges associated with the AGREEMENT (which include changes from Amendments I through 8 and these additional services included in proposed Amendment 9), shall be increased from $441,605.00 to $4821685.00. All sections of the AGREEMENT shall remain in full force and effect, and are incorporated herein. This Amendment No. 9 to the AGREEMENT, regardless of where executed, shall be governed by and construed by the laws of the State of Florida. TIME OF COMPLETION Carter Associates, Inc. shall have 90 calendar days from their receipt of a written Notice to Proceed to submit revised plans for review and 30 calendar days additional to submit final plans. This plan shall be designed in accordance with the FDOT standard design criteria and Indian River County requirements, as follows: A IF Senring Florida SA Since 1911 4 • The intersection design shall accommodate the four lanes currently being constructed on the east approach for College Lane, the three lanes proposed on the west approach for 16"' street, and the ultimate five lanes on the north and south approaches for 66th Avenue. • Revise 66th Avenue Phase 1 Summary of Quantities, Plan and Profile sheets, Cross Sections, and Signing & Pavement Marking sheets. • Submit plans for review/comment/approval by the IRC Traffic engineering department and revise/update plans as required. • Provide mast arm foundation design by a structural engineering sub -consultant. • Provide construction administration services for the traffic signal installation concurrent with the roadway construction of the Phase 1 portion of the project. These services will be provided on a time & materials basis utilizing the budget amount stipulated in Amendment No. 3. Utility Coordination: The Engineer shall prepare "marked -up" plans showing known existing utilities along 66th Ave and shall attend a utility coordination meeting arranged by the County. These services are needed in order to renew coordination with the utility owners as previous base contract utility coordination efforts were conducted several years ago. ROW Acquisition Agreements: In general, the project plans will be modified to accommodate several specific requirements of ROW acquisition agreements, as follows: • Revise 66th Avenue Phase 2 Summary of Quantities, Plan and Profile and Cross Section sheets, and create fencing details to add a 4 -board horse fence along the Graves property frontage on 66th Ave. • Revise 66th Avenue Phase 2 Summary of Quantities and Plan and Profile sheets, to add a culvert replacement at the Knight property on 4th Street. • Revise 66th Avenue Phase 2 Summary of Quantities, Summary of Drainage Structures, and Plan and Profile sheets, to add a drainage swale and inlets at the Hefflebower property on 8th Street. • Revise 66th Avenue Phase 2 Summary of Quantities and Plan and Profile sheets, to add a culvert replacement at the Schacht property on 8th Street. Plan Revisions for Post400% Comments: In general, the project plans will be modified to address post -100% comments, as follows: • Update the General Notes with current utility company contacts and current FDOT references. • Import new topographic survey data of existing facilities on 4`h, 8th, and 12th Streets. • Revise Summary of Quantities to add a bid item for removal of existing wells. • Revise Phase 1 Plan and Profile sheets to show a recently installed 25 -pair AT&T buried cable. • Revise water main design on Plan and Profile sheets to accommodate the proposed sidewalk installation north of the Phase 1 project limits to SR -60. • Revise IRFWCD permit application submittal to include the proposed construction along Lateral Canal "A" north of the phase 1 project limits to SR -60. • Re-evaluate the proposed stormwater drainage system design on the north side of 4th Street, east of 66th Avenue. • Re-evaluate the proposed stormwater drainage system design on the north side of 8th Street, east of 66th Avenue. • Revise 66th Avenue Phase 2 Summary of Quantities, Summary of Drainage Structures, and Plan and Profile sheets, to substitute a ditch bottom inlet in lieu of drainage structure ME4 at the north-east corner of the 4th Lane intersection. • Re-evaluate the proposed side -street profiles at 656' Ave., 4th Place, 4th Lane, 5t'' Street, and 5th Place, N:\PSW\98-23E\Agreements\Amendment 9 proposal(revised).doc Serving Florida Since 1911 Assumptions: In developing this proposal, the following assumptions have been made and deviation from these assumptions may require additional expenditures on behalf of the County to the Engineer. • The County will provide any additional survey data that may be needed. • The County will provide geotechnical engineering services to conduct borings at each mast arm foundation location. The Engineer will coordinate the locations and extent of the sub -surface explorations with the geotechnical engineering firm. • No traffic study or timing analysis will be required. The IRC Traffic Engineering Department shall provide the traffic signal phasing and timing desired for the proposed traffic signal. Compensation* Amendment No. 9 fees will be invoiced on a percent complete lump sum basis. The Engineer shall complete the final signalization design within 30 days after receipt of review comments from the County Traffic Engineer. Duration of Agreement: The duration of the Agreement shall be extended to remain in full force and effect for a period of three years after the date of execution of this Amendment.
