HomeMy WebLinkAbout11/6/1956TUESDAY, NOVEMBER 6, 1956 THE BOARD OF COUNTY COMMISSIONERS of Indian River County, Florida, met at the Courthouse in Vero Beach, Florida in a regular meeting at 9:00 o'clock A. M. November 6, 1956. All members were present. Also present were S. N. Smith, Jr., Attorney, Sam T. Joyce, Sheriff,', E. E. Carter, Road & Bridge Superintendent and Douglas Baker, Clerk. Minutes of September 4th and October 2nd, regular meetings, were read and the same were approved upon Motion made by Commissioner Hamilton, seconded by Commissioner Waddell and carried. Homer Fletcher, Tax Assessor appeared before the Board and submitted a number of requests to cancel or adjust the valuation of real or personal property which had been extended on the 1956 County Tax Roll. The corrections were authorized by Homer C. Fletcher Tax Assessor, and approved by the Board of County Commissioners on the following parcels of real estate: Lots 7 & 8, Blk 1, Replat of Elks 3, 4, 7 of Knight's Add. to Bdgewood. Lot 22, Blk 15, Vero Beach Estates Lots 5 & 6, Blk 4, Veromar Sub. Lot 7, Porpoise Point Sub. Lots, 8, 9, 102 Blk 5, Sunnyside Park Sub. Sam Joyce, Sheriff, told the Board he would need some furniture and equipment including desk, table and chairs, and the Board appointed a furniture and fixture committee consisting of Sam Joyce, E. E. Carter and Douglas Baker, to determine what equipment was needed and to purchase same. Upon Motion of Commissioner McCullers, seconded by Commissioner Hamilton and carried, the Board agreed to provide tile floors for the new addition to the Courthouse at an approximate cost of Twelve Hundred Dollars. The Board authorized Sam Joyce to deduct good time off on prisoners when, in his opinion, it was advisable to do so. County Agricultural Agent, McCullars advised the Board he needed a full time secretary and that the State would pay $75.00 per month toward a salary of $200.00. Upon Motion of Commissioner Waddell, seconded by Commissioner Hamilton and carried, the Board agreed to pay $125.00 per month toward the salary. The right of way contract was returned executed by the State Road Department on the South Gifford Road and filed with the clerk. Mr. Boring of the firm of Merriman, Boring and Sutherland, appeared before the Board and offered a 15 acre tract of land in the Oslo area to the County for a public park. Commissioner Waddell and Road and Bridge Superintendent E. E. Carter were appointed as a committee to look over the tract offered by Brotman & Associates through Mr. Boring and report back to the Board. Mrs. Anne Christensen, County Welfare Case Worker, appeared before the Board and gave a report of her activities for the month of October and same was ordered filed by the Clerk. Mrs. Christensen stated that she was going to need help for the months of November and December and the Board authorized her to get someone. 0 1 1 0 1 0 1 40 1 C 75 R E S O L U T I O N --- County Deed to H. J. Zeuch & Co. covering 5 acres of land in 01so formerly owned by J. Douglas Baker and wife. WHEREAS, H. J. Zeuch & Co.., a dissolved Florida corporation, acting by and through a majority of its Board of Trustees, has filed its Petition with this Board praying for a conveyance to it of the property hereinafter described; and, WHEREAS, the Board of County Commissioners has considered the same and does 'i herewith find and determine that it appears to the satisfaction of this Board that a failure to approve said Petition would work a severe hardship upon the Petitioner; and, WHEREAS, this Board has determined that said Petitioner has offered to pay an amount equal to all taxes which had become delinquent, together with interest and costs pro- D vided b law and together with all subsequent and omitted taxes, -including taxes for the y g q � g • current year, as the purchase price for said lands as hereinafter recited; Now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, i ,Florida, that said Petition for the conveyance to said Trustees of said H. The County will move the house situated upon the above described property back off the right of way and set it up and reestablish it on the lot immediately to the North of this property. After moving the house will be reestablished in a livable condition and in as good condition as the same was prior to moving. 2. Due to the fact that your present water supply Js from an artesian well on the East side of the right of way, the County will drill a 2 inch or 2 1/2 inch artesian well on your property line',and hook your house up to the well for water supply. The well may also be used jointly with Mr. and Mrs. Nelson to serve the property to the South of you. 3. The County will try to move the large palm tree in this right of way; however, we cannot assure you that it can successfully be moved. If the new right of way does not take more than 3 feet of your existing porch, then the County will cut off the part of the porch which extends into the new right of way, replace the steps on either side as you wish and refinish the front porch in as good condition as the same now exists or, if the new right of way line goes back more than3 feet into the porch, then the County will move your house back off the right of way and set it up and reestablish it in as good condition as the same existed prior to moving. When the right of way stakes are put up at your property and the measurements made, you can make your decision as to which you wish to be done. 77 In consideration of your conveyance of the right of way described in the above deed, Indian River County, acting by j and through its Board df County Commissioners, herewith agrees with you as follows: 1. Within Ninety (90) days after completion of construction of improvements to the above road, the County will place a drain a pipe in the roadside ditch paralleling the above described pro- perty on the part of it that is immediately in front of the yard of your home and fill and level to grade over the pipe. November 2, 1956 In consideration of your conveyance of the right of way described in the above deed, Indian River County, acting by and through its Board of County Commissioners, agrees with you as follows: 1. it is our understanding that most of the Australian pine trees on the front of this property are in the new right of way and they will be removed in the course of construction. As to those trees which are not in the new right of way, the County agrees that it will remove these trees. All of the above will be done prior to the time of taking possession of the right of way and, in the meantime, you may continue in possession. As to these trees which are in the right of way, the County agrees with you that the County will either take out the remaining trees or the County will pay you the sum of $50.00. All of the above will be done prior to the time of taking possession of the right of way and, in the meantime, you may continue in possession. With respect to the small concrete block house that is in the right of way, the County will either move it back off the right of way and set it up and reestablish it in as good condition as the same existed prior to moving or the County will tear this building down and rebuild it and reestablish it back off the right of way. 3. In addition to the above, the County will pay to you the sum of $50.00. In consideration of the above, you will not only deliver the above deed, but you will also deliver the quit claim deed, No. 124, from Fred Melin. • All of the above will be done prior to the time of taking possession of the right of way and, in the meantime, you may continue in possession. The County will move the house situated upon the above described property back off the right of way and set it up and reestablish it in as good condition as the same existed prior to moving. 2. Due to the fact that your present water supply is from an artesian well on the East side of the right of way, the County will drill a two or two and one-half inch artesian well on your property line and hook your house up to the well for water supply. Stanley with American Fire & Casualty Company as surety; Bernice Meyer with Massachusetts Bonding and Insurance Co. as surety; Ileene W. Reeves with American Fire & Casulaty Company as surety; Grace W. Richardson with American Fire & Casualty Company as surety; Rudy Hubbard with Home Indemnity Company as surety; J. R. Furlong with Home Indemnity Company as surety and Jean T. Pugh with American Surety Company of N. Y. as surety. The several bills and accounts against the County, having been audited, were examined and found correct, were approved and warrants issued in settlement of same. Such v bills and accounts being on file in the office of the Clerk of the Circuit Court, the warrants so issued from the respective funds being listed in the Supplemental Minute Book as provided by the rules of the State Auditor, reference to such record and the list so recorded being j made a part of these minutes.
