THE BOARD OF COUNTY COMMISSIONERS of Indian River County, Florida, met at the
Courthouse in Vero Beach, Florida in a regular meeting at 9:00 o'clock A. M. January 8, 1957.
All members were present, being W. C. Graves, Jr., J. J. P. Hamilton, D. B. McCullers, Robert j
W. Graves and Donald Macdonald. Also present were E. E. Carter, Road and Bridge Superintendent,
Sherman N. Smith, Jr., Attorney, Larry Yates, Deputy Sheriff and Douglas Baker, Clerk.
Commissioners MacDonald and Robert W. Graves announced they had received their
commissions from Tallahassee and were therefor duly qualified to serve as member's of the
Board of County Commissioners.
The Minutes of December 4th regular meeting were read and approved upon Motion
made by Commissioner Hamilton, seconded by Commissioner Macdonald and carried.

Reports were made by previously appointed committees and all old business was
taken care of.

It was moved by Commissioner Hamilton, seconded by Commissioner Macdonald and
carried that tile floors be placed in Judge Kanner's office upstairs and that the room also
be painted.
Upon Motion of Commissioner Macdonald, seconded by Commissioner Hamilton and
carried, the bid of Paul G. Callahan for cleaning, caulking, and putting two coats of paint
on the outside of the windows in the Courthouse at a cost of $3.75 each per window and $5.00
for each downspout was accepted and Douglas Baker, Clerk was authorized to tell Mr. Callahan
to proceed with the work.
A committee consisting of Commissioner McCullers, E. E. Carter, Road & Bridge
Superintendent and Douglas Baker, Clerk, was appointed relating to the painting of the Court-
room and the other rooms in the original courthouse building in order that Sherman N. Smith,
Jr., Attorney could prepare notice inviting bids on this w)rk, with the idea that it would
be dome on a unit basis.
Douglas Baker, Clerk announced that he had not been able to comply with the
law regarding the application of Amelia Johnson for a fortune tellers license and action was
then deferred until the next regular meeting during which time Mr. Baker stated that he would
make the examinations as provided by law.
Robert W. Graves, Commissioner, Douglas Baker, Clerk and E. E. Carter, Road &
Bridge superintendent were appointed a committee with regard to an addition to the Health
Center Building.
Sherman N. Smith, Jr., Attorney, advised the Board that he had recently obtained
the abstract on the property for the Old Folks Home.
Commissioner Macdonald announced he had selected C. C. Coleman to serve as a
member of the Planning and Zoning Board of Adjustment.
It was announced that Alex Ryburn could not serve as a member of the Board of
Adjustment for the Planning and Zoning Commissioner but Alex MacWilliam, Jr. could serve,
therefore, upon motion made by Commissioner Robert Graves, seconded by Commissioner Macdonald
and carried, Alex MacWilliam, Jr. was appointed a member of the Board of Adjustment.

Sherman N. Smith, Jr. stated that he.had contacted Al Briggs with respect to
serving on the Planning and Zoning Commission in place of Robert W. Graves, who had resigned,
and that Al Briggs had accepted the appointment.
The following Confederate Pensioner in Indian River County was approved:

quested that Pasco Woods, Judge of the Small Claims Court be paid an allowance/ of $80.00
instead of $40.00 per month. Upon Motion made by Commissioner Macdonald, seconded by Robert
W. Graves and carried, the same was approved.
Mrs. Tennie Lee Bradley and Sam Bradley, representing Mr. Ansin, appeared befox
the Board and renewed their request for the extension of 20th Avenue to Oslo Road be opened
with the understanding that Mr. Ansin would pay $4,000.00 toward the construction of a bridge
over the South Relief Canal. Mrs. Bradley stated the right-of-way for thislroad extension
would be given with the exception of that through some land owned by Dr. Nude and it was
reported Dr. Nuzie had refused to cooperate and give the right of way to the County. Theref
upon Motion by Commissioner Macdonald, seconded by Commissioner McCullers and carried, the
Attorney, Shertman'N. Smith, Jr. was requested to proceed with condemnation proceedings on
Dr. Nuzie's land in order to open up 20th Avenue to Oslo Road. Attorney Smith was also re-
quested to write a letter to Mr. Ansin to send the $4,000.00 in order that the Board could
proceed with the matter.
At this point Chairman Graves then turned the meeting over to, Attorney Smith
who asked for nominations for Chairman. W. C. Graves, Jr. was nominated by Robert W. Graves.
J. J. P. Hamilton was nominated by D. B. McCullers, Jr. Upon motion made by Commissioner
1 Macdonald,. seconded by Commissioner McCullers and carried, nominations for Chairman were then
closed. Upon roll call voting for W. C. Graves, Jr. were Robert W. Graves and W. C. Graves,

p Hamilton. The vote was then made unanimous in favor of J. J. P. Hamilton for.Chairman upon
Motion made by W. C. Graves, Jr., seconded by Robert W. Graves and unanimously carried.
Attorney Smith then turned the meeting over to Chairman Hamilton who asked for
�9 nominations for Vice Chairman. Robert W. Graves was nominated by W. C. Graves, Jr. D. B.
McCullers, Jr. was nominated by Donald Macdonald. It was then moved by Commissioner W. C.
° Graves, Jr., seconded by Commissioner Macdonald and unanimously carried that nominations for
11 Vice -Chairman be closed. Upon roll call and voting for Robert W. Graves, were W. C. Graves,
Jr., and voting for McCullers were Macdonald, and McCullers, which was a tie vote, wereupon

Chairman Hamilton voted for Mccullers, thereby electing him as vice chairman. It was then
moved by Commissioner Robert W. Graves, seconded by Macdonald that the vote for McCullers

County Service Officer, Forrest N. McCullers, County Agent, L. C. Royal, Janitor.
E. E. Carter, Road & Bridge Superintendent, tendered his resignation as County
Road and Bridge Superintendent. Upon Motion by Commissioner Robert Graves, seconded by
Commissioner W. C. Graves, Jr. and unanimously carried, Mr. Carter's resignation was rejected.
Upon Motion of W. C. Graves, Jr.., seconded by Commissioner Macdonald and unanimously carried,
Mr. E. E. Carter was appointed Superintendent of Public Roads for the ensuing year.
It was then moved by Commissioner Macdonald, seconded by Commissioner W. C.
Graves, Jr. and unanimously carried that the Superintendent of Public Roads install a foreman
who is charged with the responsibility and invested with the authority to operate the main-
tenance division, including all equipment and personnel under the general direction and super-
vision of the Superintendent of Public Roads.
Mrs. Anne*Christensen, County Welfare Case Worker,.appeared before the Board
and gave a report of her activities for the month of December, and same was ordered filed by
the Clerk.

These two bids identical. So it was decided to buy one-half from one and one-half from the
other.
W. J. Roschach, appeared before the Board and discussed the abandoning of a
certain road in Tropicolony, Inc. subdivision. Sherman N. Smith, Jr. was requested by the
Board to draw up the necessary petition and present same at the next regular meeting of the
Board.
Flip Lloyd of Lloyd & Associates, appeared before the Board requesting certain
plats be tentatively approved subject to completion and subject to county regulations. Upon
Motion made by Commissioner Macdonald, seconded by Commissioner W. C. Graves, Jr. and unanimous-
ly carried the Board tentatively approved the following plats: Floravon, Ranch Estates #1,
King's Highland, and Graves Annex, also a part of Fellsmere Farm Company Subdivision.
A delegation from Fellsmere being Messrs. Bussey, Jones, Medlin, Smith and
Day, appeared before the Board and requested the Board ask the State Road Department to surface
and resurface the area East of Tallahassee Park to Broadway being a distance of one-half mile
and identified as State Road #512. The Board requested Attorney Smith to draw up a Resolution
for the next regular meeting.

Pursuant to the foregoing Notice (Proof of Publication), the following

R E S O L U T I O N
BE IT RESOLVED by the Board of County Commissioners of Indian River County,
I
Florida, that this Board does herewith find and determine as follows:
{ 1. That Pilliam L. Bidlingmayer and Moffie S. Bidlingmayer, his wife, filed
a Petition before this Board on the 4th day of December, 1956, at a meeting of said Board,
requesting this Board to adopt a Resolution closing, vacating and abandoning the road or
street and renouncing and relinquishing the rights of Indian River County, Florida, or the
' public, in and to all that part of a certain road situated in Indian River County, Florida,
described as follows:
All that part of that certain road described in Deed Book
91, page 493, in the office of the Clerk of the Circuit
Court of Indian River County, Florida, that lies South of
the South line of the North 10 acres of the Northeast
quarter of the Northeast quarter in Section 31, Township
33 South, Range 40 East, and ALSO,
All that portion of said above described road over, on and
across the North S chains of the Southeast quarter of the
Northeast quarter of Section 31, Township 33 South, Range 40
East.
2. That this Board has published Notice thereof one time in the Vero Beach
Press Journal, a newspaper of general circulation in Indian River County, Florida, said
publication being published at least two weeks prior to the date stated therein for such
public hearing.
3. That the part of said road above described is not -a State or Federal road
maintained by the State of Florida and that said street, road or highway delineated on any
recorded map or plat is not located within the incorporated limits of any municipality and
is located in Indian River County, Florida.
4. That a public hearing thereon has been held by the Board of County Comm-
issioners of Indian River County, Florida, in the office of said Board in the Indian River
County Courthouse, Vero Beach, Florida, on January S, 1957, at 10:00 o'clock A.M.; and
BE IT FURTHER RESOLVED, that this Board does herewith close, vacate and
any public or private street, road, alleyway or other place used for travel and all portions
thereof and does herewith renounce and disclaim any right of Indian River County, Florida,
and the public in and to all land delineated as a street, road or highway as to that certain
road above described.
UPON Motion made by Commissioner Macdonald, seconded by Commissioner Robert
Graves and carried, the following letts of agreement were authorized relating to obtaining
right of way deeds on State Road #5 or U. S. #1 for the Sebastian - Wabasso area.

1. The County will move your house back from the right of way the same i
distance as the additional right of way being taken and will set up and
reestablish your house in as good condition as the same existed prior to
moving.
All of the above will be done prior to the time of taking possession of the
right of way and, in the meantime, you may continue in possession.

Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner

i Macdonald and unanimously carried, the Board accepted the offer submitted by J. W. Boring,
Attorney for Vero Beach Associates, Inc., of some land in Oslo Park Unit No. 2 lying between
Alabama Avenue and Oklahoma Avenue for public park purposes. Vero Beach Associates, Inc. is
i to give the County a Quit Claim Deed to this land and they will satisfy a mortgage against this
property upon delivery of the deed. The County also agreed to take care of the 1956 County
if and Drainage taxes on this land. Clerk Baker was instructed to record said deed and charge to
the county.

Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner
Macdonald and unanimously carried the.Board authorized that the proposed Typical Secion pre-
pared by the State Road Department of Florida for State Road Job 8859-150, State Road S632
(South Winter Beach Road) and the estimated cost thereof of $70,000.00 be approved.

The several bills and accounts against the County, having been audited, were

examined and found correct, were approved and warrants issued in settlement of same. Such
bills and accounts. being on file in the office of the Clerk of the Circuit Court, the warrants r°
so issued from the respect a funds being listed in the Supplemental Minute Book as provided
by the rules of the State Auditor, reference to such record and the list so recorded being
made a part of these minutes.
The County Depository filed its monthly statement, showing receipts, and dis-
bursements of the various funds, which have been audited, were found to be correct.

There being no further business, on motion made, seconded and carried, the
Board adjourned until 9:00 o'clock A. M. January 15, 1957.

A Special Meeting of the Board of County Commissioners of Indian River County,
Florida was held at the Courthouse, Vero Beach, Florida at 9:00 o'clock A. M. Tuesday,
January 15th. Present were Chairman J. J. P. Hamilton, W. C. Graves, Jr., Robert.W. Graves
and D. B. McCullers, Jr. Absent was Donald Macdonald. Also present were Sherman N. Smith, Jr.a
Attorney, E. E. Carter, Superintendent of Roads and Katherine Morrison, Deputy Clerk.
Siiice the Chairman, J. J. P. Hamilton was a little late, Vice Chairman called
the meeting to order and requested the Attorney, Sherman N. Smith, Jr. to read the Notice
of Public Hearing, said notice being attached herewith and made a part of these minutes.
