This Amendment to Work Order Number 1 is entered into as of this 1Rthday of September , 200 7 pursuant to that certain Continuing Contract Agreement for Professional Services entered into as of August 10 , 2004 and amended effective July 24 , 2007 (as so amended , the "Agreement'), by and between Indian River County Solid Waste Disposal District, a dependent special district of Indian River County, Florida ("District' ) and Brown and Caldwell (Corporation), a California Corporation ("Consultant') . The District has selected the Consultant to perform the professional services set forth on Exhibit 1 , attached to this Work Order and made part hereof by this reference . The professional services will be performed by the Consultant for the fee schedule set forth in Exhibit 1 and within the timeframe more particularly set forth in Exhibit 1 , all in accordance with the terms and provisions set forth in the Agreement. Pursuant to paragraph 1 .4 of the Agreement, nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . Fell , Assistant ounty Attorney EXHIBIT 1 ATTACHMENT 1 TO AMENDMENT NO. 1 INDIAN RIVER COUNTY SOLID WASTE DISPOSAL DISTRICT FELLSMERE CONVENIENCE CENTER EXPANSION SCOPE OF SERVICES Amendment No. 1 modifies the scope of work in Brown and Caldwell ' s Work Order No . 1 for planning, design, permitting, and construction of an expansion to the existing Fellsmere Convenience Center located at 12510 C .R. 512 to include site planning, surveying, geotechnical and environmental site investigations, permitting, engineering and landscaping design, bidding assistance and construction phase services . In addition to on-site improvements, the project also includes off-site improvements consisting of utility extensions and roadway improvements . Amendment No. 1 is being implemented at this time for engineering work related to planning, design, and permitting of the expansion to the existing Fellsmere Convenience Center located at 12510 C .R. 512. Included in this Amendment No . 1 are the services for site planning, engineering, landscaping, and permitting needed to obtain Indian River County Planning Department approval of the proposed project. The original Scope of Services did not anticipate the need for this approval process . The project location consists of two adjacent tracts, one in the City of Fellsmere and one in unincorporated Indian River County. The original project scope indicated engineering services for one site plan submittal process through the City of Fellsmere, anticipating the smaller unincorporated county parcel would be annexed into the larger parcel located within the city limits . At the Owner' s request, for county planning review and permitting purposes, the parcel was not annexed and required planning, design and permitting to be conducted through the additional County site planning process . The following Scope identifies the Tasks required to obtain the County site planning and permitting approval . ORIGINAL TASK 1 — PROJECT MANAGEMENT Additional work activities to be completed under Task 1 include the following : 1 . Project Design Review Meetings - Conduct project design review of the site plan and submittals required for County approval. 2. Quality Control — Conduct weekly staff meeting with design team members to maintain flow of work, review and coordinate work products and communicate design: requirements ; revisions ; schedule . ORIGINAL TASK 3 — PRELIMINARY DESIGN PHASE Amendment No. 1 does not require any additional work under Task 3 . ORIGINAL TASK 4 — SITE PLAN APPROVAL Additional work activities to be completed under Task 4 include the following: 1 . Preliminary Site Plan and Calculations - Develop preliminary site plan conforming to Title IX of the Indian River County Code showing existing site conditions , right-of- ways and easements, proposed demolition, proposed site improvements and stormwater systems within the County parcel. Provide dimensional data and develop site data calculations differentiating the Fellsmere and County parcels . Complete and submit application for site plan review. 2. Final Site Plan Submittals — Revise initial site plan submittal per comments from County Planning Department review. Prepare all accompanying exhibits and submittals required for site plan approval. Complete and submit applications for Indian River County development permits. 3 . Landscaping — Revise the landscape design within the County parcel to comply with Indian River County Ordinance 2007-012 (Landscaping Revisions). Coordinate landscaping requirements with site plan development to provide appropriate grading and location for landscape buffers and strips ; opaque features ; and irrigation facilities . Locate and calculate final vegetation quantities . ORIGINAL TASK 5 — CONSTRUCTION PLANS AND SPECIFICATIONS Additional work activities to be completed under Task 5 include the following: 1 . Paving_, Drainage. Grading - Revise grading plans to comply with Indian River County LDR' s . 2. Landscaping — Prepare final construction plans and specifications for landscaping in conformance with both City of Fellsmere and Indian River County LDR' s . ORIGINAL TASK 6 — PERMITTING Additional work activities to be completed under Task 6 include the following: 1 . ORIGINAL TASK 7 — BIDDING SERVICES Amendment No. 1 does not require any additional work under Task 7 . ORIGINAL TASK 8 — CONSTRUCTION PHASE SERVICES Amendment No. 1 does not require any additional work under Task 8 . ORIGINAL TASK 9 — OFF SITE ROADWAY IMPROVEMENTS Amendment No. 1 does not require any additional work under Task 9. ORIGINAL TASK 10 — REIMBURSABLE EXPENSES Additional work activities to be completed under Task 10 include the following: 1 . This increases the overall cost of Work Order No. 1 from $ 179 , 875 to $ 190,875 . An approximate breakdown of this lump sum amount, by task, is presented below.
