Oslo Road Widening between 43 `d Avenue and 27th Avenue
AMENDMENT NO. 1 TO THE PROFESSIONAL ENGINEERING/LAND SURVEYING
SERVICES AGREEMENT BETWEEN KIMLEY-HORN AND ASSOCIATES, INC. AND
INDIAN RIVER COUNTY, FLORIDA.
This is an amendment to the existing Engineering/Land Surveying Services Agreement (AGREEMENT)
dated May 24th, 2005 between Kimley-Horn and Associates, Inc. (ENGINEER) and Indian River County
(COUNTY) . This amendment addresses changes in " Section III - Scope of Services", " Section V -
Compensation" and "Section XVI — Duration of Agreement" of the AGREEMENT.
Amendment Description
This Amendment includes the following :
"SECTION III — SCOPE OF SERVICES " is being modified to incorporate the following:
The COUNTY desires to have subsurface utility locates performed along Oslo Road between 27th Avenue
and a point approximately 1 ,000 feet west of 581h Avenue (2 .2 miles) to aid in corridor design. Oslo Road
between 27th Avenue and 43'd Avenue ( 1 .0 mile) is being designed by the ENGINEER. Oslo Road
between 43 `d Avenue and 58th Avenue is being designed by the COUNTY.
Subsurface Utility Locates
The ENGINEER will utilize ASCE Standard 38-02 — "Standard Guidelines for the Collection and
Depiction of Existing Subsurface Utility Data" on this project. The ENGINEER will research and
obtain available utility records (Quality Level "D" utility as-builts) along the corridor and
horizontally mark (Quality Level `B" utility designations) and survey, from project control
provided by the ENGINEER/ COUNTY, two known toneable underground utilities (water main
and force main) .
The project is approximately 2 .2 miles in length. These utilities will be marked utilizing standard
marking paint and/or flags to ensure accuracy in the collection of the information. The
ENGINEER will provide a 2D cadd file depicting the surveyed utility designations along the
corridor. From this utility designation file, the ENGINEER/ COUNTY will be able to determine
potential conflict sites . Once potential utility conflicts have been identified by the ENGINEER/
COUNTY, the ENGINEER will perform test holes (Quality Level "A" utility locates) and survey
the locations from existing survey control. The ENGINEER will update the 2D designation cadd
file with each test hole and also provide the COUNTY with a test hole summary report depicting
horizontal coordinates, vertical elevation, direction, type and approximate size of each utility
found.

Surface utility locate deliverables will consists of Quality Level "B" utility designation cadd file
for the existing water main and force main along with Quality Level "A" utility locates (test holes)
at identified conflict sites identified by the ENGINEER/ COUNTY.
Subsurface Utility Engineering Conditions and Understandings
The utility markings are for design purposes only. The Florida One Call must be notified forty-
eight (48) hours in advance of any excavation.
Accuracy of Geophysical Mapping methods, although highly reliable, is subject to outside
interference. Depth, soil conditions, material conductivity, and other geological anomalies that
may distort Electromagnetic and GPR frequencies . The ENGINEER will not access confined
spaces. If confined spaces need to be accessed for locating purposes than the COUNTY will be
notified and further arrangements will be made for said access. Additional fees may be applicable.
If Due to traffic conditions additional MOT is required and beyond the capability of the
ENGINEER' s standard MOT operations, the ENGINEER will notify the COUNTY and provided
and additional fee for the MOT operation. The ENGINEER will make every effort possible
utilizing state of the art technology to designate underground utilities; however there are no
guarantees that all underground structures will be detected.
Simnalization Design Revisions
Due to alignment modifications associated with Oslo Road Phase I Widening (approximately Old
Dixie Highway to 27th Avenue), the signalization plans associated with the Oslo Road/ 27th
Avenue intersection must be revised.
" SECTION V — COMPENSATION" is being modified to incorporate the following:
The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered pursuant
to this Agreement fees inclusive of expenses in accordance with the following :

"SECTION XVI — DURATION OF AGREEMENT" is being modified to incorporate the following:
The time for completion of the Level `B" Utility Designation shall be 60 days following receiving
the authorization to proceed. The time for the Level "A" Utility Locates are 45 days following
location designation from the ENGINEER/ COUNTY.
The AGREEMENT is hereby amended as specifically set forth here in. All other sections of the
AGREEMENT shall remain in full force and effect and are incorporated herein.
This Amendment No. 1 to the AGREEMENT regardless of where executed, shall be governed by and
construed by the laws of the State of Florida.
