TUESDAY, MARCH 5, 1957
The Board of County Commissioners of Indian River County, Florida, met at the
Courthouse in Vero Beach, Florida in a regular meeting at 9:00 o'clock A. M., March 5, 1957.
Present were J. J. P. Hamilton, D. B. McCullers, Jr., Robert W. Graves and Donald Macdonald.
Absent was W. C. Graves, Jr. Also present were E. E. Carter, Superintendent of Roads,
Sherman N. Smith, Jr., Attorney, Sam T. Joyce, Sheriff and Douglas Baker, Clerk.
Upon Motion made by Commissioner Robert W. Graves, seconded by Commissioner
McCullers, and unanimously carried, minutes of February 5th regular meeting, February 15th
special meeting, and February 25th special meeting were approved as read.
Sherman N. Smith, Jr., Attorney, reported that he had written to the State
Road Department with reference to relieving the drainage situation on Emerson Avenue, but

up till this time had received no answer from them. •
Commissioner Robert W. Graves, reported that he and Mr. J. R. Holman had picked',
out pictures to go in the ad in the Florida Opportunity Journal and stated they would give a
good pictorial account of the county as a whole.
Sherman N. Smith, Jr. reported that Commissioner W. C. Graves, Jr. had gone
to Fort Pierce and looked over their Old Folk's Home and the running of same. He stated
this home was run by a Welfare Board and that he didn't think it would work out too well for
us here, however, Fort Pierce is to send us a report of how their Home is run. When said
report is received the Commissioners decided they would go into the situation more fully.
Sherman N. Smith, Jr. reported that he had written to the U. S. Corp of
Engineers and the U. S. Airforce requesting a conference with them with regard to obtaining
several acres of land on the Beach north of Rice's pier, now owned by the U. S. Government,
and that he had received word from the Airforce .they will meet with him any time. He stated
that as yet he has heard nothing from the Corp of Engineers.
Attorney Smith also reported that he had arranged with the Bank for a loan of
$4,000.00 to be paid to the City of Sebastian, relating to the right of way agreement on U.
S. #1 Highway. •
The County Attorney presented to the Board the right of way contract between
the.County and the State Road Department for SRD #231, Section 8801-110 (207)(151) State Road
5, Indian River County, Florida, duly executed by the State Road Department. Same was ordered,
filed.
Forrest N. McCullers, County Agent, appeared before the Board requesting the
County allow him to employ a man to rework the County's booth at the Florida State Fair and
to install a Diorama in the Center of the Booth. He stated that this would cost $2,000.00
if ordered now but if we waited until the fall, it would cost much more. He also stated
that the $2,000.00 would not have to be paid until in next year's budget. Upon Motion made
by Commissioner Macdonald, seconded by Commissioner McCullers and unanimously carried, the
Board authorized County Agent McCullers to go ahead and order the work done, and the $2,000.001:
would be appropriated in next year's budget.

Pursuant to the foregoing notice requesting bids on One Tudor Standard Model

11 Six cylinder automobile, the following bids were received:

Arnold Offutt Ford, Inc. - - - - - - - - - - Price $1514.38
Roland Miller Chevrolet, Inc.- - - - - - - - - - Price $1499.90.
Upon Motion made by Commissioner Robert Graves., seconded by Commissioner Mac-
donald and carried, the Board accepted the low bid by Roland Miller Chevrolet, Inc. for the
price of $1499.90.
Roland Miller and Kenneth Franks appeared before the Board and requested that
something be done about Road A -1-A, stating that a 3 mile strip was almost impassable. Upon
Motion made by Commissioner Robert Graves, seconded by Commissioner Macdonald and unanimously
carried, the Board requested E. E. Carter, Superintendent of Roads to make an estimate of how
much it will cost to rework this stretch of road and submit these figures to the Commissioners

at their next regular meeting.
Mr. Humphries of Wabasso appeared before the Board with reference to an outfall!;
ditch to be put in on his land for the new U. S. #1 Highway. He was advised by the Board
that any changes in this ditch would have to be made by the State Road Department. Sherman
advised him that he would take it up with the State Road Department.
Mrs. Anne Christensen, County Welfare Case Worker, appeared before the Board
and made a report of her activities for the month of February, and same was ordered filed by
the Clerk.

Mrs. Christensen reported that Mrs. Jeffries was in need of nursing home care.
Upon Motion made by Commissioner Macdonald, seconded by Commissioner McCullers and carried,
the Board authorized $35.00 per month toward her care in a nursing home.
A proposed typical section was submitted by the State Road Department for State
Road #8858-151 - Glendale Road from State Road 505A to State Road 5, budgeted amount $1000,000.
for approval. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner Mc -
Cullers and unanimously carried, said typical section was approved.
A proposed typical section submitted by the State Road Department for 16th
Street in the City of Vero Beach from State Road 505 to State Road #5 estimated budgeted
amount $57,400.00 for approval. Upon Motion made by Commissioner Robert Graves, seconded by
Commissioner McCullers and unanimously carried, said typical section was approved.
The County Attorney read a letter to the Board from L. B. Vocelle requesting
permission to Repeal the Legislative Act vesting the Board of County Commissioners with the
power to regulate the hours of sale of alcoholic beverages in Indian River County. After
considerable discus sion in the matter and upon Motion made by Commissioner Macdonald, seconded
by Commissioner McCullers and carried, the Board of County Commissioners requested the
Attorney to advise L. B. Vocelle, Representative from Indian River County that it is the con-
sidered judgment and opinion of the Board that Chapter 29196, Laws of Florida, 1953, granting
the Board of County Commissioners the power to regulate the sale of alcoholic beverages
throughout Indian River County, should not be repealed, but to the contrary this power should
be vested in the Commissioners.
E. E. Carter, Superintendent of Roads, requested the Commissioners ask that
a special act be passed in the Legislature, whereby the County would pay the full amount of
Blue -Cross - Blue Shield Insurance instead of part as they are now doing. Upon Motion made by;
Commissioner Robert Graves, seconded by Commissioner McCullers and unanimously carried, the
County Attorney was requested to submit a bill to Legislator L. B. Vocelle to be passed in
this Legislature whereby the County would pay the full amount of Blue Cross - Blue Shield
Premiums for all County Employees.
It was brought out that since the resignation of Col. A. V. Lill as Director
of Civil Defense in Indian River County that no one had been selected to replace him.
Commissioners McCullers and Robert Graves were appointed as a committee to find someone to
replace Col. Lill as Director of Civil Defense in Indian River County. r

Mr. Weller is talking to me about the County commitment letter of June 5th.
Mr. Weller tells me that in our discussion with him he understood me to
agree to the building of a new concrete block sign whereas I thought we
were taling about the fact that we would rewire any new sign instead of
rewiring this old sign if he wished. At any rate, I have told him today
that you have my permission to make any deal with him on these items in
this letter which the two of you can agree upon so long as the overall
cost to the County will not be increased.

1. The County will pay to you immediately the sum of $960.00, which said sum
is paid to you in order that you will immediately fill the Western part of
this lot to grade in order that your house may be moved back on this filled area.
2. The County will, without expense to you, move the house on the property
back off the right of way on the filled area and set up and reestablish the house
in as good condition as the same exists prior to moving. This will include
either connecting up the house to the present water line that passes from the
West side of the road to the East side of the road and seeing that the water
line remains after this construction or drilling an artesian well for your
joint use as well as your neighbors who are presently using water from a well
on the East side.
This agreement is approved by the Board of County Commissioners at its meeting

Mr. and Mrs. Leach are in the office now and they tell me thay have been moved,
so there remains only the matter of their well and septic tank.
They have shown me a contract with 0. F. Pippin totaling $431.00 for the well,
and an estimate from Indian River Septic Tank Service for $142.52 for the septic
tank. As you know, we have agreed to either do these two items ourselves or
pay them for them and let them do it later. Mr. and Mrs. Leach now tell me
they would prefer to have the money and they will do the items. If you think
the County cannot do them at any less cost, it seems to me that it would be
advisable for us to simply pay them the money.
Would you check into this and if you agree, tell Doug to whom I am sending a copy
of this letter, so that he can send them a County check for this item.

Mr. Troy E. Moody, County Tax Collector, appeared before the Board with respect,.
to the Audit Report of the Tax Collector's Office #4504, a copy of which was filed with the
Board by the State Auditing Department of the State of Florida. Mr. Moody tendered to the -
'Board his check in the sum of $1344.60, for the year 1955, and $247.59 for the year 1956, with,.,
the statement that these checks represented compensation paid by the Tax Collector to Mrs. M. L
Moody during the period of time from April 1955 to February 1956, insofar as the total sums
;'',paid to her during that period of time are prorated between the Board of County Commissioners "

;and the School Board. Mr. Moody advised the Board that he gave the School Board his check in
the sum of $275.40 for the year 1955, and $67.41 for the year 1956, which represents their
prorata share. These four checks being in effect repayment for all of the compensation paid
to Mrs. Moody during that period of time.
Mr. Moody further advised the Board that all salaried compensation paid to Mrs.
;M. L. Moody during the period of that Audit report was paid to her for services actually
'rendered to the office and which payment was commensurate with the compensation paid others for
e
esimilar services.
With respect to the statement of the Auditor dealing with Special Drainage
,,Districts, the Collector advised the Board that to begin with, these are really very small i
lin so far as money is concerned and that he has set up a system of prorating and charging to
;income received from drainage districts what he considers as its prorate share of the expense
of the office.
Mr. Moody advised the office that with respect to the audit dealing with auto-
mobile expenses, that they were actual sums paid out by him for use of his automobile during
the period of time in the course of business of the office, and that the same statement is
correct with respect to the amount charged for travel, hotel and transportation expense.
With respect to the use of the validating machine, the collector reported that

;the machine has always been used on the collecting of county taxes since its installation, but
'that drainage taxes of all districts until the Indian River Farms Drainage District began using
the County form of receipts were hand written receipts because the forms used could not be
used in the validating machine, and there are other instances of receipts of the office which
are not on forms for use on the validating machine.
i Upon Motion made by Commissioner Macdonald, seconded by Commissioner McCullers
and unanimously carried, the Board accepted Mr. Moody's statement and the checks, and considers
,the matter closed.
The several bills and accounts against the County, having been audited, were

examined and found correct, were approved and warrants issued in settlement of same. Such
is
bilis and accounts being on file in the office of the Clerk of the Circuit Court, the warrantsd
so issued from the respective funds being listed in the Supplemental Minute Book as provided
by the rules of the State Auditor, reference to such record and the list so recorded being
made a part of these minutes.
The County Depository filed its monthly statement, showing.receipts, and dis-
bursements of the various funds, which have been audited, were found to be correct.
There being no further business, on motion, made, seconded and carried, the
Board then adjourned.

A Special meeting of the Board of Couriy Commissioners of Indian River County,
Florida was held at the Courthouse, Vero Beach, Florida at 9:00 o'clock A. M. Friday, March
229 1957. All members were present. Also present were Sherman N. Smith, Jr., Attorney,
E. E. Carter, Superintendent of Roads and Katherine Morrison, Secretary.
Chairman Hamilton announced this meeting was called for the purpose of accept-
ing bids on Automobile Liability and Property Damage insurance, and Workmen's Compensation
insurance.

l consisting of American Ins urance Agency, Buckingham -Wheeler Agency, Moore Insurance Agency,
! Ed Schlitt Agency, Warren T. Zeuch Agency; stating they appreciated the opportunity to bid on
the Automobile Liability renewal but were unable to do so from the lack of time in which to

promulgate proper rates. They also recommended that the County place the entire responsibili
of handling County insurance business with the Indian River Association of Insurance Agents

and they would review the county's insurance coverage, and then make recommendations to the
county commissioners for their final decision.
After considerable discussion in the matter, Motion was made by Commissioner
!j Macdonald, seconded by Commissioner McCullers and carried, to accept Rudy Hubbard's bids both
on the Automobile Liability and Workmen's Compensation insurance.

Commissioner Robert W. Graves introduced to the Board Colonel Leo M. 0!Brien
p who volunteered as Director of Civil Defense. Colonel O'Brien stated that he was a resident
of the county and had 40 -years military experience in the airforce and would do all he could

for the Civil Defense program. Upon Motion made by Commissioner Robert W. Graves, seconded
by Commissioner Macdonald and unanimously carried, it was decided that Lea M. -O'Brien, Colonel
U. S. Airforce Retired, be herewith appointed as Director of the Indian River County Civil
J Defense, according to Chapter 252, Florida Statutes.
Upon Motion made by Commissioner W. C. -Graves, Jr., seconded by Commissioner
4� Robert W. Graves and unanimously carried, resolution was passed to extend to Colonel Lill the
Boards appreciation for his services rendered as Civil Defense Director of Indian River. County

WHEREAS, A. V. Lill, Colonel, United States Army Retired, has served as Director,
of the Indian River County Civil Defense Council for a period of many years; and,
WHEREAS, Colonel Lill has been most active and has practically single-handed
;promoted and carried on the Civil Defense program of this County during that period of time,
attending many meetings and advising the public on Civil Defense plans in the event of an
emergency existing in this County and
WHEREAS, it -has become necessary for personal reasons for Colonel Lill to resign

Homer C. Fletcher, Tax Assessor -appeared before the Board and stated that he
had received permission from the Governor to.close the Tax As sessor's Office in the afternoons
until the 1957 tax roll has been completed and presented to the Board of Equalization, subject

to the approval of the Board of County Commissioners, and with proper notice being given to
the public. Upon Motion made by Commissioner Robert W. Graves, seconded by Commissioner Mc -
Cullers and unanimously carried , the Board also approved the closing of the Tax Assessor's
Office as heretofore stated.
Mrs. Cuttshaw of Sebastian appeared before the Board with reference to the county
moving her cabins back off the right of way. She stated that John Massey gave her an estimate of
$2600.00 to do the work and she couldn't understand why it would cost so much. Commissioner
W. C. Graves, Jr. suggested the Board give her twelve or thirteen hundred dollars and let her
get the work done herself. After considerable discussion it was decided that she should get an _.
estimate from someone else as to how much the work would cost and they would work with her from
there.
The following letter of agreement was accepted upon Motion made by Commissioner
Macdonald, seconded by Commissioner McCullers and unanimously carried.

of this property which fronts on the street on the West side of
the property. The house will be set up and reestablished in as
good condition as the same existed prior to moving, which will

All of the above will be done prior to the time of taking poss-
ession of the right of.way and, in the meantime, you may continue
in possession.
This agreement is approved by the Board of County Commissioners

R E S O L U T I O N -- Secondary Road Program
YEAR 1957-1958 COUNTY OF INDIAN RIVER
WHEREAS, under Chapter 26.321 of the Extraordinary Session of 1949, known as
the "Secondary Road Assistance Act of 1949", and Section 139 of the Florida Highway Code of
1955, the State Road Department will receive 807.of the proceeds of this county's pro -rata
`i share of the Seventh Cent Gasoline tax to be used asrescribed b regulations of the said

Department within this County, as requested by resolution of this Board of County Commissioners
and approved by the Department for one or more of the following purposes: Construction,
'+ reconstruction, maintenance and repair of State roads and bridges, the lease or purchase of
bridges connecting State roads, the acquisition of rights-of-way for State roads, and the re-
duction of road and bridge indebtedness; and
WHEREAS, The State Road Department has requested this County Board to recommend
the purpose for which, and the roads on which, this County's 80% surplus gas tax and Federal
Aid Secondary allocations should be spent for construction and improvement; and
WHEREAS, the State Road Department requires this information so that it may be
considered in the preparation of the Annual Budget of the State Road Department; and
WHEREAS, this Board conferred with the State -Road Department concerning the
projects to be selected and the specifications with respect thereto,

NOW, THEREFORE, BE IT RESOLVED THAT The State Road Department is hereby re-
quested to use such funds for construction (including rights of way acquisition, surveys,
maintenance, etc.) of the following raods:
1. South Winter Beach Road or State Road S-632, from State Road 505 East

2. 16th Street in the City of Vero Beach or State Road # , Job #8860,
from State Road 611 to State Road #5.
3. Glendale Road or State Road # , Job #8858, from La teral B Road or

BE IT FURTHER RESOLVED That
the methods
and standard employed by the State
Road Department for determination of major
improvement
features, including the types and
widths of pavement, and the Department's standard specifications for construction are con-
curred in and approved by this Board. It is requested: That the Department will consider the,
projects in the order listed above insofar as practicable, but not to the extent of retarding the
whole program; that the termini of the projects as described in the resolution and shown on
the accompanying may, rather than any estimate of funds therefor, shall control the Depart-
ment's allocation of funds; that this resolution shall remain in effect throughout the year;
and that after the current year the recommendations of this resolution shall constitute a
continuing improvement program for the County, unless changed by a subsequent annual resolu-
tion.

R E S O L U T I O N --- Primgry Road Program
WHEREAS, the State Road Department of the State of Florida is now in process
of preparing its annual budget for the year 1957-58; and,
WHEREAS, the Board of County Commissioners of Indian River County is vitally
interested in the additions, extensions and improvements to the primary road system of the
State of Florida in Indian River County, Florida; now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County,
Florida, that this Board does herewith respectfully request the State Road Department of
Florida to include and incorporate in its budget for the year 1957-1958 for primary roads
the following projects in Indian River County, Florida, to -wit:
1. The four-laning and improvement of State Road #5 on its appropriate rights
of way into a modern and adequate four lane highway from the North limits of the City of Vero
Beach to Wabasso.
2. The re -construction and improvement into a modern and adequate two lane
highway of State Road A -1-A from Beachland Boulevard in the City of Vero Beach to the Alorth

The Board of County Commissioners of Indian River County, Florida, met at the
Courthouse in Vero Beach, Florida in a regular meeting at 9:00 o'clock A. M., April 2, 1957.
Present were D. B. McCullers, Jr., Robert W. Graves, W. C. Graves, Jr. and Donald Macdonald.
Absent was J. J. P. Hamilton. Also present were E. E. Carter, Superintendent of Roads,
Charles Smith, Attorney, Douglas Baker, Clerk and Katherine Morrison, Secretary.
In the absence of J. J. P. Hamilton, Chairman, Commissioner McCullers, Vice
Chairman took over the chair and asked if there were any changes or additions to be made to
the minutes. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner Mac
Idonald and unanimously carried, minutes of March 5th regular meeting and March 22nd special

meeting were approved as read.
Mr. Fred Ballou, Assistant State Auditor appeared before the Board requesting
,that the salary of the Clerk to the Board of County Commissioners be raised from $275.00 per
month to $350.00 per month. He stated that because of the increased volumn of work required
of the Clerk and to be comparable to that paid by the surrounding counties he thought a salary
of $350.00 per month would be more in line. After considerable discussion in the matter and
,pupon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Macdonald and

;unanimously carried, the Board agreed to raise the Clerk's salary to $350.00 per month beginn-
1,ing the lst of April, 1957.
Upon Motion made by Commissioner W. C. Graves, seconded by Commissioner Mac-
donald and unanimously carried, the Board authorized a part time janitor be employed at a rate
of $1.10 per hour.
