HomeMy WebLinkAbout2006-149AMENDMENT NO. 2 TO 43rd AVENUE ROADWAY AND DRAINAGE IMPROVEMENTS PROFESSIONAL ENGINEERING SERVICES AGREEMENT This AMENDMENT, entered into this 2nd day of May 2006, by and between INDIAN RIVER COUNTY, a political subdivision of the State of Florida, hereinafter referred to as the COUNTY, and CARTER ASSOCIATES, INC., Vero Beach, Florida, hereinafter referred to as the ENGINEER. This AMENDMENT modifies the terms and conditions of the existing Professional Engineering Services Agreement dated October 7, 2003, between the COUNTY and the ENGINEER. This AMENDMENT stipulates changes in "Section I — Project Limits and Description", "Section II — County Obligations", "Section III - Scope of Services", "Section IV — Time for Completion", and "Section V - Compensation". SECTION I - PROJECT LIMITS AND DESCRIPTION Consultant services are required to present the 4 -lane concept for 43rd Avenue from 18`h Street to 8`h Street with dual travel lanes in each direction, a center median, right turn and left turn lanes at 16`h, 12`h, and 8th Streets, and bump -outs for U-turns at an "open house" style workshop to solicit public input regarding the project. SECTION II — COUNTY OBLIGATIONS The COUNTY agrees to provide a meeting place for the public workshop. SECTION III - SCOPE OF SERVICES The ENGINEER agrees to perform professional roadway design and related services in connection with the project as required and set forth in the following: A. General The ENGINEER will endeavor not to duplicate any previous work done on the project. After issuance of written authorization to proceed, the ENGINEER shall consult with the COUNTY to clarify and define the COUNTY'S requirements for the project and review all available data. B. Public Workshop The ENGINEER will prepare presentation boards depicting the 4 -lane conceptual plan for 43rd Ave and will organize and facilitate a public workshop to share the concept with the public and receive public feedback. The ENGINEER will prepare one 3'x5' rigid presentation board with the roadway outline overlaid on a color aerial photograph at I"=150', and three 2'x3' rigid presentation boards; one each of the three 80 -foot constrained ROW cross section options. The ENGINEER will conduct the workshop for 2 -hours, in the early evening hours (e.g. 5pm-7pm), on a weekday, and will man the workshop with two staff members that are familiar with the project plans and details. 3. The ENGINEER will collect comment cards from those members of the public that are willing to provide comments. The ENGINEER'S staff will also keep notes of the verbal comments that they hear. The ENGINEER will consolidate both sources of comments and will provide a written report to the COUNTY of the opinions expressed by those at the workshop. SECTION IV - TIME FOR COMPLETION The time for completion of the presentation boards shall be four (4) weeks. The workshop shall be scheduled at the COUNTY'S discretion, after completion of the presentation boards. SECTION V - COMPENSATION The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered pursuant to this AMENDMENT, fees in accordance with the following: Public Workshop $9,597.75 TOTAL PROFESSIONAL SERVICES ............................................. $9,597.75 All tasks will be billed on a percentage complete/lump sum basis, plus direct expenses. The total billing shall not exceed $9,597.75 plus expenses, unless otherwise authorized by a separate written agreement. All other sections of the AGREEMENT shall remain in full force and effect and are incorporated herein. This AMENDMENT NO. 2 to the AGREEMENT regardless of where executed, shall be governed by and construed by the laws of the State of Florida.
