HomeMy WebLinkAbout2005-305 x G 4GINAL Amendment to the Professional Services Agreement TO : (Owner's Representative) Amendment Number : 2 In accordance with the Agreement dated : � = May 13, 2003 Between the Owner: Board of County Commissioners, Indian River County, Florida and the Architect : Donadio & Associates, Architects of Vero Beach, Florida For the Project : Indian River County New Administration Complex to be generally located on approximately 13 acres north of 26th) Street. east of 20th Avenue . south of Aviation Boulevard and west of Lateral " E " Canal in Vero Beach . Florida . This Project shall also include but not be limited to other such improvements as the Extension of 20th Avenue to the North and Construction of a Bridge across the Main Relief Canal connecting 20th Avenue with Aviation Boulevard . AMENDMENT NUMBER 2 : Authorization is Granted (X) to proceed with Additional Services or a Change in Services (X) to incur Reimbursable Expenses As Follows : The subject of this requested Amendment Number Two (2) is the design of a third facility (second facility to be located on 43 `d Ave . ) to be located on 43rd Avenue (Jackson Tract) . This building will accommodate the Emergency Services Department including the Emergency Operations Center which, because of the role of this building as a critical central hub of operations during emergency conditions it will be specially designed to operate under the most adverse conditions possible in accordance with the following criteria : Basis of Design : The Architect and Owner acknowledge and agree that the following design criteria as required by the State of Florida, Division of Emergency Management shall be the basis for the design of this Emergency Operations Center facility : A. The EOC shall meet the hurricane hazard safety criteria established in Standards for Hurricane Evacuation Shelter Selection (ARC 4496) . B . The EOC and essential ancillary structures and equipment shall be designed to resist the effects of a major hurricane . The wind design load requirements shall be ill accordance with the American Society of Civil Engineers (ASCE) Standard 7 , Minimum Design Loads for Buildings and Other Structures. The minimum wind design criteria shall include : Design Wind Speed = 200 miles per hour (3 second gust) Wind Importance Factor, 1 = 1 . 00 Exposure Category == C Directionality Factor, Kd = 1 . 00 Internal Pressure Coefficient = +/- 0 . 18 Pagel of 3 All components and cladding assemblies necessary to maintain a structurally enclosed condition and prevent rainwhter intrusion shall be designed to meet the wind design criteria . Roof cover waterproofing barriers shall meet the wind design criteria . Loose aggregate roof ballast shall not be used on the roof cover. Rooftop equipment shall be designed and installed to meet the wind design criteria . C . The EOC and essential ancillary structures and equipment shall resist penetration by windborne debris impact At a minimum, all exterior enclosure claddings and assemblies (i . e . , walls , roofs , louvers , outside doors , windows, etc . ) located within 60 feet in height above finish grade shall meet the hurricane windborne debris impact criteria specified in the Department of Energy's (DOE) Standard, Natural Phenomena Hazards Design and Evaluation Criteria, DOE-STD - 1020-2002 . That is , the building enclosure must resist penetration by a nominal 2 " x4 " lumber plank weighing 15 pounds propelled at 50 miles per hour striking end-on and normal to the assembly surface . As applicable, impact test procedures shall be consistent with recognized state and national standards ; such as , SBCCI Test Standard for Determining Impact Resistance from Windborne Debris SSTD 12 , American Society of Testing and Materials (ASTM) Standards ASTM E 1886 and ASTM E 1996, and Florida Building Code Testing Protocols TAS 201 , TAS 202 and TAS 203 . D . The minimum design elevation of the lowest floor for the EOC and essential ancillary structures and equipment shall be located outside of or elevated above : Category 5 storm surge elevation, the 500 year flood plain (if determined) , or the base flood elevation plus two feet, whichever is greater. E . The following information shall be shown on the construction drawings : 1 . wind design per ASCE 7 with applicable year of revision, 2 . design wind speed, 3 . wind importance factor, 4 . design wind exposure, 5 . design internal pressure coefficient, 6 . design wind pressures in terms of pounds per square foot (psf) to be used for the design of exterior component and cladding materials not specifically designed by the principal licensed design professional , 7 . windborne debris impact performance criteria, and 8 . finish floor elevation with comparison reference to the Category 5 storm surge elevation, 500 year flood elevation (if determined) , and the base flood elevation . F . The EOC and essential ancillary structures and equipment shall be designed for a minimum of 72 hours of continuous operation and shall not be solely reliant upon off-site utilities (e . g. , water, natural gas fuel , electricity, telecommunication and information technologies, etc . ) The design shall ensure that the EOC is equipped with survivable communications to receive and distribute warnings , and ensure connectivity with other EOGs , the State Warning Point, adjacent jurisdictions , and key response and recovery agencies and organizations . G . Force protection and security measures shall be consistent with the guidance published in Florida's Homeland Security Comprehensive Assessment Model(HLSCAM), United States Air Force Installation Force Protection Guide, or other federal or state recognized best-practices guides as approved by the Department . Authorization Authorization is granted to proceed with Additional Services as described herein and in accordance with approvals given at a regular meeting of the Indian River County Board of County Commissioners on Tuesday, August 2 , 2005 . The following adjustment shall be made to compensation . Compensation: Add : $375,700. 00 (Three Hundred Seventy-Five Thousand, Seven Hundred Dollars and No Cents) Reimbursables shall not exceed $ 30 , 000 . 00 Time : of design services : 10 (ten) months; to run concurrently with and independently of the Primary Contract. THIS CONTRACT SHALL HEREINAFTER BE KNOWN AS THE "PRIMARY CONTRACT" OTHER AMENDMENTS Authorization was previously granted for Amendment No . 1 on Tuesday, March 23 , 2004 AMENDMENT NO . 1 : The subject of amendment No . 1 is the design of a third building to be located on 43rd Avenue (Jackson Tract) which will accommodate other departments which, by virtue of their roles in County government, are more suited to that site . The off-campus building will provide the storage, staging area, and loading dock and administration space needed by the Supervisor of Elections who has agreed to this relocation of her main office . Also in the 43 `d Avenue building will be Buildings and Grounds and Animal Control facilities . Authorization was granted to proceed with the following Additional Services in accordance with approvals given at a regular meeting of the Indian River County Board of County Commissioners on Tuesday, June 22 , 2004 wherein: REQUESTED AMENDMENT NO. 20 The subject of this amendment is the design of a third facility (second facility to be located on 43 `d Ave . ) to be located on 43rd Avenue (Jackson Tract) which will accommodate the Emergency Services Department including the Emergency Operations Center which, because of its role as a critical central hub of operations during emergency conditions will be specially designed to operate under the most adverse conditions possible . Page 1 of 5 THE REQUESTED AMENDMENT ( AMENDMENT NO. 2) MODIFIES THE SCOPE OF WORK AS FOLLOWS . The Project : New Indian River County Emergency Management and Emergency Operations Center Facility containing approximately 16 ,000 square feet to be generally located on approximately 12 acres approximately one quarter mile north of 41st Street . west of 43rd Avenue . in Vero Beach . Florida This Project shall also include but not be limited to other such improvements as site design parking and stormwater facilities The Owner and Architect agree as follows : To design Emergency Services administrative offices and Emergency Operations Center to be located in one facility to meet the needs and responsibilities of the Director of Emergency Services In doing so the EOC and essential ancillary structures and equipment shall be designed to resist the effects of a major hurricane It shall be designed for a minimum of 72 hours of continuous operation and shall not be solely reliant upon off- site utilities (e . g . , water, natural gas fuel , electricity, telecommunication and information technologies etc.) The form of design should result in a strong and durable operational type structure The design shall meet recommended minimum operational standards as prescribed by the Florida Department of Emer ency Management . The Owner ' s Program is , Adequate area to support the identified users based on programming previously completed as part of the PRIMARY CONTRACT for the New County Administration Complex. and in accordance with standards prescribed by the Florida Department of Emergency Management for facilities of this type The financial parameters are as follows : . 1 Amount of the Owner's overall budget for the entire Project, including the Architect's compensation, is : $ 5,926,200.00 .2 Amount of the Owner's budget for the Cost of the Work, excluding the Architect's compensation, is : $5,284,450.00 . 3 The estimated Construction Budget for the building alone is $ 4,800,000 .00 1 . 1 .2 .6 The time parameters are : Proposed Design Schedule is based on the following duration of activities : 1 . ARTICLE 1 . 5 COMPENSATION 1 . 5 . 1 For the Architect's services as described under Article 1 .4 , or elsewhere herein. compensation shall be computed as follows : Add : Three Hundred Seventy-Five Thousand, Seven Hundred Dollars and 00 Cents ($ 375 , 700 . 00) Reimbursables shall not exceed $ 30 , 000 . 00 Progress Pavments shall be billed monthly based on the following_ Program Validation 5 % Schematic Design 15 % Design Development 20% Construction Documents 35 % Bidding/Negotiations 5 % Construction Administration 20% TOTAL 100 % ARTICLE 2 .3 EVALUATION AND PLANNING SERVICES 2 .3 . 1 The Architect shall provide a written preliminary evaluation of the information furnished by the Owner under this Agreement, including the Owner's program and schedule requirements and budget for the Cost of the Work, each in terms of the other. The Architect shall review such information to ascertain that it is consistent with the requirements of the Project and shall notify the Owner of any other information or consultant services that may be reasonably needed for the Project. Page 3 of 5 ARTICLE 2 .4 DESIGN SERVICES 2 .4 . 1 The Architect's design services shall include normal civil, structural, mechanical and electrical engineering and other such professional design services described herein as required to provide construction documents for a complete and usable facility. 2 .4 . 2 SCHEMATIC DESIGN DOCUMENTS 2 .4 . 2 . 1 The Architect shall provide Schematic Design Documents based on the mutually agreed-upon program, schedule, and budget for the Cost of the Work. The documents shall establish the conceptual design of the Project illustrating the scale and relationship of the Project components . The Schematic Design Documents shall include a conceptual site plan, if appropriate, and preliminary building plans, sections and elevations . At the Architect's option, the Schematic Design Documents may include study models, perspective sketches, electronic modeling or combinations of these media. Preliminary selections of major building systems and construction materials shall be noted on the drawings or described in writing . 2 .4 . 3 DESIGN DEVELOPMENT DOCUMENTS 2 .4 . 3 . 1 The Architect shall-provide Design Development Documents based on the approved Schematic Design Documents and updated budget for the Cost of the Work. The Design Development Documents shall illustrate and describe the refinement of the design of the Project, establishing the scope, relationships, forms , size and appearance of the Project by means of plans, sections and elevations , typical construction details, and equipment layouts . The Design Development Documents shall include specifications that identify major materials and systems and establish in general their quality levels . 2 .4 .4 CONSTRUCTION DOCUMENTS 2 .4 . 4 . 1 The Architect shall provide Construction Documents based on the approved Design Development Documents and updated budget for the Cost of the Work. The Construction Documents shall set forth in detail the requirements for construction of the Project. The Construction Documents shall include Drawings and Specifications that establish in detail the quality levels of materials and systems required for the Project. 2 .4 .4 .2 During the development of the Construction Documents, and as requested by the Owner. the Architect shall assist the Owner in the development and preparation of the Conditions of the Contract for Construction (General, Supplementary and other Conditions) . The Architect also shall compile the Project Manual that includes the Conditions of the Contract for Construction and Specifications and may include bidding requirements and sample forms .
