HomeMy WebLinkAbout2006-238 X06 - � 3 INDIAN RIVER COUNTY Roadway Improvements to East CR 510 and North AIA AMENDMENT NO. 2 TO THE PROFESSIONAL ENGINEERING/LAND SURVEYING SERVICES AGREEMENT BETWEEN KIMLEY-HORN AND ASSOCIATES, INC. AND INDIAN RIVER COUNTY, FLORIDA. This is an amendment to the existing Engineering/Land Surveying Services Agreement (AGREEMENT) dated June 22"`x, 2004 between Kimley-Horn and Associates, Inc . (ENGINEER) and Indian River County (COUNTY). This amendment addresses changes in " Section I - Project Limits and Description", Section II - County Obligations, "Section III - Scope of Services" , " Section V - Compensation" and "Section XVI — Duration of Agreement' of the AGREEMENT . Amendment Description This Amendment includes the following: " SECTION I - PROJECT LIMITS AND DESCRIPTION" is being modified to include roadway construction assistance services for the Roadway Improvements to State Road AIA and County Road 510 Project. The improvements proposed to State Road AIA and County Road 510 consist of the following: Improvement to SR AI A 1 . Pebble Beach Villas Turn Lane Improvement 2 . Vera Cruz Turn Lane Improvement 3 . SR AIA Bi-Directional Turn Lane Improvement 4 . Treasure Shores Park Turn Lane Improvement 5 . Sea View Turn Lane Improvement 6 . McLarty Museum Turn Lane Improvement 7 . Sebastian Inlet Day-Use Park Turn Lane Improvement Improvements to CR 510 S . CR 510/ Wabasso Island Lane Roadway Improvement 9. CR 510 Signing & Marking Improvement 10. CR 510 Bi-Directional Turn Lane Improvement "SECTION II — COUNTY OBLIGATIONS " is being modified to incorporate the following: It is understood that during the Construction Phase of the State Road Al and County Road 510 Roadway Improvement Projects, the COUNTY will undertake the day to day task of construction observation, which includes but is not limited to the following: Indian River County, Amendment No. 2 ` Roadway Improvements to State Road AIA and County Road 510 • COUNTY representatives will be on site during construction and responsible for construction observation . • Conduct review of implemented maintenance of traffic devices . • Conduct the weekly progress meetings. • Work with the Contractor to develop and process monthly pay request. • Provide monitoring of the utility improvements associated with the bridge-culvert construction. "SECTION III — SCOPE OF SERVICES " is being modified to incorporate the following: The ENGINEER will provide limited construction services assistance for roadway, and utility construction elements of the Roadway Improvements to State Road AIA and County Road 510 Projects. The following provides descriptions of the tasks that the ENGINEER will perform. The general scope of work will be conducted under a lump sum budget. However, should the COUNTY request additional services other than those described below, assistance may be authorized under an hourly budget. Roadway Construction Observation Assistance • The ENGINEER will attend the Pre-Bid and Pre-Construction meetings and address the questions that pertain to the ten various roadway improvement projects. • The ENGINEER will attend the bi-weekly progress meetings for up to 52 weeks. • The ENGINEER will respond to COUNTY and Contractor Requests for Information (RFI) . • The ENGINEER will assist the COUNTY in acquiring various License Agreements located along State Road AIA corridor. • The ENGINEER will review the contractor submitted shop drawings. • The ENGINEER will review as-built drawings provided by the Contractor' s licensed surveyor. • The ENGINEER will assist the COUNTY in conducting two, walk through inspections . One inspection as a final inspection and a second inspection as a follow up to clear punch list items for each of the ten projects . • When requested by the COUNTY, the ENGINEER will review Contractor proposed Page 2 of 5 Indian River County, Amendment No. 2 Roadway Improvements to State Road A IA and County Road 510 plan alternatives . This work will be undertaken as an additional service and the fee will be calculated at an hourly rate along with expenses. • At the request of the COUNTY, the ENGINEER will provide CADD assistance to input Contractor supplied As-Built data into the project electronic files. The ENGINEER will undertake this effort at an hourly rate. • The ENGINEER will review the As-Built data as submitted by the Contractor, and make permit certifications to the Florida Department of Transportation . • The ENGINEER will review the As-Built data as submitted by the Contractor, and make permit certifications to the St. Johns River Water Management District. " SECTION V — COMPENSATION" is being modified to incorporate the following: The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered pursuant to this Agreement fees inclusive of expenses in accordance with the following: A. Additional Services Fee The COUNTY agrees to pay for additional services, which are outside or beyond the lump sum scope of services identified above in accordance with the revised hourly rate schedule. All other sections of the AGREEMENT shall remain in full force and effect and are incorporated herein. This Amendment No . 2 to the AGREEMENT regardless of where executed, shall be governed by and construed by the laws of the State of Florida.
