HomeMy WebLinkAbout2007-047 2o0T 041 AMENDMENT NUMBER 3 TO WORK ORDER NUMBER 1 This Amendment Number 3 to work Order Number 1 ("Amendment') is entered into as of this 6thday of February 2007 X1966 ("Effective Date") pursuant to that certain Continuing Contract Agreement for Professional Services dated entered into as of Consulting Services ("Agreement'), by and between Indian River County, a political subdivision of the State of Florida ("COUNTY") AND Ecotech Consultants, Inc . ("CONSULTANT") . 1 . The COUNTY has selected the Consultant to perform the professional services set forth in Work Order Number 1 dated November 16. 2004 . 2 . The COUNTY and the Consultant desire to amend Work Order Number 1 as set forth in Exhibit 1 attached to this Amendment and made a part hereof by this reference, all in accordance with the terms and provisions set forth in the Agreement. 3 . From and after the Effective Date of this Amendment, Work Order Number 1 is amended as set forth in this Amendment. Pursuant to paragraph 1 .4 of the Agreement, nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein. Fell, Assistant ounty Attorney EXHIBIT 1 ATTACHMENT INDIAN RIVER UTILITIES DEPARTMENT NORTH COUNTY BRINE DISPOSAL SCOPE OF SERVICES Amendment No . 3 modifies the scope of work in Work Order No. 1 as issued to Ecotech Consultants, Inc. for assisting the County with permitting, design, and construction management services . Negotiations with FDEP has made it necessary to revise the original design and contract plans of the brine disposal system. Seven (7) acres are being added to the western boundary of the site and this causes a major change in our previous design and significant revisions to our contract plans . Amendment No . 3 is being implemented at this time to provide professional environmental and engineering services by Ecotech Consultants, Inc. and Masteller & Moler, Inc. associated with the project described above. The additional work to be performed as part of this Amendment will generally included the preliminary redesign of the site plan (to include the additional seven acres on the west side of the site) for permitting purposes, preparation of construction plans and specifications, and meetings with the County and permitting agencies . A brief description of the scope of services for Amendment No. 3 is provided below : Task 1 . Preliminary Site Plan Redesign to Include New t7.0 Acre Site Ecotech Consultants, Inc . (ETC) will assist the County with redesigning the site plan to include an additional t7 .2 acres located along the western boundary of the project site. The deliverables for this task will include two copies of the revised site plan. Task 2 . Preparation of Construction Plans & Specifications ETC and Masteller & Moler, Inc . will prepare plans and specifications for the permitted site design. The deliverables for this task will include two copies of the draft plans and specifications for review by the County. ETC will modify the draft plans and specifications as appropriate in response to comments received from the County, after the County completes their review of the draft application. Two copies of the final plans and specifications will be provided to the County. Page 1 of 4 Task 3. Permitting/Meetings ETC will assist the County with modifying the permits to include the additional seven acres of land located on the west side of the project site. ETC also will meet with FDEP and the County on an as needed basis to discuss the Spoonbill project. There are no planned deliverables for this task. Page 2 of 4 EXHIBIT 1 ATTACHMENT 2 INDIAN RIVER UTILITIES DEPARTMENT NORTH COUNTY BRINE DISPOSAL PROJECT BUDGET The Ecotech Consultants, Inc . Team proposes to complete the Scope of Services described in Amendment No. 3 , Attachment 1 for the lump sum amount of $99,475 .00 . This increases the overall cost of Work Order No . 1 from $242 ,2200. 00 to $341 ,695 . 00. An approximate breakdown of this lump sum amount, by task, is presented below. Direct charges for additional services will be billed to the County at their actual value. The time needed to complete each of the tasks described in Attachment 1 by Ecotech Consultants, Inc. and the County can be reasonably estimated as shown below with the limitation that neither the County nor Ecotech Consultants, Inc . can control the phase of the permitting process controlled by the Florida Department of Environmental Protection, the St. Johns River Water Management District, or the U. S . Army Corps of Engineers.
