(ENGINEER) and INDIAN RIVER COUNTY (COUNTY) . The proposed scope of work generally includes final design of roadway and drainage improvements and permitting services. The re-design will be based on splitting the project into two (2) projects, modifications to minimize impacts to property owners and other minor changes . All provisions of the original Professional Engineering Services Agreement including Amendment Nos . 1 , 2 and 3 shall remain in full force and effect, unless otherwise specifically modified. This amendment addresses changes in "FINAL DESIGN AND PERMITTING", SERVICES, "COMPENSATION," and "TIME OF COMPLETION" of the AGREEMENT. SCOPE OF SERVICES See attached letter from Carter Associates, Inc . dated September 26, 2006, which specifies changes in the "SCOPE OF SERVICES " and "COMPENSATION. " COMPENSATION This section of the AGREEMENT entitled SECTION V - COMPENSATION shall be revised in response to the Scope modifications set out herein. The charges associated with this AMENDMENT NO. 4 are as follows : Fees for Final Design and Permitting : $30,640. 00 (Lump Sum) The charges associated with the AGREEMENT (which includes changes from Amendment 1 , 2 and 2 and these additional services included in proposed Amendment 4), shall be increased from $297,620 . 00 to $328 ,260.00. The AGREEMENT is hereby amended as specifically set forth herein. All sections of the AGREEMENT shall remain in full force and effect, and are incorporated herein. This Amendment No . 4 to the AGREEMENT, regardless of where executed, shall be governed by and construed by the laws of the State of Florida. Improvements (S .R. 60 to 4th Street) Addendum No. 4 — Professional Services Agreement IRC Job # 98- 10/CAI Job # 98-23E Dear Chris : We are pleased to present this proposed addendum for additional services relative to breaking the construction plans package into two separate construction packages and preparing construction plan revisions and obtaining permit modifications resulting from the County' s right-of-way acquisition of the Beatty properties. All provisions of the original Professional Engineering Services Agreement (dated November 17, 1998), including Addendum Nos. 1 , 2 and 3, shall remain in full force and effect, unless otherwise specifically modified herein. A manhour breakdown is attached as Exhibit "A" for your use. The following describes our proposed scope of services and terms of agreement between Carter Associates, Inc . (CAI) and Indian River County (COUNTY): Separation of Construction Documents into Two Separate Packages : In general, the dans will be divided into two separate construction packages. The north package will include 66' Avenue improvements from and including 16th Street to SR60 . The south package will include the remainder of the project. The construction packages will be prepared to be independent of each other for the purposes of bidding and constructing the improvements separately.
