Kafer, Jr. , P.E. , County Engine SUBJECT: Amendment No. 5 to the Professional Services Agreement with Carter Associates, Inc. for Roadway Improvements, 66th Avenue from 4th Street to SR 60 — IRC Project No. 9810 DATE: January 16, 2007 DESCRIPTION AND CONDITIONS Indian River County entered into a Professional Services Agreement with Carter Associates, Inc. on November 17, 1998 and approved Amendment No. 1 through Amendment No . 4 for additional service. Additional services are now required in order to accommodate the connection of College Lane at the alignment of 16th Street. The proposed bridge for College Lane over the I .R.F. W. C .D. Lateral A Canal will be required to be much higher than the existing bridge, which requires 66th Avenue to be much higher for proper tie-in. A summary of the proposed work for this Amendment is as follows : • Revise 16`h Street and 66th Avenue Plan & Profile sheets, Cross Sections, and Signing & Pavement Marking Plan sheets. • Revise drainage structures, drainage piping, and stormwater management report. • Revise Tabulation of Quantities and Summary of Drainage Structures. • Update engineer' s cost estimate . (ENGINEER) and INDIAN RIVER COUNTY (COUNTY). The proposed scope of work generally includes final design of roadway and drainage improvements and permitting services. The re-design will allow for proper tie-in of College Lane to 66"' Avenue and other minor changes. All provisions of the original Professional Engineering Services Agreement including Amendment Nos. 1 , 2, 3 , and 4 shall remain in full force and effect, unless otherwise specifically modified. This amendment addresses changes in "FINAL DESIGN AND PERMITTING", SERVICES, "COMPENSATION," and "TIME OF COMPLETION" of the AGREEMENT. SCOPE OF SERVICES See attached letter from Carter Associates, Inc. dated January 4, 2007, which specifies changes in the "SCOPE OF SERVICES " and "COMPENSATION." COMPENSATION This section of the AGREEMENT entitled SECTION V - COMPENSATION shall be revised in response to the Scope modifications set out herein. The charges associated with this AMENDMENT NO. 5 are as follows: Fees for Design Modifications : $21 ,460.00 (Lump Sum) The charges associated with the AGREEMENT (which includes changes from Amendment 1 , 2, 3 and 4 and these additional services included in proposed Amendment 5 ), shall be increased from $328,260. 00 to $349, 720 .00 . The AGREEMENT is hereby amended as specifically set forth herein. All sections of the AGREEMENT shall remain in full force and effect, and are incorporated herein.
