Home My WebLink About2007-247 AMENDMENT NO. 6 TO THE PROFESSIONAL ENGINEERING SERVICES AGREEMENT 66TH AVENUE PAVING AND DRAINAGE IMPROVEMENTS BETWEEN SR 60 AND 4TH STREET IRC PROJECT NO. 9810 THIS is an amendment to the existing AGREEMENT dated NOVEMBER 17, 1998, including AMENDMENTS NUMBER 1 through 5 , between CARTER ASSOCIATES , INC. (ENGINEER) and INDIAN RIVER COUNTY (COUNTY). The proposed scope of work generally includes final design Landscaping and Irrigation Design services around all 5 proposed Stormwater Retention Ponds. All provisions of the original Professional Engineering Services Agreement including Amendment Nos. 1 through 5 shall remain in full force and effect, unless otherwise specifically modified. This amendment addresses changes in "FINAL DESIGN AND PERMITTING", SERVICES, "COMPENSATION," and "TIME OF COMPLETION" of the AGREEMENT. SCOPE OF SERVICES See attached letter from Carter Associates, Inc. dated July 16, 2007, which specifies changes in the "SCOPE OF SERVICES " and "COMPENSATION." COMPENSATION This section of the AGREEMENT entitled SECTION V - COMPENSATION shall be revised in response to the Scope modifications set out herein. The charges associated with this AMENDMENT NO. 6 are as follows : Fees for Design Services : $ 56, 135 .00 (Lump Sum) Fees for Construction Phase Services : $4, 500. 00 (Hourly Not To Exceed) The charges associated with the AGREEMENT (which include changes from Amendments 1 through 5 and these additional services included in proposed Amendment 6), shall be increased from $ 349,720. 00 to $4105355 . 00. The AGREEMENT is hereby amended as specifically set forth herein. All sections of the AGREEMENT shall remain in full force and effect, and are incorporated herein. This Amendment No. 6 to the AGREEMENT, regardless of where executed, shall be governed by and construed by the laws of the State of Florida. After receiving Indian River County comments regarding these plans, they have 30 calendar days to submit plans that are 100% complete. All provisions of the original Professional Engineering Services Agreement (dated November 17, 1998), including Amendment Nos. 1 , 2, 3 , 4 and 5 shall remain in full force and effect, unless otherwise specifically modified herein. A man-hour fee estimate is attached as Exhibit "A" for your use. The following describes our proposed scope of services and terms of agreement between Carter Associates, Inc . (CAI) and Indian River County (COUNTY): Design Modifications: In general, the roadway plans and drainage design will be modified to relocate pond 300B from the north- west comer of the intersection between the Main Relief Canal and 66`° Ave to the south-east comer of the intersection between the Lateral ` A' Canal and 66`" Ave. Also, landscaping and irrigation plans with associated electrical services will be added at each of the five stormwater management ponds, and littoral zones will be added to one side of ponds 300A and 300B, as follows: • Revise 66h Avenue Plan & Profile and Cross Section sheets, drainage structures, drainage piping, Tabulation of Quantities and Summary of Drainage Structures. • Revise the lake plan sheets and the typical lake section for ponds 300A and 300B. Add littoral zone notes and details. • Revise the stotmwater management calculations and report. • Utilizing a Landscape Architect as a sub-consultant, provide landscape calculations demonstrating compliance with the County' s tree protection ordinance. • Utilizing a Landscape Architect as a sub-consultant, add landscape plans and details to provide planted buffers with trees, shrubs, and irrigations systems around each of the five drainage ponds within the project limits. _ ♦y Seivh,9 Ronda_ L Lace 191 • Utilizing an Electrical Engineer as a sub-consultant, add electrical plans to provide electrical services from the existing FP&L overhead lines along the 660' Ave ROW to power the irrigation equipment, and coordinate with FP&L to connect these installations. • Update engineer ' s cost estimate . Compensation : Amendment No. 6 fees will be invoiced on a percent complete lump sum or time & materials basis (as applicable) .
