Home My WebLink About2006-309 INDIAN RIVER COUNTY Oslo Road Phase I Roadway Widening AMENDMENT NO, 8 TO THE PROFESSIONAL ENGINEERING/LAND SURVEYING SERVICES AGREEMENT BETWEEN KIMLEY-HORN AND ASSOCIATES, INC. AND INDIAN RIVER COUNTY, FLORIDA. This is an amendment to the existing Engineering/Land Surveying Services Agreement (AGREEMENT) dated March 24th, 1998 between Kimley-Horn and Associates, Inc. (ENGINEER) and Indian River County (COUNTY) . This amendment addresses changes in " Section I - Project Limits and Description", Section II - County Obligations, "Section III - Scope of Services" , " Section V - Compensation" and " Section XVI — Duration of Agreement" of the AGREEMENT . Amendment Descri tp Lon This Amendment includes the following: "SECTION I - PROJECT LIMITS AND DESCRIPTION" is being modified to include roadway construction assistance services for the Oslo Road Phase I Roadway Widening Project. The project consists of widening Oslo Road to a five lane urban roadway section between 27`h Avenue and approximately 600 feet west of Old Dixie Highway. " SECTION II — COUNTY OBLIGATIONS " is being modified to incorporate the following: It is understood that during the Construction Phase of the Oslo Road Phase I Roadway Widening Project, the COUNTY will undertake the day to day task of construction observation, which includes but is not limited to the following: • COUNTY representatives will be on site during construction and responsible for construction observation. • Conduct the weekly progress meetings. • Work with the Contractor to develop and process monthly pay request. "SECTION III — SCOPE OF SERVICES " is being modified to incorporate the following: Roadway Alignment Modifications The ENGINEER will revise the Final Oslo Road Phase I Roadway Widenin construction documents to revise the Oslo Road alignment immediately cast of 27` Avenue for a length of approximately 1 , 000 feet . The re-alignment shall eliminate and/or Indian River County, Amendment No. 8 Oslo Road Phase I Roadway Widening Project reduce the need to enclose 800 linear feet of the sub-lateral canal located along the south side of Oslo Road . The re-alignment shall include the addition of a westbound right turn deceleration lane at the Oslo Road/ 27`I' Avenue intersection. Beyond revisions to the construction documents, these revisions/ additions will require modifications to the St. Johns River Water Management District and Indian River Farms Water Control District Permits . Based upon the completed construction documents, this amendment will require revisions to the following plan sheets : Summary of Pay Items — 1 Sheet Typical Section — 1 Sheet Summary of Quantities — 7 Sheets Horizontal & Vertical Control — 2 Sheets Plan and Profile — 3 Sheets Cross Section - 4 Sheets Erosion Control Plan — 2 Sheets Signing & Marking Sheets — 2 Sheets Landscape Design — 1 Sheet In addition to the revisions to the construction documents, the Project Computation Book will be revised to reflect the change in project quantities. Construction Phase Services The ENGINEER will provide limited construction services assistance for structural, roadway, and utility construction elements of the Oslo Road Phase I Roadway Widening Project. The following provides descriptions of the tasks that the ENGINEER will perform . The general scope of work will be conducted under a lump sum budget. However, should the COUNTY request additional services other than those described below, assistance may be authorized under an hourly budget. Roadway Construction Observation Assistance : • The ENGINEER will attend the Pre-Bid and Pre-Construction meetings and address the questions that pertain to the construction project. • The ENGINEER will review the contractor shop drawings to include, but not limited to : 1 . Drainage structure shop drawings 2. Various mix designs 3 . Utility components shop drawings Page 2 of 5 Indian River County, Amendment No. 8 Oslo Road Phase I Roadway Widening Project 4 . resubmittals (maximum of one each). • The ENGINEER will attend the bi -weekly progress meetings for up to 96 weeks . • The ENGINEER will respond to COUNTY and Contractor Requests for Information (RFI). • The ENGINEER will review as-built drawings provided by the Contractor' s licensed surveyor. • The ENGINEER will assist the COUNTY in conducting two , walk through inspections . One inspection as a final inspection and a second inspection as a follow up to clear punch list items. • The ENGINEER will provide certification to St. Johns River Water Management District based on as-built drawings provided by the Contractor' s licensed surveyor and information provided by the COUNTY. • The ENGINEER will provide certification to Indian River Farms Water Control District based on as-built drawings provided by the Contractor' s licensed surveyor and information provided by the COUNTY. • When requested by the COUNTY, the ENGINEER will review Contractor proposed plan alternatives. This work will be undertaken as an additional service and the fee will be calculated at an hourly rate along with expenses. • At the request of the COUNTY, the ENGINEER will provide CADD assistance to input Contractor supplied As-Built data into the project electronic files . The ENGINEER will undertake this effort at an hourly rate. " SECTION V — COMPENSATION" is being modified to incorporate the following: The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered pursuant to this Agreement fees inclusive of expenses in accordance with the following: A. B . Additional Services Fee The COUNTY agrees to pay for additional services, which are outside or beyond the lump sum scope of services identified above in accordance with the revised hourly rate schedule. Principal $ 150 Senior Professional $ 125 Professional $ 100 Engineer Analyst $85 Technician $ 75 Draftsman $65 Support Staff $48 "SECTION XVI — DURATION OF AGREEMENT" is being modified to incorporate the following: This Agreement shall remain in full force and effect until December 31 , 2008 or until completion of project phases as specified by the Public Works Director, or unless otherwise terminated by mutual consent of the parties hereto or pursuant to Section XII of this AGREEMENT. All other sections of the AGREEMENT shall remain in full force and effect and are incorporated herein. This Amendment No . 8 to the AGREEMENT regardless of where executed, shall be governed by and construed by the laws of the State of Florida.
