Oslo Road Phase I Roadway Widening
AMENDMENT NO. 9 TO THE PROFESSIONAL ENGINEERING/LAND SURVEYING
SERVICES AGREEMENT BETWEEN KIMLEY-HORN AND ASSOCIATES, INC. AND
INDIAN RIVER COUNTY, FLORIDA.
This is an amendment to the existing Engineering/Land Surveying Services Agreement
(AGREEMENT) dated March 24th, 1998 between Kimley-Horn and Associates, Inc.
(ENGINEER) and Indian River County (COUNTY). This amendment addresses changes in
"Section III - Scope of Services" and " Section V - Compensation" of the AGREEMENT.
Amendment Description
This Amendment includes the following:
"SECTION III — SCOPE OF SERVICES " is being modified to incorporate the following:
Alternate Pond Siting Report
The COUNTY desires to prepare an alternate pond siting report to address the 27`h
Avenue stormwater requirements between Oslo Road and 7th Street SW. The analysis
will address the hydrologic and hydraulic characteristics associated with three alternative
pond sites.
A preliminary stormwater management system will be developed to include type of
collection system, outfalls and best practice stormwater management facility selection.
The potential effect on downstream properties and other stormwater management
requirements will be addressed. An opinion of probable construction cost will be
developed for each alternative pond site evaluated. Costs evaluated will include right-of-
way, construction, utilities, maintenance, cultural resources, environmental, floodplain
and aesthetics.
No site specific geotechnical data will be obtained to aid in seasonal high water elevation
determination and soil classification. The ENGINEER will coordinate with the
COUNTY and/or their consultant regarding the development of costs associated with
right-of-way acquisition.
" SECTION V — COMPENSATION" is being modified to incorporate the following:
The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered

pursuant to this Agreement fees inclusive of expenses in accordance with the following:
A. Professional Services Fee
The basic compensation mutually agreed upon by the ENGINEER and the
COUNTY is as follows :

Lump Sum Components
Alternate Pond Siting Report K780
Hourly Rate Components Labor Fee '
Right-of-Way Acquisition Coordination $ 7,500
'Not to exceed without written authorization.
B . Additional Services Fee
The COUNTY agrees to pay for additional services, which are outside or beyond
the lump sum scope of services identified above in accordance with the revised
hourly rate schedule.

"SECTION XVI — DURATION OF AGREEMENT" is being modified to incorporate the
following:
This Agreement shall remain in full force and effect until December 31 , 2008 or
until completion of project phases as specified by the Public Works Director, or
unless otherwise terminated by mutual consent of the parties hereto or pursuant to
Section XII of this AGREEMENT.

The AGREEMENT is hereby amended as specifically set forth here in. All other sections of the
AGREEMENT shall remain in full force and effect and are incorporated herein.
This Amendment No . 9 to the AGREEMENT regardless of where executed, shall be governed
by and construed by the laws of the State of Florida.
