HomeMy WebLinkAbout2009-306 li r �1 ,�o c fir_ 3c6 IMPROVEMENT OF THE INTERSECTION OF SR 60 & 43RD AVENUE PROFESSIONAL CIVIL ENGINEERING & STRUCTURAL ENGINEERING SERVICES AMENDMENT NO , 5 TO THE PROFESSIONAL ENGINEERING/LAND SURVEYING SERVICES AGREEMENT BETWEEN ARCADIS G & M , Inc . AND INDIAN RIVER COUNTY, FLORIDA . This is an amendment to the existing Engineering Services Agreement (AGREEMENT) dated September 6 , 2005 between ARCADIS G& M , Inc . ( ENGINEER) and Indian River County ( COUNTY) . This amendment addresses changes in " Section I — Project Limits and Description" , " Section III - Scope of Services " , and " Section V - Compensation " . Amendment Description This Amendment includes the following : " SECTION I - PROJECT LIMITS AND DESCRIPTION" is being modified to incorporate the following : Consultant services are required for the preparation of road design plans ; bridge plans ; permit applications and utility relocations associated with the construction of SR 60 / 43rd Avenue Intersection Improvements . A conceptual site plan and a boundary and location survey is required for use in the preparation of cure plans for the Paradise Mobile site . The conceptual site plan will depict the existing conditions at the site , and will detail the proposed site improvements after the acquisition of right of way for the intersection improvements . The conceptual site plan will detail the proposed driveways , parking areas , propane tank, signage , and other related site features . A conceptual commercial area improvement plan will be prepared illustrating the conditions along 43rd Avenue south of SR 60 following the acquisition of the right of way and the widening of the roadway . This plan will include the following sites : • Paradise Mobile • Szechuan Palace • Mermaid Car Wash • Cumberland Farms • Pinewoods II Animal Hospital In addition , the plan will show the existing buildings , driveways and front parking areas for the businesses located on the east side of 43rd Avenue between 19`h Street and SR 60 . The plan will also show potential parking area improvements that could be constructed on lots 13 and 14 located on the east side of 43rd Avenue south of the Our Place Beauty Salon site . ( SURVEYOR) and Indian River County ( COUNTY ) . " SECTION III — SCOPE OF SERVICES " is being modified to incorporate the following : Surveyor will perform field and office surveying and mapping services related to completion of a Boundary and Improvement Surveys of the two (2 ) parcels . " SECTION IV - TIME FOR COMPLETION " is being modified to incorporate the following : 1 . Project shall be completed as follows : a . 30 business days from Notice to Proceed . 2 . Deliverables - The SURVEYOR shall provide the COUNTY : a . FINAL five ( 5 ) 24 " x 36 " paper signed and sealed "hardcopy", AutoCad drawing file and PDF formats on CD . b . Work Product shall be prepared and supplied in State Plane geometry (NAD83 2007 adjustment if applicable) ; digital versions are to be prepared and submitted so that the COUNTY or other consultants can readily use it for the design and analysis of the area, as defined . It shall contain all information necessary for third-party surveyor to independently recreate and/or utilize the survey work . It is acknowledged all final products become property of Indian River COUNTY and will be available for use by the public at large . a. The SURVEYOR ' S work product shall meet or exceed the minimum standards as defined by Sections II , III and IV or the COUNTY will not approve the SURVEYOR ' S request for payment . " SECTION V — COMPENSATION " is being modified to incorporate the following . The COUNTY agrees to pay and the Surveyor agrees to accept for services rendered pursuant to this Agreement fees in accordance with the following : A . Professional Services Fee 1 . All other sections of the AGREEMENT shall remain in full force and effect and are incorporated herein . This Amendment No . 5 to the AGREEMENT regardless of where executed , shall be governed by and constructed by the laws of the State of Florida.
