Such bills and accounts being on file in the office of the Clerk of the Circuit Court, the warrants so issued from the respective funds being listed in the Supplemental Minute Book as provided by the rules of the Sta to Auditor, reference to such record and the list so recorded being made apart of these minutes. The County Depository filed its monthly statement, showing receipts and disburse- ments of the various funds, which have been audited, were found to be correct. e There being no further business, on motion, made, seconded and carried, the Board y then adjourned. M. Tuesday, October 15, 1957. All membersu,� were present. Also present were Sherman N. Smith, Jr., Attorney, Ed Schmucker, County Eng- ineer, Douglas Baker, Clerk, and Katherine Morrison, Secretary. 'm Homer C. Fletcher appeared before the Board and stated that he had attended a meeting where Senator Holland stated he had requested aerial photographs be made of parts of ii Florida, Indian River County being one of the sections, by the U. S. Department of Agriculture.' Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Macdonald and unanimously carried, the following Resolution was unanimously adopted: V • R E S O L U T I O N --- Aerial Photographs WHEREAS, Indian River County, Florida, is in great need of aerial photographs of thel area of this County for its planning of a bulkhead line along the Indian River, the assess- went of property and the development of an overall plan of streets and roads in the County, NOW, THEREFORE: BE IT RESOLVED by the Board of County Commissioners for Indian River County, Florida, that this Board does herewith commend the Honorable Spessard L. Holland, United States Senator's from Florida, for his active efforts to date in securing aerial photographs for this section of Florida and this Board does herewith respectfully request the United States Department of Agriculture to immediately have such aerial photographs made; • and 0 1 1 1 0 BE IT FURTHER RESOLVED, that this Board does herewith point out to the Board of County Commissioners of St. Lucie County, Brevard and Martin County the desirability of such aerial photographs and suggest that these Counties being contiguous to Indian River County join in with this County on the request for such aerial photographs. - - - - - - - - - - - - - - - - - - - - - - - - - - The County Assessor of Taxes Homer C. Fletcher, appeared before the Board and presented the tax rolls for the year 1957 on Real and Personal Property and also Intangible Tax Roll, which were carefully examined and found correct and on Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Macdonald, and carried, were approved, and the Warrants to each of said rolls were annexed thereto and is in words and figures followeing: THE STATE OF FLORIDA To: Troy E. Moody, Tax Collector of the County of Indian River You are hereby<:commanded to collect out of the real estate and personal property, and from each of the persons and corporations named in the annexed roll, the taxes set down in each roll opposite each name, corporation or parcel of land therein described, and in case taxes so imposed are not paid at the time prescribed by law, you are to collect the same by levy and sale of the goods and chattels, lands and tenements so assessed, or of the person or copocation so taxes; and all sums collected for the State taxes you are to pay to the State Treasurer at such time as may be required by law, and at the same time you are to pay to the legally qualified Depository all sums collected for County taxes, district school taxes and other special taxes; and you are further required to make all collections on or before the first Monday in April; and on or before the first Monday in July you will make a final report to and settlement with the Comptroller and County Commissioners. Given under my hand and seal this the 15th day of October, in the year AD 1957. Homer C. Fletcher Assessor of Taxes, Indian River 1 County. The committee consisting of Commissioners W. C. Graves, Jr., and Robert Graves gave their report on Hospitalization and recommended the County keep their Blue Cross -Blue Shield Insurance. Upon motion made by Commissioner Macdonald, seconded by Commissioner McCullers and unanimously carried, the Board decided to keep the Blue Cross, Blue Shield Insurance. Buck Vocelle and Larry Finegan appeared before the Board requesting a site for the American Legion Fair. Upon Motion made by Commissioner Macdonald, seconded by Robert .i Graves and unanimously carried, the County grants to the American Legion, Felix Poppel Post n #39 the use of the South 20 acres of the Sa of SWk of NE'k of Section 11, Township 33 South, ° Range 39 East, for the use by the Legion of this property as a site for public fair grounds "I with the understanding that the County may terminate this lease at any time by giving the Legion one year's notice of termination. Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Mac- donald and unanimously carried, this Board goes on record that all the land now owned by the County in Section 11, Township 33 South, Range 39 East not be sold but kept for the use of the,,1 General Public. Bud Holman appeared before the Board and requested that the work be done by the County as per agreement made between Mr..- Holman and the County in 1947. Mr. Schmucker, H County Engineer sta ted that work had been started out there but the rains were holding them up, but just as soon as they could they were going to finish it up. Mr. Holman also stated that Commercial fishermen were taking fish out of Blue Cypress Lake by the tons and asked the Commissioners to do whatever they could to prevent them taking any more out. The Board asked Mr. Smith to write another letter to the Game & Fresh Water Fish Commission requesting this lake be used by only rod & reel and pole fishermen, in other words for sports fishing only. Commissioner Robert Graves reported he had looked over the situation of a bridge reques ted by Mr. Hogan and he recommends that said bridge be put in. The Board then re- quested the County Engineer put this bridge in as soon as convenient. Sherman N. Smith, Jr., County Attorney, read the following recommendations of the Planning and Zoning Commission to the Commissioners: The Commission tentatively approves and recommends to the County Commissioners for further consideration, the change in zoning of all of the area North of the North City Limits of the City of Sebastian extending to a line 300 feet South of the Roseland Road, and from the new right of way line of U. S. Highway #1 East to the Indian River, now Zoned R-3 Transient District be changed to C-1 Commercial District. The Commission tentatively approves and recommends to the County Commissioners for 0 1 1 0 1 i 1 1 i further consideration, achange in the Zoning Resolution of the County by adding a paragraph thereto to read as follows: • "Any person desiring a change or amendment to the Zoning Resolution or zoning map shall submit the same in writing to the Superintendent of Public Roads describing by legal description and by street address, where possible, the property to be affected by the proposed change, 1 1 1 0 1 O setting forth the present zoning applicable thereto and specifying the district, zone or use requested by the applicant. There shall be at said time paid to the Superintendent of Public Roads for the account of the County the sum of $50.00 for each such requested change, pro- viding, however, that as many lots or parcels of property as the applicant may desire may be included in any single petition provided the same is one contiguous area. The Superintendent of Public Roads shall then transmit the application to the Zoning Commission for ten- tative consideration at its next meeting. Should the Zoning Commission tentatively approve the petition, it shall report its tentative approval to the County Commissioners and should the County Commissioners ten- tatively approve the same, public hearings shall be had. Should either the Zoning Commission or the County Commissioners upon their tentative consideration disapprove the application and the applicant elect to proceed no further, then the fee deposited with the County shall be returned to the applicant; otherwise, the fee shall remain the property of the County. Should public hearings be held, then in connection with the publication of the notice for the public hearing before the Zoning Commission the Superintendent of Public Roads shall mail a written notice to all property owners owning property within 300 feet of the outer limits of the area described in the petition requesting a change, advising all such owners as shown bpon the last prepared and complete Tax Assessmnt Roll of the County stating in simple terms the proposed change and the time and place of the public hearing. The provisions hereof providdng for mailing of notice is directory only and the failure to mail such notice shall not affect any change or amendment to said Zoning Resolution." Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Robert Graves and unanimously carried, the Board agrees that the tentative recommendation to this Board made by the Planning and Zoning Commission as set forth in its minutes of October 4th and 8th be tentatively approved and public hearing be held. Upon Motion made by Commissioner Macdonald, seconded by Commissioner W. C. Graves, Jr., and unanimously carried, the Board agreed to pay Mr. I. R. James $900.00 for right of way on U. S. #1, SRD #243. Upon Motion made by Commissioner W. C. Gra ves, Jr., seconded by Commissioner Mc - f Cullers and unanimously carried, this Board reaffirms the former este blished policy of the Board of County Commissioners, that expenses for trips of the Sheriff's office in returning individuals from out of State to this County, be first cleared with the Board for its approval,N which may be given by the Chairman, before such expense be charged to the County.
