CHAIRMAN ATTEST: SECRETAR TUESDAY, DECEMBER 3, 1957 The Board of County Commissioners of Indian River County, met at the Courthouse, Vero Beach, Florida in a regular meeting held at 9:00 o'clock A. M. Tues day, December 3, 1957. All members were present. Also present were Ed Schmucker, Road & Bridge Superintendent. Sherman N. Smith, Jr., Attorney and Katherine Morrison, Secretary. The Chairman asked if there were any changes or additions to be made to the minutes of November 5, 1957, there being none and upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Donald Macdonald the minutes were approved as read. Homer Fletcher, Tax Assessor appeared before the Board and requested permission to adjust the valuation and extended tax on the following described property on the 1957 tax roll, Lot 1 & Sk of Lot 2, Block 2, Tropicolony S/D for the reason that the house on said lot was constructed after January 1, 1957 and therefore not assessable as improved property. Upon Motion made by Commissioner W. C. Lester Hanshaw appeared before the Board with regard to zoning in the North end of the County and was informed that the matter would be taken up at a later meeting after proper advertising. A report of the zoning Board was read and the Board authorized the Attorney to prepare notice for hearing before the Commissioners and same be advertised in the Press Journal A representative of the Florida Opportunity Journal appeared before the Board re - questing the Board buy advertising in said Journal. After some discussion in the matter and upon Motion made by Commissioner Robert Graves, seconded by Commissioner Macdonald and un- animously carried the Board authorized advertising in said Journal in the amount of $250.00. Robert Graves was appointed to work with the magazine staff to select the correct advertising. Mr. E. H. Auten appeared before the Board and presented the following Petition: To: The Board of County Commissioners of Indian River County, Florida Gentlemen: P E T I T I O N The undersigned E. H. Auten and Mary Louise Auten, his wife, do herewith petition you to adopt a resolution vacating, abolishing and abandoning a public roadway over, on and across the Southeast 20 feet and the Southwest 20 feet of Lot 40 in Section 21, Fleming Grant, Township 30 South, Range 38 East, according to Berry's Subdivision of the Fleming Grant revised from Carter's Survey as set forth and described in the deed recorded in Deed Book 20, page 29, St. Lucie County, Florida, records, now situated in Indian River County, Florida, and requesting said Board to renounce and disclaim any right of said County for the public in and to that certain roadway above described delineated on said plat as a street, road or highway. That, said lands have no delinquent taxes or assessments levied against the same and are now located in Indian River County, Florida, and none of the same constitute a State or Federal Highway. The Secretary informed the Board that Ben Potter, who was high bidder for the junk advertised for sale by the county, had failed to pay the balance of his bid price. The County Attorney gave a report on the condemnation suit for U. S. #1 Highway. Mrs. Chesser of Wabasso appeared before the Board and asked if the Commissioners could do anything about closing a beer place operating on her property. The Board informed her there was nothing they could do, but that she could refuse to rent further to them. Sam Joyce, Sheriff appeared before the Board with reference to.some small repair bills for the County Jail, stating he thought these bills should be paid by the County. The Secretary stated they had a letter from the Comptroller's office which stated small repair bills should be paid by the Sheriff's office under its new budget and that major repairs would be paid by the County. The Board then stated they would have to go by the ruling made by the Comptroller's office and pay for only major repairs. The County Attorney stated he had received an answer from the State Road Department stating they would post signs from the West City Limits of Vero Beach and a point .5 mile west showing this to be a 45 MPH speed zone and a resume speed sign .5 mile west of the west city limits on Road 60. M. at which time a public hearing will be held on fixing of a bulkhead line. The Road & Bridge Superintendent having tabulated the bids reported that Arnold o� Fold Sales was low bidder on the Tractor unit at a price of $6680.49, this with jumpers. He further stated that Nelson Manufacturing Company was low bidder on the Trailer unit but their bid 1i was not quite up to specifications but that the Fontaine Company was the low with all specifi cations as required. Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers and carried the Board authorized buying the Tractor from Arnold Ford Sales and buy the lowest one of the trailer units that meets the required specifications and that this equipment should be bought on a cash basis and not lease purchase plan. Mrs. Anne Christensen, County Welfare Case Worker appeared before the Board and gave! a report of her activities for the month of November. Said report was ordered.filed by the g Clerk. V Col. O'Brien, Civil Defense Director of Indian River County appeared before the Board stating he needed information with regard to relocation of the Courthouse, etc. in the event of an emergency. After considerable discussion in the matter a Committee was appointed consisting of Sherman N. Smith, Jr., W. C. Graves, Jr., Ed Schmucker and Col. O'Brien to work out these and other details. Col. O'Brien further stated that he was in need of stenographic help. The Chairman g asked all members to be thinking about this problem and discuss the matter further at the next regular meeting. I Tom Williams, Juvenile Counselor appeared before the Board requesting payment for mileage and attending meetings. The Board informed him that since most of his work was with the school department he ',should contact J. A. Thompson in this regard. N Ed Schmucker, Road and Bridge Superintendent stated that he had several dues to pay each year and asked the County's help in this respect. Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Macdonald and carried the Board authorized payment. of these dues up to $40.00. Y. as surety. r A letter was read by the Secretary from the Indian River Farms Drainage District requesting a resolution be adopted requiring culverts be put in as drainage outlets into canals. Upon Motion made by Commissioner W. C. The Road and Bridge Superintendent then pointed out that on a temporary basis the bulkhead line had been drawn on the map (which he presented to the Commissioners) as 25 feet from the existing shoreline. After considerable discussion in the matter and upon Motion made by Commissioner Robert Graves seconded b b s o y Commissioner Donald Macdonald and unanimously carried, the Board appointed the County Attorney and the County Engineer to prepare and submit to the Board a p i Resolution establishing the bulkhead line. .p 19 The County Attorney stated this resolution together with three copies of a map ii i showing the bulkhead line would be sent to the Trustees of the Internal Improvement Fund. iw I� Sheriff Sam Joyce appeared before the Board together with the Assistant State Auditor'1 Mr. Lockman and they requested that $2100.00 be transferred from the Sheriff's Contingency Fund,' to the Sheriff's Equipment fund for the reason that the Sheriff himself could now own a car but that said car must be in the name of the Sheriff's Department. Upon Motion made by Comm- issioner Macdonald, seconded by Commissioner McCulZers and unanimously carried, the Commiss- ioners approve the transfer of $2100.00 from the Sheriff's Contingency Fund to the Sheriff's r equipment fund and further approves the request for purchase of the Sheriff's automobile for $2500.00. The County Attorney presented an Easement from Whispering Palms, Inc. to the County, a giving an easment to the county for location of telephone and electric poles. Upon Motion made by Commissioner Macdonald, seconded by Commissioner W. C. Graves, Jr., and unanimously carried the Board accepted said easement, and the Clerk was authorized to put same on record. Dr. Miller of the Indian River County Health Department appeared before the Board{ A and stated that he thought the Commissioners should set a limit of time that indigent patients s! should be kept in the hospital. After some discussion in the matter and upon Motion made by Commissioner Robert Graves, seconded by Commissioner Macdonald and carried, the Board set a limit of 14 days hospitalization and in extreme cases this could be extended an additional ;r s 14 days. Dr. Miller also stated they would like to close the Health Building for the Christmasr holidays on Tuesday, Wednesday and Thursday, Dec. 24th, 25th and 26th. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner McCullers and carried the Board agreed to the closing of the Health Center on Dec. 24, 252 & 26th. Mr. Joe Bell of Ocott Motors appeared before the Board and asked permission to rent 100 feet of the North end of the Block on which the Health Center Building is located. The Board asked what rent he would be willing to pay and he stated he didn't know at this time. The Board asked that he make up his mind and let them know at the next regular meeting Of..the Board on January 7th. Upon Motion made by Commissioner Macdonald, seconded by Commissioner Robert Graves 4 and unanimously. carried, the Board passed a resolution that all of the access roads, driveways, 1 0 1 1 and road areas set forth and established on the ground in the various county dump ares of the • f County are herewith designated and established as public roads in order that the dumping of �� 0 1 I - • 1 40 �T­ any items on these public roads shall be unlawful and the County Engineer is directed to post these roads accordingly. There being no further business, upon Motion made, seconded and carried, the Board then adj ourned. ATTEST: Secretary TUESDAY, JANUARY 7, 1958 The Board of County Commissioners of Indian River County, met at the Courthouse, Vero Beach, Florida in a regular meeting held at 9:00 o'clock A. M. Tuesday, January ;7, 1958. All members were present. Also present were Ed Schmucker, Road & Bridge Superintendent, Sherman N. Smith, Jr., Attorney, Douglas Baker, Clerk and Katherine Morrison, Secretary_ The Chairman asked there Vere any changes or additions to be made to the minutes of December 3, 1957 and minutes of special meeting of December 17, 1957, there being none and upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers and unanimously carried, the minutes were approved as read. The Chairman, Mr. J. J. P. Hamilton then turned the meeting over to Attorney Smith, who asked for nominations for Chairman. Mr. Hamilton stated at this point that he would like to resign as Chairman and nominated Donald Macdonald for Chairman, Robert Graves, then sec the nomination. The acting Chairman asked for other nominations and there being none, -called for a vote and Donald Macdonald was elected Chairman unanimously. Attorney Smith then turned the meeting over to Chairman Donald Macdonald who asked for nominations for Vice -Chairman. W. C. Graves, Jr., nominated Robert Graves for.Vice- Chairman and this was seconded by D. B. McCullers, Jr. There being no further nominations, Robert Graves was elected Vice -Chairman by a unanimous vote. It was moved by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers, and unanimously carried that the following county employees be re-employed for the ensuing year: S. N. Smith, Jr., County Attorney, Anne Christensen, Welfare Case Worker; Elmer Harris, County Service Officer; Forrest N. McCullars, County Agent; and L. C. Royal, Janitor; E. S. kSchmucker, Jr., Road & Bridge Superintendent. Commissioner W. C. Graves, Jr., gave a report of the committee on relocation of county government in case of emergency. Upon Motion made by Commissioner.Robert Graves, se- conded by Commissioner Hamilton and unanimously carried, recommendations of said committee were approved and said report ordered filed. A letter was received and read by the Chairman from the Indian River Citrus Bank with respect to the American Legion wanting to construct a building for a fair exhibition and in order for the bank to loan them money to construct this building the Legion would have 27
