held at 10 o'clock A.M.Tuesday, January 3rd
1928,the follow-
ing members of the Board were present: John H.Atkin, Chairman; Geo.A.Braddock; J.T.
TABruce; J.J.P.Hamilton and O.O.Helseth. Also present were Miles Warren, Clerk and

The minutes of the previous meeting were read and approved.
M.B.Iffillians, by his attorney, appeared beforenthe Board and requested reimburse-
ment of $60.00 for destruction of crop by reason of road being opened up through the
place he was renting. It was ordered that $30.00 be paid fir Williams out of the Road
& Bridge fund, for right-of-way and loss sustained.
Mr J.1k.Stinson appeared before the Board regarding road from the .F.E.C.tracks,
west to his place. It was ordered that the County Engineer put this road in passable,
condition within the next 30 days.
W.T.Gibson, representing the Florida Road Oiling Company, Inc., appeared before
the Board and stated that his company wished to assign the contract for road oiling
heretofore entered into with the County to A.O.Greynolds Co. Inc.5, thereupon Com'r.
Hamilton moved that such assignment be approved and final settlement be made with
said Florida Road Oiling Co., Inc. upon the filing with the Board and the approval
thereof of a proper bond by the assignee for the completion of said contract, and up
the approval of the County attorney of all legal" matters pertaining thereto. This
motion was seconded by Commissioner Braddock and unanimously adopted.
CONSOLIDATION OF JUSTICE OF PEACE DISTRICTS
NOS. 4 -- 5 and 6
The following resolution was offered by Commissioner J.J.P.Hamilton:
WHEREAS, it appears that there is. no Justice of the Peace elected, qual ifi
-or commissioned or acting in either the Fourth or Sixth Justice of the Peace Distric
of said
County as
defined and
established by this Board under order adopted, July 21
1925 and
of record
at page 17
of these minutes, and
VIHEREAS, it appears that it is for the best interest of the County that
this situation be remedied;
THEREFORE be it resolved by the Board of County Commissioners of Indian
River County, that there is no Justice of the Peace elected, qualified or commissiohec
or acting in either the Fourth or Sixth Justice of the Peace Districts of Indian
River County, and it appearing that the best interest of the County requires that
this situation be remedied.-

BE IT THEIE FORE ordered that the territory of said County be retof ore
created as the Fourth Justice District and described as follows: Beginning at the
North-west corner of Township 32 South, Range 35 East; "thLinse East along the Township

line to the North-east corner of Township 32 South, Range "35 East; thence South to the
South-east corner of Section 1, Township 32 South Range 35 East; thence East to the
South-west corner of Section 6- Township 32 South, ReAge 38 East; thence continue
East along rection lines td- South-east corner of Section 1, Township 32 South, Range
38 East; "thence North to -the North-west corner of Township -32 South, Range 39 East;
thence East do the Township line to the ?atlantic Ocean; thence in a Southerly"direc-

and the territory of said County heretofore created as the S_Wh, Justice
District, and described as follows:
Beginning on the South-west corner of Section 189 Tomnsbip 33 South, Range
36 East; thence run East to the Atlantic Ocean; thence South to the South line of
Township 33Soith, Range 40. East; thence pest along thenTownship 'line to the South-
west comer of Township 33 South, Range 36 East; thence North to the point of beginn-
ing. The same comprising Election District No. 7 (Oslo), be and the same are hereby
attached to the territory of aryl made a part of the FIFTH Justice District- of said
County, and that said territory formerly comprising the Fourth and Sixth Justice
Districts be .and the same shall henceforth be a part of the FIFTH Justice District,
,;of said County.
Be it further resolved that this resolution and order be recorded iii the minutes
of the proceedings of this Board and that a copy of the same shall be pod at the
Court House door of said County.
It was ordered that the road be graded from lateral '"A" to Kings Highway, in the
Indian River Farms Drainage Districts as soon as the County Engineer can get to this.
Work .
The Bond of J.W.Knight, as 'Sheriff of Indian River County for a term of four
years from November 2, 1926 with Columbia Casualty Coop a corporation, as surety was
presented to the Board for its approvals whereupon Commis si oner Hamilton offered the
following resolution:
BE FT RESOLVED that the Bond of J.7.Knight. as Sheriff of Indian River County,
for a term of four years from Nov. 2, 1926, be and the same is acceptable to the Board
as to form and sufficiency of sureties, but the Board declines to approve said Bond
solely on the ground that said Sheriff was elected on November 2, 19269 for a term of
two years and the Board believes it is without authority to approve said bond and
declines to do so upon the ground that it has no legal power to do so. Such resolu-
tion was seconded by Commissioner Geo-A.Braddock, and unanimously adopted.
The Board announced in open session they are now in a position to consider sites
for a, Court House and Jail and requested all who have any site to offer to do so at
the February meeting of the Board.
It was ordered that the following named persons be named to the respective posi-
tions, for the year. 1928:
James To Voc elle, County Attorney
D. L. Leisher, County Engineer,
William Frick, Traffic Officer,
the salaries of such employees of the County to remain the same as the year 1927.
It was ordered that the matter of entering into an agreement with the Fort Pierce
Bank and Trust Compary, as to the deposit of $1140.68 in Special R&B Dist No. 4 Bond
Fund, be not executed, in as much as the County has security for such deposit.
It was ordered that the matter of selecting a list* of jurors from the registration
books of the County for the year 1928, be ..carried over until the February meeting of
this Board, and ordered that when this Board adjourn at the January meeting it do so,
with the provision that the January meeting is adjourned until the February meeting for
the purpose of so selecting the jury list for 1928.
The City of Sebastian, a municipal corporation, by and through its City Clerk
requested authority and permission to construct, operate and',maintain a: electric light

and power line over the following County roads-2-

oadsB eginning at the North city limits of the City of Sebastian .and the Old Dixie
highway, thence run Northerly along the old Dixie Highway tomdaincluding its intersect
with the new county road leading into Roseland, thence along said new County road,
in a westerly direction,, known as the Roseland road, to Gibson street; also over the
following Streets and -.Avenues in the Town. of Roseland, Florida: Gibson Street; Bard.
Street, Josie 'Street, Dale street, louis Street, Berry Avenue and :Sebastian Avenue;
also the o ld County ro ad t o Ro s eland.
It was ordered, on motion of Commissioner Geo.A.Braddock., seconded by Com'r.
J.U.IaBruce, that the authority for such be granted, upon the same conditions, terms,
and agreement as entered into by this Board with the Florida Dight, & Power Company,
which is of record at page 51 of the minutes of this Board.
The several bills .and accounts against the County, having been audited, were
examined and approved, and warrants ordered issued in s et Clement of same. The said
severalx bills and accounts being on file in the Clerk's office and made a part of then
minutes.
The County Depositories filed their monthly statement of accounts showing receipts
and disbursements for the month of December, which, having been audited were found to
be correct.
It. was ordered,. on motion, made, seconded and carried that the Board adjourn over
until the regular meeting in February for the purpose of selecting a list of jurors froi
the registration books, for the year 1928, and to attend to such other business as may
properly come before this Body.
The Board then adj oum ed until the regular meeting in February 1928.
