ATTEST: Secretary TUESDAY, JANUARY 7, 1958 The Board of County Commissioners of Indian River County, met at the Courthouse, Vero Beach, Florida in a regular meeting held at 9:00 o'clock A. M. Tuesday, January ;7, 1958. All members were present. Also present were Ed Schmucker, Road & Bridge Superintendent, Sherman N. Smith, Jr., Attorney, Douglas Baker, Clerk and Katherine Morrison, Secretary_ The Chairman asked there Vere any changes or additions to be made to the minutes of December 3, 1957 and minutes of special meeting of December 17, 1957, there being none and upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers and unanimously carried, the minutes were approved as read. The Chairman, Mr. J. J. P. Hamilton then turned the meeting over to Attorney Smith, who asked for nominations for Chairman. Mr. Hamilton stated at this point that he would like to resign as Chairman and nominated Donald Macdonald for Chairman, Robert Graves, then sec the nomination. The acting Chairman asked for other nominations and there being none, -called for a vote and Donald Macdonald was elected Chairman unanimously. Attorney Smith then turned the meeting over to Chairman Donald Macdonald who asked for nominations for Vice -Chairman. W. C. Graves, Jr., nominated Robert Graves for.Vice- Chairman and this was seconded by D. B. McCullers, Jr. There being no further nominations, Robert Graves was elected Vice -Chairman by a unanimous vote. It was moved by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers, and unanimously carried that the following county employees be re-employed for the ensuing year: S. N. Smith, Jr., County Attorney, Anne Christensen, Welfare Case Worker; Elmer Harris, County Service Officer; Forrest N. McCullars, County Agent; and L. C. Royal, Janitor; E. S. kSchmucker, Jr., Road & Bridge Superintendent. Commissioner W. C. Graves, Jr., gave a report of the committee on relocation of county government in case of emergency. Upon Motion made by Commissioner.Robert Graves, se- conded by Commissioner Hamilton and unanimously carried, recommendations of said committee were approved and said report ordered filed. A letter was received and read by the Chairman from the Indian River Citrus Bank with respect to the American Legion wanting to construct a building for a fair exhibition and in order for the bank to loan them money to construct this building the Legion would have 27 to hold title to the land on which the building would be located. After considerable dis- cussion in the matter it was decided to table the matter until after another delegation could f be heard. The Chairman read a letter from the State Association of County Commissioners which stated that a County Commissioner's Manual was now ready for publication and our cost or'� contribution toward the publication of this manual would be $100.00. Upon Motion made by Commissioner McCullers, seconded by Commissioner Robert Graves and carried, the Board auth- orized this payment be made. A letter was received and read from the Scott Motor Company wishing to lease the South 100 feet of the block on which the Health Center is located. They stated they would marl said lot and keep in good condition and pay the county $25.00 a month for the use of said lot. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner Hamilton and unanimously carried, the Board accepted the proposition by the Scott Motor Company. A letter was received and read from a Mr. Leo S. Greenmun suggesting that the County clean up all vacant lots in subdivisions and charge to the lot owners on their to x bills. After some discussion in the matter it was decided to table the matter at this time, this upon motion made by Commissioner Robert Graves, seconded by Commissioner McCullers and unanimously carried. The Chairman read a letter from the Florida Shore and Beach Preservation Assoc- iation inviting the Commissioners to join the Association. Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers and unanimously carried, this matter was tabled. j Clyde Howard and a large delegation consisting of citizens from the area in which j the American Legion intends to hold the County Fair this year, appeared before the Board objecting to the fair being held at this location. Upon Motion made by Commissioner W. C. ,i Graves, Jr., seconded by Commissioner Robert Graves and unanimously carried, the Board cancesl,� ,s the former agreement made between the Commissioness and the American Legion, Felix Poppell Post #39, letting them use 20 acres of land owned by the county on which to hold a fair, and further to reimburse them for the actual cost of the land clearing they had done on this land. The Board further requested Ed Schmucker to check and see that the actual cost of the work done on the land is all that we pay for. Ed Schmucker, Road & Bridge Superintendent presented a proposed plat on a 22 acre tract of land for Mr. Joseph G. DeRosa, said tract being located on the West side of 20th Avenue and 175' N. of glendale road, and stated that since this was such a small subdivision would Mr. DeRosa be required to give an area for a park and also would it be alright for him r� to put in only a 50' street. After some discussion in the matter and upon Motion made by F i Commissioner McCullers, seconded by W. C. Graves, Jr. and carried, the Board decided no park would be required and he would be allowed to put in only a 50' wide street. The following resolution was introduced by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers and unanimously carried. RESOLUTION -- County Dtupps MUM WHEREAS, Indian.River County, acting by and through its Board of County Commissiom 4s, has heretofore set aside, designated and established certain area in the County for the purpose of dumping and disposing of refuge; and WHEREAS, it is considered necessary, in order to provide for the orderly and sanitary operation of these County dumps, to adopt rules and regulations pertaining thereto; NOW, THEREFORE: BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida) that the following rules and regulations shall be applicable to each of the areas heretofore set aside and established for the dumping of refuge within Indian River County, Florida, as follows, to -wit: 1. All roadways leading from the nearest public road and providing for travel in, around and through the dumps are herewith designated as public roads and the dumping of any materials on the same is strictly prohibited. 2. The particular designated spot for the dumping of refuge shall be from time to time designated and established by the County Engineer and signs erected designating the same and during such time no dumpting shall be done in any place except these designated areas. 3. Any dead animals placed in the dumping area shall be buried and covered over by the individual disposing of the same. 4. No contractor engaged in the business of and contracting for the clearing of land shall dump any stumps of trees, underbrush or debri in any of the dumping areas of the County unless said contractor shall either bury the same or destroy the same by supervised burning as shall be directed by the County Engineer. Any stumps, trees or underbrush de- posited in the County dump by any other person shall be immediately saturated with an in- flammable material and set fire by the individual placing the same therein. 5. Any person violating the terms of these dumping regulations shall be prosecuted) as provided by law and in addition, they shall be denied -the use of said area for dumping for a period of time to be fixed by the County Engineer not to exceed 90 days.. 6. In order to facilitate the enforcement of these regulations and to encourage the general public in assisting the County in enforcing the same, the County does herewith offer a reward of $5.00 to any person furnishing information to the County leading to the arrest or presecution of any person for the violation of these regulations. 7. The County Engineer is herewith authorized and directed to place such signs in the dumping areas and to give such publicity to these regulations as he shall deem appropria The following Resolution was introduced by Commissioner Robert Graves, seconded by e Commissioner W. R E S O L U T I O N -- State Road A -1-A, Waba®so Bridge Area WHEREAS, the State Road Department of Florida proposes to improve that part of j State Road AlA, Section 8807 between State Road.502 and the Sebastian Inlet; and WHEREAS, said Department has requested the Bridge Commissioners of the Wabasso Bridge District, Trustees, to execute and deliver to the Department a deed in favor of the i State of Florida to certain lands described in said Deed Owned by said The Bridge Commiss- ioners of the Wabasso Bridge District, Trustees, which said lands are now held, owned and administered by Indian River County, a political subdivision of the State of Florida, acting by and through its Board of County Commissioners conveying all of its right, title and II interest in and to said lands required for the right of way for said State Road, NOW, THEREFORE: ,II BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida,,i� that the Chairman and Clerk of this Board be and they are hereby authorized and directed to make, execute and deliver to the State Road Department a Deed in favor of the State of Florida) conveying all of its right, title and interest in and to the lands therein described for such right of way, and BE IT FURTHER RESOLVED, that two certified copies of this Resolution be forwarded u to the State Road Department at Fort Lauderdale, Florida. tl Upon Motion made by Commissioner McCullers, seconded by Commissioner Robert Graves, aj °3 and unanimously carried, the County Attorney was requested to make an appointment with the State Road Department at Fort Lauderdale at the earliest possible date and the Board would go down there to discuss the re -alignment of U. S. #1 from Wabasso to Gifford. u 4: Ed Schmucker stated hewould like to advertise for materials for the next six months and other new pieces of equipment. Upon Motion made by Commissioner W. C. Graves, Jr., �i seconded by Commissioner McCullers and unanimously carried, the Board authorized Mr. Schmucker;', to go ahead and advertise. Col. Leo M. O'Brien appeared before the Board and tendered his resignation as Director of Civil Defense for the County. Said resignation was accepted with regret. Upon motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Robert' Graves and carried,, the Board appointed Ed Schmucker as Director of Civil Defense with Elmer Harris as his assistant to do most of the work. Mrs. Anne Christensen, Cpunty Welfare Case Worker appeared before the Board and gave'P� a report of her activities for the month of December and said report was ordered filed by 6 E the Clerk. a Mrs. Christensen said she needed to put a Mrs. Wursauff in a nursing home for a 1 40 few months and stated she thought $50.00 a month for three months would take care of the situation. The Board authorized her to go ahead on this basis. �E E 1 r-- • • 1 0 A letter was received from the Chamber of Commerce together with a resolution adopted by the Combined Traffic Committee relative to recommendations to the Sta to Road Department for the solution of traffic problems at the Intersection of U. S. #1 Highway and State Road 60, and requested the Commissioners to further endorse said resolution. Upon Motion made by Commissioner McCullers, Seconded by Commissioner Robert Graves and unanimously carried, the Board does herewith endorse said resolution Notary Public Bond for Stella Arendas in the sum of $500.00 with St. Paul Fire & Marine Insurance Company as surety was approved by Douglas Baker, Clerk as authorized by law.
