HomeMy WebLinkAbout2/4/1958V TUESDAY, FEBRUARY 4, 1955: The Board of County Commissioners of Indian River County, met at the Courthouse, Vero Beach, Florida in a ragular meeting held at 9:00 o'clock A. M. Tuesday, February 4, 1957. All members were present. Also present were Ed Schmucker, Road & Bridge Superintendent, Sher- man N. Smith, Jr., Attorney and Katherine Morrison, Secretary. The Chairman asked if there were any changes or additions to be made to the minutes of January 7th regular meeting, and January 21st, special meeting. There being none and upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers, the minutes o of these two meetings were approved as read. ;f Mr. Bill Payne of the Rod and Gun Club appeared before the Board and stated that the k Rod & Gun Club would like to improve the facilities at Blue Cypress Lake, such as building I barbeque pits, putting in docking facilities, a well for water and other facilities. Upon ,u Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Hamilton and carried, the Board appointed a committee consisting of Commissioners McCullers and Robert Graves to get together with members of the Rod & Gun Club and find out just what they had in mind and then V '6 make their recommendations at the next regular meeting. r° Sherman N. Smith, Jr. stated at this point that the Flood Control District had not 9w given this county jurisdiction over the waters of .Blue Cypress but only that portion which we c now own. Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Hamilton and unanimously carried, the Board requested the County Attorney to contact Mr. Brian ,I McCarty of the Central & Southern Florida Flood Control Board and see if we could get this matter straightened out. Mr. Al Lefaver appeared before the Board and stated he was putting in a Grocery store off of the North Gifford Road but in that area was a law restricting the sale of al- coholic beverages and wanted to know whether or not he would be allowed to sell beer and wine to go out. The County Attorney advised him that he would be allowed to sell beer to go out only. 0 1 1 0 1 1 0 • 1 1 Cl u 40 1 • The foregoing Notice was read, whereupon all present were heard on the matter. Objections were raised by Mr. John H. Sutherland representing certain property owners in.the vicinity, thereupon on Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers and unanimously carried, the County Engineer and County attorney were directed to work with the parties concerned and further hearing on the matter was deferred until the next regular meeting of the Board. Major Keaton of the Civil Air Patrol appeared before the Board and explained the work of the Civil Air Patrol and requested some financial help toward buying two UHF radio units for the Civil Air Patrol. The Board informed Major Keaton that they were unable to help' them financially at the present time but if they could see their way clear in the future to give them such help they would be glad to do so. The Chairman stated that in regard to the recommendations of the Zoning Commission brought before the Board of County Commissioners at their last meeting that all members had gone over the proposed zoning changes on the ground and asked the pleasure of the Board om said recommendations. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner McCullers and unanimously carried, the following Resolution was unanimously adopted: RESOLUTION -- Zoning Changes WHEREAS, the Zoning Commission of Indian River County, Florida, did after public hearing make its final report recommending changes and additions to the Zoning Resolution of Indian River County, Florida; and, WHEREAS, this Board did publish its notice of said recommended changes and additions and did, pursuant thereto, hold a public hearing in relation thereto, at which parties in interest and citizens were heard; Now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, that the Zoning Resolution of Indian River County, Florida, and the accompanying Zoning map, be changed as follows, to -wit: 1. That the R -1-A, Country Home District, be extended South from the center of the Roseland Road approximately 410 feet to the South line of the Old Hight property and from the Old Dixie Highway, East to the Indian River. 2. That the C-1, Commercial District, cover the area from the North line of River - view Subdivision South to the North line of the City of Sebastian and from a line 150 feet East of the O1d.Dixie Highway, East to the Indian River. 3. That the area from the R -1-A, County Home District, mentioned in Paragraph 1 above South to the North line of Riverview Subdivision and from a line 150 feet East of the f Old Dixie Highway, East to the Indian River, remain R-3, Transient District. 4. That all of the remaining area North of the North City Limits of the City of Sebastian extending to a line approximately 410 feet South from the center of the Roseland Road and from the new right of way line of U. S. Highway No. 1 East to the Indian River not encompassed in paragraphs numbered 1, 2 and 3 above, be zoned R-2, Single Family District. 5. That the Zoning Resolution be changed in order that there be added at the end thereof a paragraph to read as follows: ".,Z/ F:6 QMH Any person desiring a change or amendment to the Zonigg Resolution or Zoning Map shall submit the same in writing to the. Superintendent of Public Roads describing by legal description and by street address, where possible, the property to be affected by the proposed change, setting forth the present zoning applicable thereto and specifying the district, zone or use requested by the applicant. There shall be at said time paid to the Superintendent of Public Roads for the account of the County the sum of $50.00 for each such requested change; pro- viding, however, that as many lots or parcels of property -as the applicant may desire may be included in any single petition provided the same is one contiguous area. The Superintendent of Public Roads shall then transmit the application to the Zoning Commission for tentative con- sideration at its next meeting. Should the Zoning Commission tentatively approve the petition, it shall report its tentative approval to the County Commissioners and should the County Commissioners tentatively approve the same, public hearings shall be had. Should either the Zoning Commission or the County Commissioners upon their tentative consideration disapprove the application and the applicant elect to proceed no further, then the fee deposited with the County shall be returned to the applicant; otherwise, the fee shall remain the property of the County..Should public hearings be held, then in connection with the publication of the notice for the public hearing before the Zoning Commission, the Superintendent of Public Roads shall mail a written notice to all property owners owning property within 300 feet of the outer limits of the area described in the petition requesting a change, advising all such owners as shown upon the last prepared and complete Tax Assessment Roll of the County stating in simple terms the proposed change and the time and place of the public hearing. The provisions hereof providing for mailing of notice is directory only and the failure to mail such notice shall not affect any change or amendment to said Zoning Resolution. The Chairman stated at this time that he would like to take up the matter of Elmer 'III 9 Harris's resignation which they had asked him to hold up until this meeting. Graves, Jr., and unanimously carried, the Board appointed Ed Schmucker to take care of any correspondence regarding the office of Civil Defense and that the appointment of Elmer Harris as his Assistant be rescinded. 'G Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Robert Rp Graves, and unanimously carried, the Board decided to increase the salary of Elmer Harris as l+ County Service Officer to $300.00 a year or $25.00 a month to become effective February 1, 1958 ` Two ladies from Rockridge Subdivision appeared before the Board regarding he matter of the swale ditch in front of their property. After considerable discussion in the mat and upon Motion made by Commissioner Hamilton, seconded by Commissioner McCullers and unani- �, _7 1+ mously carried the following Resolution was adopted: That the Board does herewith determine and establish as its policy that the only matters of drainage,in which the County is inter- ested is that of draining, its public roads. That insofar as the County is concerned, the G� Ff � 0 aN roadside swale ditches are for that purpose only. That the matter of providing driveways, roadside drainage pipes and any other special items for the accomodation of property owners abutting on the roadside are the sole responsibility of the abutting property owners, but that no abutting property owner shall change or alter the roadside drainage ditches except upon prior approval of the County Engineer. Any engineering, surveying, establishing levels or other costs or expense in connection with an adjoining property owners work in the roadside drainage ditches shall be done at the expense of the abutting property owner. Mrs. Anne Christensen, County Welfare Case Worker, appeared before the Board and gave her report for the Month of January, said report was ordered filed by the Clerk. County Superintendent of Public Schools, J. A. Thompson, appeared before the Board and suggested that the Commissioners require subdividersLof large tracts of land to set aside and dedicate to the county a sufficient acreage for school sites. He further stated that within the next year or two the school system would have to build either a new High School or Junion High and would like for the County to dedicate such land. He was advised that the county had sufficient land close to the present downtown school upon which said school could be built, and they would consider the dedication by subdividers for future sites. Mr. Ryall appeared before the Board with regard to a natural drainage ditch on U. S. p �i #1 between Wabasso and Vero Beach, which subject had been brought before the Board on several other occasions. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner McCullers and unanimously carried, the Board resolved that on the matter of the Lateral Ditch for the drainage of the proposed new U. S. #1 just South of W abasso, that the State Road y Department be advised that the County has made an inspection of this area and it is the opinionh a of the County that the present existing natural drain, lake and ditch should be used and main- tained on its present alignment for any drainage of this particular area. And that the State s N Road Department be requested to permit the adjoining property owners to dig, keep and maintain d this drain for a distance of 466 feet East of the present U. S. #1 right of way. Holly Jackson appeared before the Board and stated that he had bought the liquor license of the old Kerf4y Juke and was abandoning the old building and putting up a new building, but understood that in moving the license he would be restricted because of a resolution per- taining to this area in March 1956, and therefore, would like to have said resolution amended so that he would be able to open a bar in his new building. Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Mc - Cullers and unanimously carried, the following resolution was adopted: R E S O L U T I O N -- North Gifford Road Liquor Sales WHEREAS, the Board of County Commissioners of Indian River County, Florida, did adopt a Resolution zoning the area surrounding the public school on the North Gifford Road in Indian River County, Florida, with respect to the sale of alcoholic beverages and limiting the location wherein a vendor's place of business licensed under the Beverage Laws of the State of Florida may be permitted to operate; and, 0 1 1 E 1 • 1 1 E 0 1 1 0 1 0 i WHEREAS, said Board now desires to amend said Resolution and redefine the area; Now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, that this Board does herewith establish a zone or area in Indian River County, Florida, in a territory lying without the limits of any incorporated city or town wherein the location of a vendor's place of business licensed under the Beverage Laws of the State of Florida is pro- hibited from being operated and that such prohibited territory wherein such vendors shall not operate and where no license shall be granted to any such licensee to conduct such a place of business is described as follows, to -wit: All that area or territory lying within 2340 feet North and lying within 2340 feet South of a line described as follows: beginning at the intersection of Florida State Road No. 5, or U. S. Highway No. 1, and the North Gifford Road, and thence West along said North Gifford Road a distance of three-fourths of one mile. Provided, however, that this Resolution shall not apply to vendors licensed under paragraph (b) of subsection 1 of Section 561.34, Florida Statutes; and, BE IT FURTHER RESOLVED that this Resolution shall supercede the Resolution heretofo adopted by this Board with respect to said area; and, BE IT FURTHER RESOLVED that a certified copy of this Resolution be furnished to the Beverage Department of Florida and to the Tax Collector of Indian River County, Florida. At this point the County Engineer stated he had gone over the rest of the bids wand submitted same to the Commissioners: Item #1 - Sized bridge lumber. Bid from John A. There being no further business on motion made, seconded and carried, the Board then adjourned. y� C IRMAN TUESDAY, FEBRUARY 18, 1958 A special meeting of the Board of County Commissioners of Indian River County was held at the Courthouse, Vero Beach, Florida at 9:00 o'clock A. M. Tuesday, February 18, 1958. Present were Donald Macdonald, Robert Graves; D. B. McCullers, Jr., and J. J. P. Hai.ilton. Absent was W. C. Graves, Jr. Also present were Sherman N. Smith, Jr., Attorney; Ed Schmucker, Road & Bridge Superintendent and Katherine Morrison, Secretary. The Chairman announced a quorum was present and call the meeting to order. He then asked if there were any present who wished to bring something before the meeting. Mr. Hultman living in Rockridge Subdivision stated he was having a drainage problem and trouble with his neighbors over a swale ditch. He was informed that the County only ente into drainage problems when the water was damaging County roads. Sherman was asked to contact John Gould, the Prosecuting Attorney and see if there was something he could do for the Hultman's. The Commissioners then examined the aerial photographs on which the State had marked ;i the old and formerly proposed route for U.
