M., Tuesday, May 6, 1958. `;Present were Donald Macdonald, Chairman, D. B. McCullers, Jr.; Robert W. Graves; J. J. P. ;i, Hamilton and W. C. Graves, Jr. Also present were Ed Schmucker, Road & Bridge Superintendent, Sherman N. Smith, Jr., Attorney and Katherine Morrison, Secretary. The Chairman asked if there were any changes or additions to be made to the minutes "Of April lst regular meeting. There were none and upon Motion made by Commissioner Robert ,Graves, seconded by Commissioner McCullers and unanimously carried, the minutes were approved i, as read. Forrest McCullars, County Agent, appeared before the Board and requested a raise llfor his Secretary and was informed that the budget would not stand the additional at this �Itime, but would consider a raise in the next budget. Mr. McCullars also requested that his office -be air-conditioned and was informed that at this time the Board did not have the money. Sam Joyce, Sheriff appeared before the Board and stated there was a big hole over on the jail property which is very deep and full of'water and he was afraid some child would be drowned and requested that a fence be put around it. The Board asked Mr. Schmucker to look the situation over and see whether or not the hole could be partially or wholly filled and if not what it would cost to have afence put up. Mr. Joyce stated he was putting a full time life guard on duty at Wabasso Beach and would like to have a barricade constructed where cars enter and leave the beach South of the ^;bathhouse. Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner `,Robert Graves and unanimously carried, the Board instructed the Road & Bridge Superintendent ::to barricade this opening. I A delegation from Rosewood Elementary School headed by Dan Richardson appeared pbefore the Board with regard to the paving and widening of 16th Street. Upon Motion made by (Commissioner W. C. Graves, Jr., seconded by Commissioner Robert Graves and unanimously carried, the Board agreed to give the P.T.A. members of Rosewood Elementary School 30 days in which 'to obtain as many right of ways along 16th Street as they could and at the end of that time ,those right of ways not obtained would go into condemnation. The Board requested the County ;!;,Engineer to look into the matter and see whether or not a bicycle route could be.put in from Belmont Park to Clemans Avenue. 34,1 3 lF�' 'I e F'1310 P'll _ r A petition was presented containing 23 names of property owners in Lake Park Sub- division requesting the paving of Oak Lane and suitable culverts be installed. The Board requested the County Engineer to look into the matter and see what the cost would be and whether or not it would be feasible that this work be done. Jeannette Lier appeared before the Board with regard to a road in the Indian River across the narrow cut North of Pine Island in the vicinity of Buoy 102. Mrs. Lier would like to have this road removed. The Board advised Mrs. Lier that they had not put this road in and had not authorized anyone to put the road in. The Secretary was requested to write the Copp of Engineers informing them that the Board had nothing whatever to do with the construction of said road. Several owners of property in Florida Ridge Subdivision appeared before the Board with respect to opening up a road on the North of said subdivision and connecting with U. S. #1. The delegation was informed by the Board that said road would be in St. Lucie County, therefore, they should contact the Board of County Commissioners of St. Lucie County. Mr. Kinghorn representing property owners in Dixie Garden Subdivision, appeared before the Board with respect to paving the streets in said subdivision and was informed by! the Board that the county would not undertake the paving of roads in subdivisions. Charles Gollnick, lifeguard at Vero Beach Public beach requested that the poles in the water at Wabasso Beach be removed and would like the county to donate planking for a board-� walk at Wabasso Beach. The Board requested the County Engineer to remove said poles and to give whatever materials were necessary for the boardwalk from the stockpile at the County Barn. Mr. Gollnick also requested that "go slow signs be placed on the Wabasso road leading;,; to they Beach. The Board requested the County Engineer write to the State Road Department to declare this portion of Wabasso road a speed zone. Flip Lloyd, Engineer for the City of Sebastian appeared before the Board and stated that the City of Sebastian would remove the earth over the sand ridge just West of the rail- road track on State Road 512, if the County would fix the road. The Board's attorney stated that State Road 512 was in the State Road Department's tentative budget to be fixed. Upon motion made by Commissioner Hamilton, seconded by Commissioner McCullers and unanimously carried, i the Board requested the County Engineer write to the State Road Department requesting the following: That in connection with the item proposed in the State Road Department budget for State Road 512, Section :S8O4, for grading, paving and structure from State Road 510 to State Road 5, that the State Road Department make provisions in this job for the following: 1. The lengthening of the bridge across the Sebastian River. The County is well aware of the fact that this restriction in the Sebastian River causes water to build up on the South side to the extent that it goes up and over the top of the bridge and even over the top of the rail of the bridge in flood times. 2. That consideration be given at this time to the construction of the bridge.where Collier creek crosses this road. i 1 40 1 0 1 1 i 3. That consideration be given to lowering grade over the sand ridge just West of the railroad track and to straightening up the alignment. A delegation of colored people from Wabasso•appeared before the Board requesting a ditch be opened up to the North of their property and the road fixed. The Board requested the Engineer to do what he could for them. Alice Helleso from the Health Clinic appeared before the Board and requested that A j the be put on the floor of the Health Clinic. She was informed that this could not be done at this time. Mrs. Anne Christensen, County Welfare Case Worker appeared before the Board and made a report of her activities for the Month of April. Said report was ordered filed by the Clerk. The Chairman appointed a committee consisting of Commissioners W. C. Graves, Jr.; D. B. McCullers, Jr.; Mrs. Christensen and the County Engineer to see about getting plans and i, S do whatever else would be necessary so that work could be started on the Old Folk's Home at 1 least by September. 1 1 E Guy Sullivan of the Vero Beach Fire Department appeared before the Board and stated that he would like the County to buy the Fire Department a new Resusitator. He stated he would be able to get one for $493.00. Upon motion made by W. C. Graves, Jr., seconded by D. B. McCullers, Jr., and unanimously carried, the Board will appropriate this amount in next year's budget and that said money will be available before the first of January, 1959. The County Engineer brought before the Board a plat of Sun Acres and stated that since this subdivision was only 5 acres he thought it would be alright to do away with the 0 Y g g Y park area. Upon motion made by Commissioner W. C. Graves, Jr., seconded by.Commissioner McCullers and unanimously carried, the Board approved the Plat of Sun Acres without a park b area. I� A letter was read from the Taxpayer's Association of Indian River County. The Secretary was asked to write them thanking them for their suggestion. A letter was read from Florida Sta to Nurse's Association, District No. 17, and ordered filed. A letter was read from the Roseland Men's Club requesting that the fresh Water Line in the Sebastian River be established at the same line as it now is in Brevard County. The Board requested Sherman Smith to write to Brevard County to find out where their fresh water line is in the Sebastian River and to establish ours the same. i. Upon Motion made by Commissioner McCullers, seconded by Commissioner Robert Graves and unanimously carried, the Board tentatively approves the recommendation of the Planning and Zoning Board with respect to the proposed Industrial area set forth in their minutes of May lst and directs them to hold a public hearing thereon. Upon motion made by Commissioner McCullers, seconded by Commissioner Hamilton and unanimously carried, Sherman N. Smith, Jr. was advised to let the State Road Department know that it was agreeable with the Board that Glendale Road be paved to Lateral B as was in our original Resolution and not extend the paving to /Range Line Road. Sherman Smith advised the Board that the City of Vero Beach was desirous of ob- taining a 60 foot right of way through the jail property for water and sewage lines. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner McCullers and unanimously carried, the following resolution was adopted: R E S O L U T I O N -- Right -of -Way for Street over Jail Property WHEREAS, the City of Vero Beach has requested the County to convey a right of way for a public street over, on and across certain County owned property and it appearing proper to do so; Now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida,f' that the Chairman and Clerk are herewith authorized and directed to make, execute and deliver' the deed of the County to the City of Vero Beach conveying a right of way for a public street over, on and across the following described property, situated in Indian River County, Floridan k to -wit: A right of way for a public street over, on and across the South 60 feet of the North 75 feet of the West 30 acres of the Southwest , quarter of the Southeast quarter of Section 2, Township 33 South, Range 39 East. A The Clerk was ordered to record said deed from the County to the City of Vero Beach for this 60 feet right of way. Upon motion made by Commissioner Robert Graves, seconded by Commissioner Hamilton and unanimously carried, the Board desires to accept the permit from Central and Southern i Florida Flood Control as it applies to County owned land on Blue Cypress.Lake. R E S 0 L U TI ON -- Glendale Road ti On Motion of Commissioner Robert Graves, seconded by Commissioner.D. B. McCullers, P f Jr., the following Resolution was adopted: WHEREAS, the State Road Department of Florida has established location for that part of Glendale Road, designated as Section 8858, Job 151, between S.R. S -505-A to S.R. 5, 1 0 1 0 1 1 0 9 1 1 0 1 0 1 1 • and proposed to construct and maintain the same as a part of its Secondary Road Program; and Whereas, Indian River County is vested with all right of way required for said road; NOW, THEREFORE, the Board of County Commissioners of Indian River County does hereby affirm that it is vested with all of the reguired right of way for said portion of said State Road, to -wit: All the rights and interests of Indian River County into dedicated and used Glendale Road as now exists, and portions of other dedicated Streets lying within the proposed Right of Way as shown on the Right of Way Map of Section 8858-151, Glendale Road, as filed in the office of the Clerk of the Circuit Court, Indian River County, Florida. and that said right of way is legally clear and has been physically cleared of all buildings, fences and other improvements; that all utility poles, lines, cables, pipes and other facilit A have been removed or adjusted as required for construction of said project by the State Road I Department or such removal, and/or adjustments have been arranged for and will be effected iV without delay to the State Road Department and/or its contractors; and the State Road Depart- ment is hereby requested to proceed with the construction and maintenance of said portion of said Glendale Road and Indian River County hereby agrees to save harmless the State Road Department, its contractors, agents and employees, from all claims arising out of such con- struttio4 apd:.mgintenance of said road within the right of way aforesaid and to defend any and all lawsuits to completion and satisfy any and all judgments therein made, at the County's expense. NOW, THEREFORE, the Board of County Commissioners of Xndian River County, does hereby authorize the execution of a deed conveying the hereinabove described property to the State of Florida for the use and benefit of the State Road Department. The Clerk was ordered to place of record right of way deed from the County to the P -.i State Road Department for Glendale Road. Sherman N. Smith, Attorney stated he had received the appraisal from Jewett Appraisal Service for A -1-A in the limits of the City of Vero Beach. Upon motion made by Commissioner McCullers, seconded by Commissioner Hamilton and unanimously carried, the Board approved the appraisals of Jewett Appraisal Service and directed that each of the property owners be ad- vised that the County is willing to pay the appraised amount and authorized the payment of the appraised amount. Upon Motion of Commissioner McCullers, seconded by Commissioner Robert Graves and - S— unanimously carried, the Board gave tentative approval of Vero Beach Tropical Estates Sub- division Plat. Upon Motion made by Commissioner Hamilton, seconded by Commissioner McCullers and unanimously carried, the Board requested the County Engineer to check with the State Road Department to see what their plans are with regard to providing curb, gutter and sidewalk type of construction on State Road 5 through Wabasso, Winter Beach and Gifford. Such bills and accounts being on file in the office of the Clerk of the Circuit Court, the warrants so issued from the respective funds being listed in the Supplemental Minute Book as provided by the rules of the State Auditor, reference to such record and the list so recorded being made a part of these minutes. The County depositories filed their monthly statement, showing receipts and dis- bursements of the various funds, which have been audited, were found to be correct. ATTEST: SEC CHAIRMAN TUESDAY, JUNE 3, 1958 The Board of County Commissioners of Indian River County, met at the Courthouse, Vero Beach, Florida in a regular meeting held at 9:00 o'clock A. M., Tuesday, June 3, 1958. All members were present. Also present were Ed Schmucker, County Engineer, Sherman N. Smith, Jr., Attorney and Katherine Morrison, Secretary. The Chairman asked if there were any changes or additions to be made to the minutes of May 6th regular meeting. There were none and upon Motion made by Commissioner Robert Graves, seconded by Commissioner McCullers and unanimously carried', the minutes were approved as read. The Chairman read a letter from Forrest N. McCullars requesting that the ASC office be moved across the hall as soon as the Board of Public Instruction vacates same. Upon motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers and unan- imously carried, the Board stated upon the Board of Public Instruction vacating said offices that the ASC office could have these rooms. Mr. Dan Richardson appeared before the Board and gave a report on their trying to obtain rights of way for the County on 16th Street. He stated that out of the 28 names they had been given that 15 said they would sign. The Board expressed their appreciation to Mr. Richardson and others on this committee for the work they had done toward obtaining the rights of way. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner W. C. Graves, Jr., and unanimously carried, the following Resolution was approved. R E S O L U T I O N -- 16th Street Condemnation Proceedings. WHEREAS, the Board of County Commissioners, acting for and on behalf of Indian River County, Florida, has entered into an agreement with the State Road Department to obtain on behalf of the County for the State of Florida, for the use and benefit of the State Road Department, all of the rights of ways, easements and lands required for the construction of Section 8860-150, State Road 16th Street, in Indian River County, Florida; and, WHEREAS, said County has been unable by donation or purchase to acquire the remain - ing parts thereof; Now, therefore, 0 1 1 0 1 1
