ATTEST: SEC CHAIRMAN TUESDAY, JUNE 3, 1958 The Board of County Commissioners of Indian River County, met at the Courthouse, Vero Beach, Florida in a regular meeting held at 9:00 o'clock A. M., Tuesday, June 3, 1958. All members were present. Also present were Ed Schmucker, County Engineer, Sherman N. Smith, Jr., Attorney and Katherine Morrison, Secretary. The Chairman asked if there were any changes or additions to be made to the minutes of May 6th regular meeting. There were none and upon Motion made by Commissioner Robert Graves, seconded by Commissioner McCullers and unanimously carried', the minutes were approved as read. The Chairman read a letter from Forrest N. McCullars requesting that the ASC office be moved across the hall as soon as the Board of Public Instruction vacates same. Upon motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner McCullers and unan- imously carried, the Board stated upon the Board of Public Instruction vacating said offices that the ASC office could have these rooms. Mr. Dan Richardson appeared before the Board and gave a report on their trying to obtain rights of way for the County on 16th Street. He stated that out of the 28 names they had been given that 15 said they would sign. The Board expressed their appreciation to Mr. Richardson and others on this committee for the work they had done toward obtaining the rights of way. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner W. C. Graves, Jr., and unanimously carried, the following Resolution was approved. R E S O L U T I O N -- 16th Street Condemnation Proceedings. WHEREAS, the Board of County Commissioners, acting for and on behalf of Indian River County, Florida, has entered into an agreement with the State Road Department to obtain on behalf of the County for the State of Florida, for the use and benefit of the State Road Department, all of the rights of ways, easements and lands required for the construction of Section 8860-150, State Road 16th Street, in Indian River County, Florida; and, WHEREAS, said County has been unable by donation or purchase to acquire the remain - ing parts thereof; Now, therefore, 0 1 1 0 1 1 1 L 3 197 BE IT RESOLVED by the Board of County Commissioners of Indian Rive11 r County, Floridal that Shereman N. Smith, Jr., the attorney for this Board, is herewith authorized and directed to prepare and file in the Circuit Court of Indian River County, Florida, any and all do- cuments required in order that all of said lands, rights of ways and easements required for the construction of said road shall be condemned in eminent domain proceedings and the title to said lands vested in said State, including a Declaration of Taking as authorized by Chapter 74, Florida Statutes, and said attorney is further authorised and directed to prose- cute said proceedings in the name of Indian River County, Florida, to Final Judgment. Mrs. George Lier appeared before the Board and asked if any word had been received in answer to the one written to the Corp of Engineers. No word had been received and the Board advised the Secretary to write another letter requesting a reply to the first letter. They stated they would like to find out the attitude of the Corp of Engineers before taking further action. A delegation appeared before the Board from Lake Park Subdivision wanting to know whether or not the Commissioners would pave Oak Lane. Mr. Schmucker had been asked at the last meeting to look into the matter. He stated that in his opinion it would not be feasible that the County pave Oak Lane. The Commissioners concurred with Mr. Schmucker and stated that at this time they did not think it would be feasible to pave said road. Mr. William A. Smith appeared before the Board and stated he had been before the Planning and Zoning Adjustment Board requesting that he be allowed to build an apartment over his grocery store and they had denied his request. The Commissioner's informed Mr. Smith that there was nothing they could do for him and sugges ted he might apply to the Planning and Zoning Board to have said area rezoned. Mrs. Anne Keene and several others appeared before the Board and requested an increase in the appropriation to Child Welfare. The Board said they would consider their request in making up the budget for 1958-1959. The Indian River Citrus Bank of Vero Beach, Florida, and the Florida National Bank at Vero Beach, Florida, having filed proper applications requested to be named and designated'', County Depositories for the year 1958-59, and upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Robert Graves and carried, it was ordered the Indian River Citrus Bank be designa ted County Depository for the following funds: General Revenue Fund, Road and Bridge Fund. The Florida National Bank be designated as County Depository for the following funds: Fine & Forfeiture Fund and Capital Outlay Fund. A letter was read from the Florida School for the blind and said letter was turned over to Mrs. Anne Christensen. Troy E. Moody submitted the E & I Intangible Roll to the Board for approval and upon Motion by Commissioner McCullers, seconded by Commissioner Hamilton and carried, said Roll was approved. F'320 V1 0 Is-3 19 Mr. Schmucker stated he had received word from the State Road Department that they were only going to resurface SR 512. The Board requested that Mr. Schinucker and Mr. Lloyd of Lloyd Engineering firm go to the State Road Department office in Fort Lauderdale and get a clearance for the County and the City of Sebastian to tearing down the grade and placing of the rock before the State Road Department started their work. 2 Mr. Goodridge of the Indian River.Memorial Hospital appeared before the Board and stated they would like to continue on the Hospital Indigent program and to receive the $15,000.00 appropriation from the County in our 1958-59 budget. Rev. Owen of Wabasso appeared before the Board and wanted to know if anything could be done to stop the beach buggies from riding the beach. He was told it would take an act of Legislature. He said he would like to have such an act passed at the next session of the Legislature. Mrs. Anne Christensen, County Welfare Case Worker appeared before the Board and gave her report for the month of May and said report was ordered filed by the Clerk. Sam Joyce, Sheriff requested that the good-time off for John F. Markle who was sentenced to three months in jail for driving while intoxicated be revoked, as Mr. Markle has 'i been a troublesome prisoner since he has been in jail. Mr. Joyce further stated he would be j allowed 15 days off for good behavior. Upon Motion made by Commissioner McCullers, seconded by Commissioner W. C. Graves and unanimously carried, the Board revoked the good-time off of Mr. John F. Markle. Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Mc - Cullers and unanimously carried, the Subdivision Regulations in their printed and final form were adopted. Upon Motion made by Commissioner W. C. Graves, Jr., seconded by Commissioner Hamilton and unanimously carried, the following Resolution was adopted: R E S O L U T I O N -- Purchase of Land for Public Beach WHEREAS, Indian River County, acting by and through its Board of County Commissionerp is duly authorized by the laws of the State of Florida to acquire, own, develop and maintain public parks; and, WHEREAS, there exists a great need in this County for a public park fronting on the Atlantic Ocean to provide not only public park facilities but to permit ready access to the Atlantic Ocean by the general public for bathing purposes; and, WHEREAS, the United States of America, acting by and through the Bureau of Land .Management of the Department of the Interior is the owner of and has available for acquisitions by public bodies such as Indian River County the following described lands, situated in Indian River County, Florida: Township 32 South, Range 40 East, Tallahassee Meridian, Florida, Section 20, Lot 1, the East 10 acres, as shown in plat of survey approved December 26, 1859, except the South 1,000 feet (7.8 acres) containing 2.2 acres, now in Indian River County, Florida. a �i fI 0 1 1 0 1 i 1 1 0 1 1 40 �J 1 1 41 X21 I, for purchase for recreation purposes as provided by the Recreation Act of the Congress of the United States of America; Now, therefore, BE IT RESOLVED b the Board of Count Commissioners of Indian River Count Y Y Y> Florida, �a acting for and upon behalf of Indian River County, a political subdivision of the State of Florida, that Sherman N. It is not planned that any revenues be realized from the County's operation of this project and all of the land and facilities will be available without charge. It was noted that a piece of land was being offered for sale by the County in the Wabasso area. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner W. C. Graves, Jr., and unanimously carried, the Clerk was authorized to withdraw this piece of from sale. Mr. Schmucker said he had look at the hole on the jail property and thought by putting up a strand of barbed wire around the lake and placing several no trespassing signs, this should take came of the situation.
