AND INDIAN RIVER COUNTY, FLORIDA. This is an amendment to the existing Engineering/Land Surveying Services Agreement (AGREEMENT) dated March 18 , 2003 between Bridge Design Associates , Inc . (ENGINEER) and Indian River County (COUNTY) . This amendment addresses changes in "Section I" — "Project Limits and Description" , " Section III - Scope of Services " and " Section V - Compensation " . Amendment Description This Amendment includes the following : The ENGINEER will perform the necessary engineering services to the Old Dixie Highway Bridge over South Relief Canal Project by upsizing the drainage pipes to take in offsite drainage areas . "SECTION I — PROJECT LIMITS AND DESCRIPTION The project is located approximately 3300 feet north Along Old Dixie Highway between 2nd Street SW and 3 `d Place . The Old Dixie Highway road plans will be modified by upsizing the drainage pipes to take in offsite drainage areas extending from SW 6th court to Old Dixie Highway between 2nd Street SW and 1st Street SW . On the north end of the Project, the drainage system will be modified to include sufficient capacity to convey runoff from the Old Dixie Highway right-of- way to 3rd Place . On both ends of the Project , the additional drainage areas will be conveyed to the proposed dry retention areas . " SECTION III — SCOPE OF SERVICES " is being modified to incorporate the following : The permits and roadway portion of the plans for the improvement will be modified to take in offsite drainage areas . The drainage system will be modified to include sufficient capacity to convey runoff from the Old Dixie Highway right- of-way and off site drainage areas . Permit modification applications will be prepared and submitted to the St . Johns River Water Management District , Indian River Farms Water Control District, Corps of Engineers , Department of Environmental Regulation and any other applicable permits as outlined in the original AGREEMENT . Lump Sum $ 119110 . 53 Permit Application Fees (Not To Exceed) $ 350 , 00 TOTAL Amendment No . 3 $ 119460 . 53 There are no soil borings , sketches and legal descriptions , raster images , or as -built plans included in the above fee . The AGREEMENT is hereby amended as specifically set forth here in . All other sections of the AGREEMENT shall remain in full force and effect and are incorporated herein . This Amendment No . 3 to the AGREEMENT regardless of where executed, shall be governed by and constructed by the laws of the State of Florida.
