SD -04-03 -15 -MAINT (2002040022 -38116 ) and SD -04 -07 -33 -MAINT (2002040022 .40342) V�IHEREAS , the undersigned Developer has obtained (approval by the Board of County Commissioners for the recordation of the final subdivision plats for projects known as Brookfield at Trillium Phase `A' and Brookfield at Trillium Phase ` B ' , pursuant to the Indian River County Subdivision Ordinance ; and WHEREAS , Developer has constructed certain required improvements as defined by , and in accordance with the requirements of said ordinance , all as described and evidenced ' in the various drawings and plans supporting the issuance of the Land Development Permits , together with the . as built , plans , test results , and certificates of completion of the Developer' s engineer;'' and WHEREAS , Developer desires to transfer all its right , titl and interest to the County in and to allth'ose irrmprovernents constructed ;wlthih. publicly edicated lands of said projects , free and clear of encumbrances',` aogether with the assignment of all existing warranties and Developer's` 'agreemer t 16 maintain botl `- public and private road and drainage improvements , as required by ordinance , and as stated he ein below . WITNESSETH : That for and in consideration of the sum of ONE DOLLAR ($ 1 . 00 ) and other good and valuable consideration , , the receipt of which is hereby acknowledged , Developer, on behalf of itself and: all successors and assigns , does hereby: 1 Represent unto Indian River County , a political su division of the State of Florida , that the ' required :Improvements in ' said , project have b en constructed and installed as required by the ordinance ', in the manner `describ d above ; and specifically consist of: See Exhibit "A" attached hereto . 2 . Agree that , should the required improvements fa I or otherwise become defective during a period of three years from, the date of Certificates of Completion of said required „irnprpven e its , due to defective materials o workmanship , the Developer shall upon each occasion, be"responsible in all respects for such failure or defect . Provide herewith , or has provided heretofore in a mar ner satisfactory to the County , security to guaranty beveloper' s performance of th s maintenance agreement , being either a cash escrow deposit, or irrevocable letter of credit .
