HomeMy WebLinkAbout7/25/195840 1 1 0 1 1 0 I 337 FRIDAY, JULY 25, 1955 A special meeting of the Board of County Commissioners was held at the Courthouse in the County Commissioner's Room, Friday, July 25th at 7:00 P. M. Present were Donald Macdonald, Chairman; J. J. P. Hamilton, and D. B. McCullers, Jr. Absent were Robert W. Graves and W. C. Graves, Jr. Also present were E. S. Schmucker, Jr., County Engineer and Charles Smith sitting in for Sherman N. Smith, Jr., County Attorney. Mr. Cornelius Walker, Attorney appeared before the Board with his client Mr. George B. Dexter who owns property on the corner of Glendale Road and U. S. #1. The County had agreed with Mr. Dexter on the amount to be paid for the Right of Way along Glendale Road but the State Road Department is requiring an additional 40 feet along U. S. #1 for a turn- out. After considerable discussion in the matter and upon Motion made by Commissioner Mc - Cullers, seconded by Commissioner Hamilton and carried, the Board agrees to pay to Mr. Dexter $61.00 a foot for the South 43.80 feet along the h�tghway and for the 40 foot triangle a price of $30.50 a foot, making a total of $3891.00 to be paid to Mr. Dexter for this right of way. Sam Joyce, Sheriff appeared before the Board stating that certain parties had placed a fence across the Winter Beach Road right of way leading from A -1-A to the Beach which the County had cleared for the use of the colored Methodist conference to be held July 30, 31 and August lst and 2nd. Upon Motion made by Commissioner Hamilton, seconded by Commission McCullers and carried, the Board instructed the County Attorney to take whatever legal steps were necessary to have the Said fence or barricade removed. At this point the Attorney pointed out that certain parties were going to institute an injunction or suit against the right of way in question and he thought it would be better to let them institute such pro- ceedings and then the county to defend same. Thereafter further duscussion followed and Mr. Hamilton withdrew his former motion with the request that further action be deferred until the next regular meeting of the Board. Mr. McCullers who had seconded the motion, withdrew his second. The Board then asked the County Attorney and the County Engineer to check the width of the Old A -1-A right of -way and if they find that the fence is in that right of way and if the attorney feels it is legal to remove said fence to do so.
