HomeMy WebLinkAbout2009-078 - r77 oq Q78 AMENDMENT NUMBER 5 WORK ORDER NUMBER 1 This Amendment Number 5 to Work Order Number 1 ( " Amendment") is entered into as of this 17th day of March 2009 Effective Date " ) pursuant to that certain Continuing Contract Agreement for Professional Services entered into as of April 6, 2004 ( "Agreement" ), by and between Indian River County, a political subdivision of the State of Florida ( " COUNTY") and Camp Dresser & McKee Inc . ( "Consultant" ) . 1 . The COUNTY has selected the Consultant to perform the professional services set forth in Work Order Number 1 dated April 13, 2004 . 2 . The COUNTY and the Consultant desire to amend Work Order Number 1 as set forth in Attachment A to this Amendment and made a part hereof by this reference all in accordance with the terms and provisions set forth in the Agreement. 3 . From and after the Effective Date of this Amendment, Work Order Number 1 is amended as set forth in this Amendment. Pursuant to paragraph 1 . 4 of the Agreement, nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . Fe , Assistant County Attorney j12142.doc ATTACHMENT A Part A PROJECT DESCRIPTION The North County Water Treatment Plant expansion has been under construction for the last two years . This amendment is a final reconciliation of additional engineering services rendered by CDM throughout the course of construction . Indian River County Utilities staff, CDM and the Contractor have worked closely to contain capital cost of the plant while increasing the plant' s productivity . This phase of the project was originally intended to add to add three more functioning nanofiltration skids ( treatment trains that purify 1 . 5 million gallons each of water per day) with three additional skids being installed but not loaded with membranes . The final project loaded two of those three skids with membranes . This provided the ability to purify an additional 3 . OMGD of water which can be blended with 1 .29MGD of well water for distribution . The expansion provided Indian River County with operational flexibility and reliability, as well as reserve water treatment capacity to meet future demands, enhancing the overall water utility . This amendment is the final reconciliation amendment to close out the project compensating CDM for the engineering services necessary for the successful completion of the project. A- 1 1121 a2.doc ATTACHMENT A Part B SCOPE OF WORK INDIAN RIVER COUNTY NORTH COUNTY WATER TREATMENT PLANT AMENDMENT NO . 5 - FINAL RECONCILIATION AMENDMENT FOR ADDITIONAL PERMITTING AND ENGINEERING SERVICES BACKGROUND The North County Water Treatment Plant (NCWTP) is a permitted 3 . 53 million gallons per day (mgd) (3 . 0 mgd of permeate) facility serving northern Indian River County (IRC ) . Construction of the original water plant began in June 1996 and was placed into operation in July 1998 . The facility utilized two 1 . 5 mgd membrane treatment nanofiltration skids and incorporated a raw water blend rate of approximately 15 percent (0 . 53 mgd ) to achieve the facility finished water capacity of 3 . 53 mgd . The facility layout was designed for future expansion at such time customer demand in the North County service area warranted . This Admendment is for the close out of the Phase II plant expansion which was successfully bid and the contract was awarded to Poole and Kent of Florida to construct the plant. This phase was to add three new 1 . 5 mgd nanofiltration skids along with three skids for future water production which will be installed without membranes . The actual project added five new skids with membranes and one empty skid for future expansion . This will allow for additional water production without a major plant upgrade after the well field has been expanded to provide the necessary raw water supply. This amendment is for additional services expected for unanticipated permitting services and additional engineering services during construction . SCOPE OF SERVICES CDM shall provide additional engineering services related to extra permitting in Task 3, and supplementary construction services in Task 5 . The original project design activities started in 2004 and the construction oversight period and scope of work have been modified over the last four years due to various project changes . During the construction period, additional items have been added to the project or modified, which upgraded the facilities improving the ability to economically expand the plant in the future and efficiently operate the plant. CDM has worked closely with IRC staff to minimize additional engineering effort associated with the plant expansion . The following described engineering services are additional scope items not previously covered in the Phase II plant expansion Amendments 1 , 2, 3, and 4 . The following descriptions are for additional services to be covered under this amendment: Task 1 . 0 Preliminary Design (No Changes in this Amendment) Task 2 . 0 Preparation of Contract Documents (No Changes in this Amendment) Task 3 . 0 Permitting Services (Amendment No . 5 Additional Services) A-2 i121 a2 . doc This task provides for the preparation of necessary permit applications, meetings, and negotiations with regulatory agencies and preparation of one response to Request for Additional Information (RAI) from IRC Planning and Zoning and Florida Department of Environmental Protection (FDEP) . ■ A change was initiated by IRC that increased water production (by loading additional skids with membranes ) and produced a deductive change order for the construction project. The contractor was to replace the nanofilitration membranes in the existing skids 1 and 2 with new membranes . Since the existing membranes are performing well, the decision was made to keep them in place and load two skids that were to be left empty during this expansion . This saves IRC the expense of removing the existing membranes and gives operational flexibility to the plant so the pumps can be exercised regularly and other maintenance can be performed without disrupting water production . These changes will require performance testing and test result review . These changes will have to be incorporated into the certification of the construction permit to FDEP . ■ IRC has also made some field changes regarding the location and amount of impervious area by relocating sidewalks from areas of little traffic to areas of greater traffic . While these changes do not negatively affect the project contract price the changes will have to be demonstrated to the IRC planning and zoning as a deviation from the permitted plan . Preparation of additional documentation for planning and zoning was required . Task 4. 0 Bidding Assistance Services (No Changes in this Amendment) Task 6. 0 Out of Scope Services During Construction Contract Extension The contract administration task has increased in duration as a result of the concentrate permit delays that impacted the procurement of the FDEP construction permit . The following time line illustrates the extent of the project being lengthened . Advertisement to Bid : June 30, 2006 Bid Opening: August 16, 2006 Construction Contract November 14, 2006 Notice to Proceed January 12, 2007 Issuance FDEP Permit April 23, 2007 Extended NTP April 27, 2007 The notice to proceed was extended by 105 days for the contractor because site work could not commence until the FDEP permits were in place . This provided the contractor with additional time for generating requests for additional information and could have resulted in a delay change order for IRC, which was tabled through the efforts of IRC staff and CDM . Additional RFI Reviews One of the cost containment measures was to limit the engineering oversight of the Resident Project Representative (RPR) . The periodic field representative task was subcontracted through temporary labor service provider. This greatly reduced RPR cost to the project . IRC used staff A-3 112142.doc inspectors to further reduce the engineering oversight costs required for this project; however the extended project time has increased the number of requests for additional information and submittals . There have been 81 requests for additional information to date in this project . Accelerated Walkthroughs In an effort to reduce the potential for a delay change order to the construction contract, IRC is considering accelerating substantial completion inspection for the contractor . While this creates more effort in the inspection process, it improves the contractor's ability to provide final payment on materials that are benefiting IRC . This arrangement increases the contractor's motivation to finish early or on time by improving their cash flow . Membrane Procurement Procurement of the nanofiltration membranes was originally in the contract as the contractor ' s responsibility . IRC processed Change Order No . 1 to remove that responsibility from the contractor and realized a cost savings of $44,000 in sales taxes by direct purchasing the membranes . CDM has assisted IRC with the change order and the procurement of the membranes . This effort was beyond the original scope of work . Additional Pay Application Review CDM has incurred out of scope costs associated with review of the pay application for reduction in retainage . CDM worked with staff to provide input into a reduction in retainage agreement for the contractor to be paid for substantially complete portions of the plant which benefit IRC This task is for the additional effort in reviewing these pay applications and contract amendments . Instrumentation Review and Coordination The instrumentation for a project of this magnitude is very complex . CDM has provided more support for the instrumentation system supplier than estimated . These efforts were for review of system enhancements and equipment selected by the instrumentation system supplier. Wellfield Electrical Coordination The NCWTP and the wellfield development had to be coordinated at the plant. The wellfield configuration was different from the design expectations used in the yard piping and the electrical duct banks onsite . Most of the wells were to be powered by the onsite switch gear allowing the generator system to provide backup power. Modifications to the onsite duct banks were made to accommodate the wellfield changes . This work was not in the original scope of work . Stormwater Discharge Monitoring In the course of the construction project, the contractor encountered discolored groundwater that was displaced when the yard piping was being installed . This anomaly required additional effort to ensure the construction contract was not negatively affected by this occurrence . CDM incurred additional effort to meet with the County' s stormwater discharge compliance officer, which was not foreseen in the original scope of work . A4 112142 . doc Start Up Services and O &M Manuals The original contract specifically excluded start up services and Operation and Maintenance (O&M) Manuals . CDM provided limited start up services to review operating equipment and also reviewed O&M Manuals submitted by Contractor. Additional Record Drawing Production The original scope of work for the design of the plant expansion identified 139 drawings for the design of the plant. The actual number of sheets for the plant design was 169 sheets . This task is for the effort to conform the project record drawings beyond the original scope of the project. This task does not seek to recover the additional design costs for these sheets . SCHEDULE The project is expected to be complete within the next 30 days .
