HomeMy WebLinkAbout2004-112 de IMPLEMENTATION OF THE EAST INDIAN RIVER COUNTY MASTER STORMWATER MANAGEMENT PLAN : WORK ORDER No . 5 TO THE PROFESSIONAL ENGINEEERING SERVICES AGREEMENT BETWEEN CARTER ASSOCIATES, INC. , AND INDJAN RIVER COUNTY, FLORIDA FOR FINAL DESIGN SERVICES AND CONSTRUCTION MANAGEMENT SERVICES FOR STORMWATER POLLUTION CONTROL SYSTEMS IN THE MAIN RELIEF CANAL, THE SOUTH RELIEF CANAL, AND THE NORTH RELIEF CANAL Pursuant to the Professional Engineering Services Agreement ( MASTER AGREEMENT ) dated May 8 , 2001 , by and between INDIAN RIVER COUNTY, a political subdivision of the State of Florida , hereinafter referred to as the COUNTY , and CARTER ASSOCIATES , INC . , Vero Beach , Florida , hereinafter referred to as the ENGINEER , this WORK ORDER No . 5 is an extension of and hereby becomes a part of the MASTER AGREEMENT as follows : SECTION 1 = PROJECT LIMITS AND DESCRIPTION In accordance with the East Indian River County Master Stormwater Management Plan ' s ( Master Plan ) recommended improvements and actions , and also in accordance with the COUNTY' s Florida Department of Environmental Protection Phase II MS4 Permit , WORK ORDER NO . 5 is for final design services for pollution control systems in the Main Relief Canal , the South Relief Canal , and the North Relief Canal . The Main Relief Canal and the South Relief Canal were discussed in a Preliminary Engineering Report prepared by the ENGINEER , titled Vortex Treatment Units and Floating Debris Capture Equipment , dated November 2003 , The North Relief Canal ' s pollution control system will be similar to the one to be designed forthe South Relief Canal . This Work is discussed in more detail in SECTION III — SCOPE OF SERVICES PROVIDED BY THE ENGINEER , SECTION II = COUNTY OBLIGATIONS The COUNTY will comment on the ENGINEER ' s work in a timely fashion . May 3 , 2004.doc 1 COUNTY will supply application fees for the required federal state and local permits . The COUNTY will prepare site plan applications for the North and South Relief Canal sites . Additionally, the COUNTY will prepare bidding documents , contract documents , and Division 1 of the technical specifications . The COUNTY will provide the ENGINEER' s architect with a draft floor plan of the Main Relief Canal Operations Building . SECTION III - SCOPE OF SERVICES PROVIDED BY THE ENGINEER A. PROJECT ASSIGNMENTS - The "design team " is collectively comprised of Carter Associates , Inc . ( CAI ) , Environmental Consulting & Technology , Inc . ( ECT) , and CDS Technologies , Inc . (CDS ) . In general , the individual team assignments are listed on Attachment 1 , included herein . Be GENERAL - The pollution control systems covered by this Work Order are intended to remove pollutants (floating and suspended solids and their associated nutrients ) from the waters of the Main , South , and North Relief Canals . The projects ' purpose is to protect the water quality of the Indian River Lagoon and thereby aid in restoring the Lagoon ' s seagrass coverage . C . LAND SURVEYING SERVICES - CAI shall prepare the Land Surveying Work Product ( Survey Work Product) and the design team will use the Survey Work Product for designing and permitting the stormwater treatment facilities . The Survey Work Product shall contain all information necessary for a third - party land surveyor to independently recreate the survey work. Also , the Survey Work Product shall contain all information necessary for the complete design of each pollution control system , even though such surveying services may not be specifically discussed below. 1 . The Survey Work Product The Survey Work Product must meet or exceed the following minimum standards : a . Drawing Requirements - As a minimum for each site , the survey drawing set will consist of ( 1 ) Boundary Survey and Survey Control Map , (2 ) Topographic Survey ( including canal cross-sections ) . Use multiple pages for each as necessary . Minimum drafting standards for all Drawings are : ( 1 ) Prepare and supply an electronic disc at completion of all Drawings using AutoCAD Release 2000 or later . (2 ) Drawing Scale — Except for the overall plan view sheet and unless otherwise approved in writing by the COUNTY , the horizontal scale shall be 1 "=20 ' or larger (e . g . 1 " = 10 ' , 1 " = 51 ) . Use matchlines as appropriate . May 3 , 2004.doc 2 shall be 1 " =40 ' or larger (e . g . 1 " = 30 ' , etc . ) - the intent is to fit all of each site on a single overall plan view sheet using the largest scale practicable . (3 ) Text Size - No text ( including numbers ) shall be smaller than 1 /8- inch high . (4 ) Drawing Sheet Size - Drawing sheet size shall be 244ch by 36- inch . (5 ) Existing Utilities (a ) Call out each existing utility in the following order: 1 . Type of utility (e . g . " high pressure gas main , " high voltage electric lines , " "water main , " "gravity sewer, " "force main , " "drainage culvert") 2 . Diameter 3 . Type of material 4 . Number of pipes/conduits , as applicable . (b ) All existing utilities shall have the system-abbreviated text written into the line . (e . g . ------ FM ------ for a force main . ) (c) Tie -down the horizontal location of each utility. (d ) Screen existing utilities 60 percent . 2 . Boundary Survey and Survey Control Map - Provide a detailed Boundary Survey and Survey Control Map for each site . This drawing is intended to provide an independent land surveyor with all horizontal and vertical control information necessary to independently reproduce the work in the field . All work shall meet the " Minimum Technical Standards for Surveying and Mapping " as set forth in F . S . Chapter 472 . 027 , and the requirements listed herein . If there is a conflict between the " Minimum Technical Standards for Surveying and Mapping " and the requirements listed herein , the more stringent criteria shall prevail . Show and identify all properties ( including property owner and tax parcel identification number) , road rights-of-way , drainage ditch rights-of--way , and other rights -of-way and easements within the survey limits . 3 . Survey Baseline a . For each site , establish a Survey Baseline that can later be used as a Construction Baseline . Where possible , the Survey Baseline shall run parallel to right-of-way lines . Set survey control points at maximum 500-foot intervals and at all angle breaks . Show the Survey Baseline on the applicable drawing (s ) . b . Tie all bearings to the State Plane Coordinate System , NAD 83/90 and state origin of datum . All bearings shall read in a clockwise direction . Reference the north arrow to the bearing base . May 3 , 2004.doc 3 C , Provide information on all recovered monumentation . d . Tie each Project' s main Control/Baseline to all Section lines intersecting and/or in the vicinity of the mentioned control . A Certified Corner Report shall be prepared , submitted to D . E . P . and a copy supplied to County Surveyor (as per Florida Statutes 177 part III . ) 4 , Vertical Survey Control — ( NGVD29 Datum ) With a +/- local conversion factor to NAVD88 . (This is just a note of conversion on the Cover Sheet. All elevations on the Construction Drawings shall be NGVD29 . ) Establish Temporary Bench Marks (TBMs ) at maximum 250400t intervals along the Survey Baseline and the property' s perimeter. These TBMs shall consist of long lasting - durable materials and/or be fixed on a substantial feature . The Contractor will use these TBMs during construction . Show TBMs on the Boundary Survey and Survey Control Map with a reference to the " Published Origin/Bench Mark" of the Projects' Vertical Control . 5 . Survey Control — Permanently mark all control points ( horizontal and vertical ) . Provide one set of signed and sealed copies of all field books and reduction of data to the COUNTY upon completion of the Work. Locate all control points to minimize the potential for disturbance and provide references for main control points (e . g . P . C . , P . I . , P . T . bend points ) to allow for their re-establishment in the event of loss during construction . Show control points and references on the Boundary Survey and Survey Control Map . 6 . Existing Spot Elevations and Existinq Contours — Show existing spot elevations at minimum 100-foot intervals , and as necessary to accurately illustrate grade changes and unusual topographic features . Show existing spot elevations and existing 1 ,, foot contour lines at top of bank and beyond , for each site . Rotate all spot elevations 45 degrees . Show the topographic information on the Topography Drawings . Also , provide the COUNTY with a spreadsheet or text file with coordinates and spot elevations . 7 . Canal Cross Sections - All canal Cross Sections shall depict the actual physical condition of the canal . Show top of banks , slopes , water elevation , submerged grade breaks , drop-offs , silt/muck depth and/or any features that may affect design analysis . 8 . Limits of Canal Cross Section Surveys — In general , the limits of canal cross section surveys shall be as listed below . The ENGINEER shall use its discretion regarding the number of cross-sections to take , understanding that the cross-sections will be used to reshape the canal banks upstream and downstream of each treatment system . Main Relief Canal : Eastern limits = 400 feet east of the proposed tilting weir structure or 50 feet west of the railroad bridge , whichever is the shortest distance . Western Limits = 50 feet east of the spillway . b . South Relief Canal : Eastern Limits = 400 feet east of the proposed tilting weir structure . Western Limits = the Old Dixie Highway Bridge . ( Indian River County has existing survey information in the vicinity of the Old Dixie Highway Bridge , and the COUNTY will provide this information to the ENGINEER . ) c . North Relief Canal — Eastern Limits = 50 feet west of the U . S . Highway No . 1 bridge . Western Limits = 50 feet east of the Old Dixie Highway bridge . 9 . Existing Planimetric Features — Locate and identify all visible , above ground physical features and objects within the Limits of Survey , and show this information on the Topography Drawings . Planimetric features include , but are not limited to : existing and established Survey Control , pavement , dirt trails or roads , driveways , sidewalks , curbs , bridges , structures , valve boxes , hydrants , poles , towers , overhead wires , manholes , mailboxes , fences , plantings , drainage structures , water bodies , edge of wooded areas , trees 3,, inches or larger in diameter within the canal right-of-ways (and identify the size (diameter) and species of each tree ) , signs , etc . Also , show the extension of the centerline of the City Municipal Airport' s runway on the plan view . D . ENGINEERING SERVICES —The design team shall provide the following services so that the Work described herein can be permitted by applicable federal , state , and local regulatory agencies , properly bid by the COUNTY , and constructed by a Contractor selected by the COUNTY : 1 . Final Engineering Design and Calculations — The design team shall design a pollution control system for ( 1 ) the Main Relief Canal , (2 ) the South Relief Canal , and ( 3 ) the North Relief Canal as discussed and recommended in the approved Preliminary Engineering Report . In general , each pollution control system shall include a floating boom system , three or more climber screens , and two or more vortex units . The floating boom system directs floating debris in the canal to the climber screens . The canal water will flow through the climber screens into an animal removal chamber, and then into a main channel that routes the canal water into the vortex treatment units . Design the floating boom to rise and fall with the canal water level . Canal water level shall be regulated by a tilting weir. Design the tilting weir to provide the necessary operational head for optimum operation of the vortex units throughout their design flow range . Design the entire system for continuous and automatic operation . May 3, 2004.doc 5 Provide a secondary bar screen in an open area (animal removal chamber) before the main vortex feed channel to prevent animals such as alligators and turtles from entering the vortex units . Design this animal recovery system so that it is possible to remove captured animals without harming the animal or the rescuer. Design the vortex system to remove one hundred percent of particles 2 , 400 microns and larger. It shall also be capable of removing particles down to 500 microns in size . Design the facility at the Main Canal to minimize attraction of birds . Measures to minimize the bird attraction may include pavilion-type or prefabricated buildings or the ability to easily construct an appropriate structure in the future . Additionally, the pollution control systems shall include all pertinent features and facilities normally found at similar municipal installations (e . g . wastewater treatment plant headworks ) . Such features include , but are not limited to , high- pressure washdown systems using non -potable water (canal water) , potable water supply, prefabricated concrete operations/equipment building at the North Relief Canal and at the South Relief Canal , etc . The influent flow rate shall be measured (totalized and instantaneous flow measurements ) and recorded . Similarly, the flows into each vortex unit shall be measured (totalized and instantaneous flow measurements ) and recorded . Systems shall be designed for automatic and manual operation . Design a solids removal system that automatically and continuously removes the debris captured by the climber screens and one that also removes and dewaters the settled , suspended , and floating material captured by the vortex units . The treatment system shall include equipment to weigh the material collected at each pollution control facility. At the Main Relief Canal , an architect shall design and permit an Operations Building that shall contain three offices , secretarial space , one or more bathrooms as required by code , and equipment storage and laboratory / work area space . The COUNTY will provide the architect with a draft floor plan of the building . 2 . Construction Drawings - (See "Attachment 2" for Construction Drawing requirements . ) 3 . Review Technical Specifications prepared by the COUNTY — The COUNTY will prepare the technical specifications listed in Attachment 3 . Review these technical specifications with respect to this Work Order and provide written comments . 4 . Other Required Technical Specifications — Prepare all other Technical Specifications necessary for the Contractor to properly bid and construct the project . May 3, 2004.doc 6 sections from Divisions 2 through 16 , inclusive , using the Construction Specification Institute (CSI ) format . Submit the Technical Specifications with the 75 percent review submittal . Provide the COUNTY with one hardcopy of all specifications for review by the COUNTY and Malcolm Pirnie , Inc . Technical Specifications type shall meet the following criteria : ( 1 ) Microsoft Word Format (2 ) Arial font , size 12 ( 3 ) Full justification (4 ) Follow the layout per an example provided by the COUNTY. After the COUNTY has approved the Technical Specifications , provide the COUNTY with one hard copy of the Technical Specifications , and with one electronic copy on 3 . 5-inch disks or CD . 5 . Bid Quantities - On or before the tenth day after the COUNTY approves the ENGINEER' s final construction design/drawing submittal , prepare and submit bid quantities to the COUNTY . Provide the COUNTY with one hardcopy and one electronic copy on a 3 . 5-inch disk or CD . The bid quantities shall be in the following format: a . Microsoft Word ( not Excel ) b . Arial font, size 12 c . Tabulation format : ITEM No . DESCRIPTION IQUANTITY UNIT 6 . Opinion of Probable Construction Cost - On or before the tenth day after the COUNTY approves the ENGINEER' S final construction design submittal , prepare and submit an Engineer' s Opinion of Final Construction Cost to the COUNTY . Provide the COUNTY with one hardcopy, and one electronic copy on a 3 . 5- inch disk or CD . The Opinion of Final Construction Cost shall be in the following format: ( 1 ) Microsoft Excel (2 ) Arial font , size 12 3 Tabulation format : ITEM No , DESCRIPTION QUANTITY UNIT JUNIT TOTAL PRICE AMOUNT 7 , Permit Applications and Responses to Agency Questions — Assist the COUNTY in applying for the following permits : ( 1 ) U . S . Army Corps of Engineers permits ; (2 ) U . S . Coast Guard permits ( if necessary) ; (3 ) SJRWMD Environmental Resource permits , (4 ) Driveway permits from FDOT for connection to U . S . Highway 1 for the North Relief Canal Structure , ( 5 ) Driveway permits from the COUNTY for connection to Old Dixie Highway for the North and South Relief Canal Structures , ( 6 ) Indian River Farms Water Control District Permits , and ( 7 ) the City of Vero Beach Site Plan FAPublic Works\KeithM\Stonnwater Projects\East IRC\Contracts\Consultant Contract with Carter & Associates\Work Order No. 5 - Final Design of Vortex System\Work Order #5 - Rev. May 3 , 2004.doc 7 permit subject to the items listed on Attachment No . 4 . Prepare all necessary sketches , calculations , permit application drawings , and complete all permit application forms . Coordinate with equipment suppliers as necessary regarding permit application information pertinent to their equipment and as it relates to this project. Schedule and attend a pre-design meeting (s ) with permitting agencies . Attend other meetings with permitting agencies as necessary. Reply in writing , to all permitting agency' s requests for additional information for each permit application . Document all meetings , conversations , etc, with permitting agencies . Provide the COUNTY with copies of all permit applications and responses to the agency' s requests for additional information , including attachments , and all related correspondence . COUNTY shall pay all permit application fees . 8 . Project Meetings The following meetings are included in the basic lump sum compensation : a . Thirty percent Design Review Meeting with the COUNTY and Malcolm Pirnie , Inc . b . Fifty percent Design Review Meeting with the COUNTY . c . Seventy-five percent Design Review Meeting with the COUNTY and Malcolm Pirnie , Inc. Malcolm Pirnie , Inc . ( MPI ) will provide a constructability and value engineering review of the 75 percent completion submittal ( includes Technical Specifications and Construction Drawings ) . During this meeting , we will discuss the COUNTY and MPI comments and recommendations . d . Ninety percent Design Review Meeting with the COUNTY . e . Pre- Bid Meeting - Schedule and moderate a pre- bid meeting . Respond in writing to all questions raised at the meeting and forward the written responses to the COUNTY and all official project plan holders . f. Permit pre-application meetings , information gathering meetings , and similar meetings necessary to design the projects . Submit design review material to the COUNTY prior to Design Review Meetings . Revise drawings and specifications as requested bythe COUNTY after each design review submittal . The Pre- Construction meeting and all other formal meetings not listed above and that are requested by the COUNTY in writing shall be at the hourly rates set forth herein . Respond in writing to all questions raised at the Pre- Construction Meeting and forward the written responses to the COUNTY , who will transmit them to the Contractor. ,,, 9 , Coordination With Other Professionals — Secure , schedule , and coordinate other professional services necessary to provide a complete FAPublic Works\KeithM\Stortnwater Projects\East IRC\Contracts\Consultant Contract with Carter & Associates\Work Order No. 5 - Final Design of Vortex System\Work Order #5 - Rev. May 3 , 2004.doc 8 design for bidding and construction . Anticipated professional services include , but may not be limited to , geotechnical engineering services , structural engineering services , and electrical engineering services . 10 . Assistance During Bidding — During the bidding process , provide the COUNTY with all necessary bidding assistance related to any Work Product provided by the ENGINEER , including but not limited to , technical and constructability issues . Respond to all bidder' s questions in writing and copy the COUNTY . 11 . Bid Analysis and Recommendation of Award — When bids are received , analyze each bid for completeness , compliance with the contract requirements , mathematical errors , references , financial data provided by bidder, and other pertinent topics , and recommend in writing to the COUNTY , the bidder with whom the COUNTY should enter into a construction contract . 12 . Construction Services — During construction , provide construction services as requested in writing by the COUNTY at the hourly rates set forth herein . 13 . Project Close -Out Services- At the end of construction , provide project close-out services as requested in writing by the COUNTY at the hourly rates set forth herein . 14 . Operation and Maintenance Manual — Coordinate with the various suppliers and prepare a detailed Operation and Maintenance Manual for each facility. SECTION IV = TIME FOR COMPLETION Upon receipt of the COUNTY' s . written authorization to proceed , one hundred and twenty ( 120 ) calendar days shall be allowed for delivery of the construction drawings and permit applications for submittal to the various federal , state , and local permitting agencies (approximately 75 % completion ) . The final construction drawings , specifications , and bid documents shall be ready for bidding by the issuance date of the permits , or thirty days after receipt of the COUNTY' s 75 % review comments , whichever occurs last . SECTION V - COMPENSATION The COUNTY agrees to pay , and the ENGINEER agrees to accept , a fee for services rendered according to the " Scope of Services Provided by the ENGINEER , " identified in Section III of this WORK ORDER , in the amount of $494 , 995 . The following certification language shall be added at the end of each monthly invoice form : " ENGINEER' S CERTIFICATION : THE UNDERSIGNED ENGINEER' S REPRESENTATIVE CERTIFIES that 1 have checked and verified this Application for Payment No . and that to the best of my knowledge and belief, it is a true and correct statement of work performed and/or material supplied by the ENGINEER ; that all work and/or materials included in the Application for Payment have been inspected by me and/or by my duly authorized representative or assistants ; that it has been performed and/or supplied in full accordance with the requirements of the referenced Contract and with sound engineering practice and judgment; and that the payment amount claimed and requested by the ENGINEER is correctly computed on the basis of work performed and/or materials supplied to date . THE UNDERSIGNED ENGINEER' S REPRESENTATIVE ALSO CERTIFIES that all previous progress payments received from the COUNTY on account of Work done under the Contract referred to above have been applied on account to discharge ENGINEER' s legitimate obligations incurred in connection with Work covered by prior Applications for Payment numbered 1 through inclusive ; and if this is a Final Pay Request, I further certify that all persons doing work upon or furnishing materials or supplies for this project under this foregoing Contract have been paid in full . May 3 , 2004.doc 11 The COUNTY shall make monthly partial payments to the ENGINEER for all authorized work pertaining directly to this project performed during the previous calendar month . The ENGINEER shall prepare a monthly invoice form forthe COUNTY' s approval . Use the approved form to submit all Project invoices . The ENGINEER shall submit invoices monthly for services performed and expenses incurred pursuant to this Agreement during the prior month . The ENGINEER shall submit duly certified invoices in duplicate to the Director of the Public Works Department . For lump sum line items , the amount submitted shall be the prorated amount due for all work performed to date under this phase , determined by applying the percentage of the work completed as certified by the ENGINEER , to the total due for this phase of the work . For time and material line items , the amount submitted shall be based on the actual hours worked and expenses incurred for the billing period . The amount of the partial payment due the ENGINEER for the work performed to date under these phases shall be an amount calculated in accordance with the previous paragraph , less ten percent ( 10 % ) of the invoice amount thus determined , which shall be withheld by the COUNTY as retainage , and less previous payments . Per F . S . 218 . 74 (2 ) , the COUNTY will pay approved invoices on or before the forty-fifth day afterthe COUNTY receives the ENGINEER' s invoice . Per F . S . 218 . 74 (2 ) , the ten percent ( 10 % ) retainage withheld shall be paid in full to the ENGINEER by the COUNTY , on or before the forty-fifth day after the date of final acceptance of the Work by the Public Works Director, The Agreement is broken into deliverable units . No payment shall be made unless the Public Works Director has received and approved the work products required underthe "Scope of Services Provided by the ENGINEER , " herein . SECTION VIII = VENUE Venue for any lawsuit brought by either party against the other party or otherwise arising out of this Contract shall be in Indian River County, Florida , or, in the event of a federal jurisdiction , in the United States District Court for the Southern District of Florida .
