D . B . G . Contract #03DB - 1A- 10-40-01 - H12 Dear Mr. Howard ; Please find attached , three ( 3 ) original , executed modification forms to extend the current grant ending date from January 28 , 2005 to July 28 , 2005 . Currently two (2 ) homes are complete . Ten ( 10 ) homes are under construction , five ( 5 ) of which are near completion and we are waiting for final paperwork from the contractor . Also , four (4 ) replacement units are in the permitting process . The ten ( 10 ) homes under construction were under construction in September when Hurricanes Frances and Jeanne made direct hits to the area . All ten ( 10) of the homes were damaged , of which five ( 5 ) were damaged heavily . All five ( 5 ) are still waiting for final claim amounts from their insurance carriers . The contractors were unable to continue with construction until insurance issues are settled . Also with power outages for extended periods and shortage of available construction materials , construction has been delayed . WHEREAS the Department and the Recipient have entered into the Agreement, pursuant to which the Department provided a grant to Recipient under the Small Cities Community Development Block Grant (" CDBG ") Program of $750 , 000 . 00 ; and WHEREAS the Department and the Recipient desire to modify the Agreement by extending the proj ct' s completion deadline date . NOW, THE EFORE , in consideration of the mutual promises of the parties contained herein , the parties gree as follows : 1 . The term o the Agreement is extended so that its termination date is now July 28 , 2005 for al intents and purposes . 2 . The Scope f Work to this Agreement, is hereby modified as set forth in the Revised Activity Wok Plan , which is attached hereto and incorporated herein by reference . 3 . The Department and Recipient agree that the Agreement shall henceforth be governed by the provisions of Rule Chapter 913-43 , Florida Administrative Code , as modified and effective March 28 , 2002 . 4 . All provisions of the Agreement being modified and any attachments thereto in conflict with this Modification shall be and are hereby changed to conform with this Modification , effective as ' of the date of the execution of this Modification by both parties . 5 . All provisions not in conflict with this Modification remain in full force and effect, and are to be performed at the level specified in the Agreement .
