RE : Indian River County , Modification to Work Plan Request Number Two (#2 )

Dear Mr. Howard ;
Please find attached , three ( 3 ) original , executed modification forms to extend the
current grant ending date from January 28 , 2005 to July 28 , 2005 .
Currently two (2 ) homes are complete . Ten ( 10 ) homes are under construction , five ( 5 )
of which are near completion and we are waiting for final paperwork from the contractor .
Also , four (4 ) replacement units are in the permitting process .
The ten ( 10 ) homes under construction were under construction in September when
Hurricanes Frances and Jeanne made direct hits to the area . All ten ( 10) of the homes
were damaged , of which five ( 5 ) were damaged heavily . All five ( 5 ) are still waiting for
final claim amounts from their insurance carriers . The contractors were unable to
continue with construction until insurance issues are settled . Also with power outages
for extended periods and shortage of available construction materials , construction has
been delayed .
This six (6 ) months time extension will allow sufficient time to complete construction on
the original sixteen ( 16 ) homes , prepare and submit an amendment to increase the total
number of homes addressed and complete construction of the additional homes .

MODIFICATION TO GRANT AGREEMENT BETWEEN
THE DEPARTMENT OF COMMUNITY AFFAIRS AND
INDIAN RIVER COUNTY
MODIFICATION NUMBER #2
This Modification is made and entered into by and between the State of Florida ,
Department of Community Affairs , ("the Department") , and Indian River County , (" Recipient") ,
to modify DCA Contract Number 03DB -1A- 1040 =01 = H12 , dated January 29 , 2003 , ("the
Agreement") .
WHEREAS the Department and the Recipient have entered into the Agreement,
pursuant to which the Department provided a grant to Recipient under the Small Cities
Community Development Block Grant (" CDBG ") Program of $750 , 000 . 00 ; and
WHEREAS the Department and the Recipient desire to modify the Agreement by
extending the proj ct' s completion deadline date .
NOW, THE EFORE , in consideration of the mutual promises of the parties contained
herein , the parties gree as follows :
1 . The term o the Agreement is extended so that its termination date is now July 28 ,
2005 for al intents and purposes .
2 . The Scope f Work to this Agreement, is hereby modified as set forth in the Revised
Activity Wok Plan , which is attached hereto and incorporated herein by reference .
3 . The Department and Recipient agree that the Agreement shall henceforth be governed
by the provisions of Rule Chapter 913-43 , Florida Administrative Code , as modified and
effective March 28 , 2002 .
4 . All provisions of the Agreement being modified and any attachments thereto in conflict
with this Modification shall be and are hereby changed to conform with this Modification ,
effective as ' of the date of the execution of this Modification by both parties .
5 . All provisions not in conflict with this Modification remain in full force and effect, and are
to be performed at the level specified in the Agreement .
IN WITNESS WHEREOF , the parties hereto have executed this document as of the
dates set out herein .

Reinstatement and Extension
Dear Chairman Neuberger :
Your letter,, received December 14 , 2004 , requesting a six-month time extension has been
reviewed by staff. Given that this project was directly affected by Hurricanes Jeanne and Frances, the
fact that there have been no prior modifications to this agreement and the status of Indian River ' s
accomplishments On this project, the Department agrees that an extension to your contract will allow the
opportunity for your project ' s completion . As you are aware , this grant contract was originally executed
on January 29 , 2005 and I must strongly emphasize that Indian River County proceed expeditiously and
complete this project Nvitliln the next Six -n1Ot1t11S .
The enclosed modification reflects a new grant termination date of July 28 , 2005 . This
modification alongwith your request and revised Activity Work Plans have been made part of the
