M. Tuesday, December 2, 1955. present were Donald Macdonald, D. B. McCullers, Jr., Robert W. Graves and J. J. P. Hamilton. Absent was W. C. Graves, Jr. Also present were Ed Schmucker, County Engineer, Sherman N. Smith Jr., Attorney and Katherine Morrison, Deputy Clerk. The Chairman asked if there were any changes or additions to be made to the minutes of November 4th and November 5th. There were none, and upon Motion made by Commissioner Robert Graves, seconded by Commissioner McCullers and unanimously carried, the minutes were approved as read. The County Attorney read an appraisal from Mr. Jewett on the Hewitt property which had been offered to the County for $20,000.00. The Jewett Appraisal Company appraised these two lots at $12,000.00. After some discussion in the matter the Board asked Mr. Norman if he would accept $15,000.00, and he said no that they had the property up for sale at $25,000.00 and they had already come down $5,000.00 and would not sell for less than the $20,000.00. The Board decided that they were unable to purchase the Hewitt property for $20,000.00. The Chairman asked the County Engineer if he had estimated the cost of putting a parking lot in Lang -,wick S/D as requested at the meeting of November 4th. Mr. Schmucker sta ted he had estimated that it would cost the County around $1300.00. After some discussion and ,,upon Motion by Robert Graves, seconded by Commissioner Hamilton and carried, the Board decided Ito table this matter until a further study could be made as to the need for a public parking ! lot in this area. Mr. Schmucker stated he had been contacted by Mr. Denny R. Hendry, representing ;the Roseland Gardens Community Church, and stated that he had received a tax bill for some land which he had sold to the church and asked if the Board would adjust this bill. Upon s� 'Motion made by Commissioner Robert Graves, seconded by Commissioner McCullers and unanimously Ncarried, the Board agreed to pay the amount of the tax bill (which is $54.31) for the additio R+right of way that the county needs for Roseland Road. • Homer Fletcher, Tax Assessor appeared before the Board and requested permission to N kuadjust the valuation and extended tax on the following described property on the 1955 tax roll Fd 1 and for the following reasons I� - Z/ S" I �^ Wade C. Upon Motion made by Commissioner Hamilton, seconded by Commissioner McCullers, and unanimously carried, permission was granted to adjust the valuation on said lots. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner McCullers, and unanimously carried, the following Resolution was adopted: R E S O L U T I O N -- Permit to construct and maintain �! Natural Gas Pipelines under, over, etc. County roads BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, that Houston Texas Gas and Oil Corporation, a Delaware corporation, its successors and assigns;, be hereby given and granted a permit granting the rights to construct, reconstruct, enlarge,i maintain and operate natural gas pipelines, hereinafter called Facility, together with the l necessary appurtenances under, on, over, across and along all county roads, streets, highways and road and drainage easements, subject to the following conditions: 1. The Licensee shall prevent the creation of any obstructions or conditions which are or may become dangerous to the traveling public. 2. The Licensee shall repair any damage or injuries to the roads, streets, highways �k and easements occasioned by reason of the exercise of the privileges granted by this Resolution and to repair said roads, streets and easements promptly restoring the k same to a condition at least equal to that which existed immediately prior to the infliction of such damage or injury. 3. The Licensee shall hold the Board of County Commissioners of Indian River County, Florida and the members thereof harmless from the payment of any compensation or damages resulting from the exercise of the privileges of this Resolution. 4. The Licensee shall comply with those reasonably necessary rales and regulations pro- mulgated for the protection of the County and public by the Board of County Comm- issioners of Indian River County, Florida, enacted both before and after the granting of the privileges herein. 5. Whenever necessary in the opinion of the Board of County Commissioners for the construction, widening, repair, improvement, alteration or relocation of all or any portion of said highway or highways as determined by the Board of County Commissioner, the facility and the appurtenances thereto as authorized hereunder shall be imme- diately removed from said highway or reset or relocated thereon as required by the !I I� 'R I� 0 1 1 A L. 1 1 0 I 1 0 1 1 E Board of County Commissioners and at the e9pense of the holder; PROVIDED, HOWEVER, in the event the relocation or removal of the pipeline facility constructed pursuant thereto should be required by reason of the construction of the Federal Interstate System of Highways under such circumstances as to bring such removal or relocation yith the coverage of Section III of Federal Aid Highway.Act of 1956, being Public Law 627 of the 84th Congress, any amend- ment or reinactment thereof, providing for the payment of the cost of such removal or re- location from public funds, then, in such event, Houston Texas Gas and Oil Corporation, or its assigns, upon complying with all terms and conditions of the law and of rules and regu- lations adopted pursuant thereto, shall be entitled to receive reimbursement of the cost of such removal or relocation of such pipeline facility. 6. The Licensee shall file a written acceptance of the terms of this Resolution within thirty (30) days with the Board of County Commissioners stating that it will comply with the conditions stated herein. 7. The failure of the Licensee to file a written acceptance within thirty (30) days as provided for above, shall render this Resolution null and void and of no legal effect. S. No assignment, transfer or pledge by said Licensee of the rights granted hereunder to any mortgagee or mortgage trustee shall obligate such m�rtgagee or mortgage trustee to perform any obligation contained herein, but the Licensee 'shall remain obligated to perform the terms and conditions hereof. Stephens, Director of the Bureau of Local Health Services appeared before) the Board and stated that Brevard County has grown so large that they wish to become an independent Health Unit. Heretofore they have been a two -county Unit with Osceola County. Dr. Stephens suggests that Indian River County and Osceola County form a two -county Unit. He stated he was going to visit each of the other counties involved and we could let him know later what we thought about join�,ng Osceola County as a two -county Unit. Earman, Director of Civil Defense for Indian River County sta ting that he and Mr. Macdonald had attended a meeting for Civil Defense Directors and County Commissioners in Orlando, at which meeting they had adopted a resolution'; and had been requested to have the same resolution adopted by the local Commissioners. Upon ;t Motion made by Commissioner McCullers, seconded by Commissioner Robert Graves and unanimously+ carried, the following Resolution was adopted: , RESOLUTION -- Civil Defense WHEREAS, a conflict of interests between Nations of opposing idiologies threatens daily to precipitate World War III, and WHEREAS, attack upon the continental United States in the event of open warfare may be reasonably anticipated, and WHEREAS, the presence of remunerative targets within the State of Florida indicate the likelihood of nuclear attacks upon this State in event of war, and WHEREAS, isolation of areas through disruption of transport and communications, or because of radiological contamination or other causes may be reasonably anticipated, and WHEREAS. the threat of such isolation indicates the need for creating authorities pro -tem for the coordination of survival efforts between counties of the isolated area, and to exercise emergency governmental powers during the interim, and WHEREAS, THE Florida Civil Defense Council has promulgated a plan anticipating the creation of Civil Defense Operational Area Authorities intended to function following enemy attack, and i WHEREAS, creation of such emergency authority is dependent upon ratification of said plan by the several counties, and designation of a County Commissioner by each county 1 to become a member of said authority, NOW) THEREFORE, BE IT RESOLVED by the Board of County Commissioners in regular session assembled, the County of Indian River shall, and it does hereby confirm and ratify �i the creation of the said Civil Defense Operation Area Authority for the area in which Indian River County is located, and in furtherance of this action designates and directs the Chairman of this Board to.serve as a member of said authority. Copy and original of the Annual Financial Report of the Board of County Commissioners i PP of Indian River County ending September 30, 1955 was approved and copy of the same trans- ji mitted to the State Comptroller as provided by law. Mrs. Anne Christensen, County Welfare Case Worker gave her report for the month of November and same was ordered filed. The County Engineer stated he had sent the plans for the Old Folk's Home to the State Welfare Office in Jacksonville for approval as a nursing home. Upon Motion made by Commissioner Robert Graves, seconded by Commissioner Hamilton i and carried, the County Engineer was authorized to advertise for a dragline. i it ij y 1 11 1 0 1 1 The Attorney for the Board, Sherman N. Smith, Jr. stated he had received word from the Florida East Coast Railway Company that they were opposed to a crossing at 16th Street, however, he had contacted the State Road Department with regard to the matter. Upon Motion made by Commissioner Hamilton, seconded by Commissioner McCullers and carried, the Board decided they would take no further action on this matter until the next regular meeting. Homer Fletcher, Tax Assessor appeared before the Board and requested that he be allowed to buy a new Addressograph machine from his Fee Account. He further stated that Troy Moody, Tax Collector, would help to buy this equipment if it was OK'ed by the Commissioned Upon Motion made by Commissioner Hamilton, seconded by Commissioner McCullers and carried, the Board granted Mr. Fletcher permission to buy this needed equipment from his fee account. The following Notary Public Bonds in the amount of $500.00 each were approved by Douglas Baker, Clerk as authorized by law. John H. Sutherland w/ American Surety Co. of N. Y. as surety. Stanley B. Wood w/ American Fire & Casualty Co. as surety. Barbara S. Eglin w/ American Fire & Casualty Co. as surety. Lloyd A. Jones w/ American Fire & Casualty Co. as surety. K. H. Harman w/ St. Paul Fire & Marine Ins. Co. as surety. The several bills and accounts against the County, having been audited were examined] and found correct, were approved and warrants issued in settlement of same. Such bills and' accounts being on file in the office of the Clerk of the Circuit Court, the Warrants so issued Brom the respective funds being listed in the Supplemental Minute Book as providedby the rules of the State Auditor, reference to such record and the list so recorded being made a part of these minutes. The county depositories filed their monthly statement, showing receipts and dis- bursements of the various funds, which have been audited, were found to be correct. There being no further business on motion, made, seconded and carried, the Board then adjourned.
