Upon Motion made by Commissioner McCullers, seconded by Commissioner Hamilton and
unanimously carried, the following Public Official Bonds were approved: ;I
County Commissioners Bond in the amount of $2,000.00 for J. J. P. Hamilton with
St. Paul Fire & Marine Insurance Company as surety.
County Commissioners Bond in the amount of $2,000.00 for Horace H. Gifford with Fidelity
and Casualty Company of New York as surety.
County Judge's Bond in the amount of $2,000.00 for Miles B. Mank,, II, with Fidelity
& Casualty Company of New York as surety.
There being no further business upon Motion made, seconded and carried; the Board
then adjourned.

The Board of County Commissioners of Indian River County, met at the Courthouse,
Vero Beach, Florida in a regular meeting held at 9:00 o'clock A. M., Tuesday, January 6, 1959.!
Present were Donald Macdonald, D. B. McCullers, Jr., Robert W. Graves and J. J. P. Hamilton.
Absent was W. C. Graves, Jr. Also present were Ed Schmucker, County Engineer, Sherman N.
Smith, Jr., Attorney, Horace.H. Gifford, our new Commissioner from District #4 and Katherine
Morrison, Deputy Clerk.
The Chairman asked if there were any changes or additions to be made to the minutes
of December 2nd and December 10th. There were none and upon Motion made by Commissioner Robert,
Graves, seconded by Commissioner Hamilton and unanimously carried, the minutes were approved
as read.
The Chairman Donald Macdonald tendered his resignation as Chairman of the Board and
turned the Chair over to Sherman N. Smith, Jr., Attorney for the Board.
Horace H. Gifford presented his Commission issued by the Governor of the State, as
a member of the Board of County Commissioners of Indian River County, and said Horace H.
Gifford was received as a member of this Board. J. J. P. Hamilton presented his Commission
from the Governor of the State of Florida as a member of the Board of County Commissioners
of Indian River County and continued his seat as a member of this Board.
The Acting Chairman, Sherman N. Smith, Jr. stated the first order of business is
election of a Chairman and called for nomination. Robert W. Graves was nominated by D. B.
McCullers, Jr., seconded by Donald Macdonald, and there being no further nominations, Robert
W. Graves was unanimously elected as Chairman of this Board for the ensuing year.
Attorney Smith then turned the meeting over to Chairman Robert W. Graves, who asked

asked for nominations for Vice -Chairman. D. B. McCullers, Jr. was nominated by Mr. Hamilton,
Donald Macdonald seconded the nomination and there being no further nominations, D. B. McCulley ,
Jr. was unanimously elected as Vice Chairman for the ensuing year.
It was moved by Commissioner Hamilton, seconded by Commissioner McCullers and un-
animously carried, that the following county employees be re-employed for the ensuing year:
Sherman N. Smith, Jr., Attorney for the Board; Anne Christensen, County Welfare Case Worker;
James E. Roberts, County Service Officer; Edwin S. Schmucker, Jr., County Engineer; Forrest N.
McCullars, County Agent; L. C. Royal, Janitor.

The various bids were then turned over to the County Engineer to tabulate and report
lback later to the Board.
Mr. Kunkel, Post Commander of the American Legion Post. for Indian River County,
appeared before the Board and stated they were going to put out some advertising for Indian

River County and would like a donation from the Board to help pay for the advertising. The
Board informed Mr. Kunkel that they were prohibited by law from making donations of this type.
The Board further stated they would write them a letter extending thanks and commendation for
their foresight in assembling and publishing a history of Indian River County
Roland Miller appeared before the Board and requested the County pay for one-half
the cost of Beachcomber Lane, which is a County right of way. He stated that he had contactedf

Swords & Sons Asphalt Co. and they would do the work for $1400.00. He further stated that
the road would be built to county specifications. Upon motion made by Commissioner Hamilton,
seconded by Commissioner Macdonald and unanimously carried, the Board agreed to pay one-half w
the cost of this road, or $700.00 and requested the County Engineer to see that the work was'
done to County specifications.

All that property which lies within 150 feet East of the centerline
of the Old Dixie Highway and extending from 12th Street South to
and including the parcel of property described as follows:

All within the meaning and intent and as set forth and described in said Zoning
Resolution.
Two Petitions were received - one from a Committee representing property owners of
Rockridge Subdivision and one from the property owners of Rockridge Subdivision lying from
16th Street South and from 6th Avenue East, opposing the operation of any private water
supply to serve said community. Mr. C. A. Smith representing said property owners, spoke
to the Board giving their reasons, etc. for opposing a private water supply. The Board
informed Mr. Smith and the others present that at this time the County had no authority for
the granting of franchises for water plants or other public works and that a special act of
legislature would have to be passed, but they do have the power and authority to grant ease-
ments and franchises in, upon and across County roads in Indian River County.
Sherman N. Smith, 'Jr., County Attorney had prepared a Resolution which he read to
the Board and others present, for the granting of easements and franchises over, in,Empon
and across County Roads. After some further discussion, upon Motion made by Commissioner
Ma cdonald, seconded by Commissioner McCullers and unanimously carried, the following Resolu-
tion was adopted:
R E S 0 L U TI 0 N -- Granting of Easements over, in
— and across County Roads.
WHEREAS, the Board of County Commissioners of Indian River County, Florida, is
vested by law with the power and authority to grant easements, and franchises over, in, upon
and across the County roads in Indian River County, Florida, for the maintenance of pipes,
poles and lines for the transmission and distribution of water, gas, electric power and for
telephone and telegraph purposes under such concitions and with such limitations as said
Board may in its discretion impose; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida,
that this Board does herewith declare that there shall not hereafter be placed over, in and
upon and across any County road in Indian River County, Florida, any pipes, poles or lines
for the transmission and distribution of water, gas, electric power, telephone or telegraph
purposes nor for any other similar use or purpose unless and until an .ea sement or franchise
has been issued as provided by this Resolution. Any person, firm or corporation desiring to
make such use of the County roads in Indian River County, Florida, shall make application for

an easement therefor to the County Engineer. Said application shall be in writing, shall
specify the facility which the applicant desires to place Aver, in, upon or across the
public roads and shall specify the particular location thereof, the manner of construction
thereof and such other detailed information as shall be required by the County Engineer.
Should the County Engineer determine that the proposed facility will not violate any of the
terms and conditions of this Resolution, then the County Engineer is herewith authorized and
instructed to issue a permit in the name of the County, permitting the construction, recon-
struction, maintenance and operation of the facility over, across and along all County roads

as _'_specified in the permit; provided, however, that the County Engineer shall determine:
1. That the granting of said permit will not create any obstructions or conditions i;
which are or may become dangerous to the traveling public.
2. That the holder of the permit shall repair any damage or injury to the County
roads occasioned by the exercise of the privilege granted and that the holder of the permit
will repair any such damage or injury promptly, restoring the same to a condition at least
equal to that which existed immediately prior to such damage or injury.
3. That the holder of such permit shall hold Indian River County, Florida, its
Board of County Commissioners and the members thereof harmless ffom the payment of any compen-
sation or damages resulting from the exercise of the privilege granted by the permit.
4. That the holder of the permit shall comply with all those reasonably necessary
rules and regulations promulgated for the protection of said County and public by its Board
of County Commissioners whether enacted before or after the granting of said permit.
5. That the holder of said permit will whenever necessary in the opinion of the
Board of County Commissioners for the construction, widening, repair, improvement, alteration
or relocation of all or any portion of said roads as determined by the Board of County
Commissioners, that then promptly upon notice and demand, the holder of such permit will
immediately remove from said highway or reset or relocate any or all of such facilities, all
of the expense of the holder of such permit and as required by the Board of County Commissioners;
provided, however, in the event the relocation or removal thereof shall be required by reason
of the construction of the Federal interstate System of Highways under such circumstances as
to bring such removal or relocation within the coverage of Section 3 of the Federal Aid
Highway Act of 1956, being Public Law 627 of the 34th Congress or any amendment or reenactment
thereof providing for the payment of the cost of such removal or relocation from public funds,
then in such event the holder of such permit, upon complying with all terms and conditions of
the law and all rules and regulations adopted pursuant thereto, shall be entitled to receive
reimbursement of the cost of such removal or relocation.
6. That the holder of such a permit shall file a written acceptance of the: -'terms
hereof within 30 days from the granting of such permit, stating that it will comply with the
conditions thereof and such permit shall not become effective until the receipt by the County
Engineer of such written acceptance and if such written acceptance is. not so received within
the time provided, then the permit shall become null and void and of no legal effect.

7. No assignment, transfer or pledge by the holder of the permit of the rights grant!d

Trustee to perform the obligations of such permit unless and until the mortgagee or mortgage !�

The Commissioners decided they would have two meetings a month, being the first and d
third Tuesdays of each month instead of one.
The County Engineer stated he had tabulated all bids for a new dragline, bucket and I�
pile driving equipment, and further stated that since so little was offered for the old drag-'
line as a trade-in that the Board keep the old dragline and put it -out at one of the marl pits.,,
Low bidder for the dragline was Northwest Engineering Co. at a price of $25,240.00 -
this without trade-in. Upon Motion made by Commissioner Hamilton, seconded by Commissioner
McCullers and unanimously carried, the bid by Northwest Engineering Co. was accepted, further
stating that the County would retain the old equipment.

II There were two low bidders on the Pile -driving equipment, according to our specifications.,
One was Adams Construction Co. and the other was Florida Equipment Co. The representative for
Florida Equipment Co. said to let Adams have the bid, so upon Motion made by Commissioner
Macdonald, seconded by Commissioner McCullers and unanimously carried, the bid by Adams
Construction Co. of $1800.00 for the pile -driving equipment was O.K.ed.
Mrs. V. L. Whittier appeared before the Board and stated that the County had won
their suit to have the Blue Cypress Road opened and the Surrency's were to remove the gate but
they had not as yet done so. The Board informed Mrs. Whittier that Mrs. Surrency had 60 days
in which to comply with the Court Order or to appeal to a higher court and that they would
take no action until the 60 day period was up.
Mrs. Anne Christensen, County Welfare Case Worker appeared before the Board and gave
a report of her activities for the month of December, said report was ordered filed.
The County Engineer stated that he had gone to Jacksonville on Friday and consulted
with the State Board of Health with regard to our plans for a Nursing and Old Folk's Home,
and that the State Board of Health and turned down our plans. Chairman Graves stated that the

the Board hold a joint meeting with the members of the Hospital Board. He further stated that

County Attorney to proceed with the legal details contemplating the issuance and validation
of County Bonds for a public County Hospital in the amount of $750,000.00 as approved by the
free -holders of the County.
A Petition was received from the residents and property owners of Block H. Rockridge
S/D for the necessary action to secure proper drainage for their property. This matter was
turned over to the County Engineer to see whether or not the County right of way was being
affected.

Mr. Homer Fletcher, Tax Assessor appeared before the Board and stated that the

owner of Lot 12, Block P, Rockridge Subdivision had requested an adjustment of tax but that

that the piece of land we were trying to obtain for a colored beach from the Government was

The County Engineer showed the Board on the right of way map for U.S. #1 from Vero
Beach to Wabasso, the proposed cross streets abutting into the right of way and the several
changes he had made. The Board agreed to the changes and asked him to so inform the State 1'

R E S O L U T I O N -- Amend Regulations of S/D of Land.
BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida,
that the resolution heretofore adopted by this Board regulating the subdivision of lands in
Indian River County, Florida, be and the same is herewith amended by adding thereto the follow-
ing provision, to -wit:
At the intersection of any street with another street, the plat shall provide radial
returns of 25 feet in order that the corner of each block shall be rounded off.
Upon Motion made by Commissioner McCullers, seconded by Commissioner Macdonald and
unanimously carried, the Board tentatively approves the Plat of Ve1Mar Manor without as:park
area for the reason that this is a subdivision consisting of only five acres.
The County Engineer stated that the City of Sebastian had approved a Railroad cross
at 11th street in Sebastian. The Board requested that the County Engineer contact Mr. J. W.
Fox, Florida East Coast Railway Trustee and get his O.K. on this site for a crossing, and also
check to see if they would allow the crossing without lights and gates and if so what would be
their estimate of cost for putting in this crossing.
Upon Motion made by Commissioner Macdonald, seconded by Commissioner Gifford and
unanimously carried, the County approves the request of General Development Corporation for
a proposed public road from U. S. #1 Highway across the right of way of the Florida East Coast
Railway as set forth on the present survey prepared by Lloyd and Associates dated December 10,
1958, more particularly described as 3125 South of Mile Post 216 in Sec. 17, Twp. 31 S. Range
39 East, with the provision that this right of way be 80 feet throughout and authorizes the
paving of the public cross-over by agreement between the County and the Railroad provided
General Development Corporation deposit with the Railroad its estimate of cost including
d;signal lights and gates with the understanding that the entire cost will be paid by the
General Development Corporation.

was presented and ordered filed with the Clerk.
A letter was received and read from Governor Leroy Collins requesting that the Juveni
Judge be sent by the Board of County Commissioners and his expenses paid by the Board to the
Second Annual Juvenile Judges Institute at Bartow, Florida on January 21 and 22, 195. Upon
(Motion made by Commissioner McCullers, seconded by Commissioner Hamilton and unanimously carried
(the Board authorized the payment of such expense for Miles Mank, II, Juvenile Judge.

The several bills and accounts against the County, having been audited were examined
and found correct, were approved and warrants issued in settlement of same. Such bills and
accounts being on file in the office of the Clerk of the Circuit Court, the Warrants so issued
from the respective funds being listed in the Supplemental Minute Book as provided by the
rules of the State Auditor, reference to such record and the list so recorded being made a part)
of these minutes.
The County depositories filed their monthly statement, showing receipts and dis-
bursements of the various funds, which have been audited, were found to be correct.
