THIS LICENSE AGREEMENT ( " License" ) by and between Kenneth Chesnut whose
address is 8810 44th Avenue , Sebastian , Florida 32958 (" Chesnut" ) and Indian River
County , Florida , a political subdivision of the State of Florida , whose address is 1801 27th
Street , Vero Beach , Florida 32966 ( " County" ) , this 8th day of Septelno (2009 (" Effective
Date" ) , hereby agree as follows :
WHEREAS , Chesnut acquired property located at 4820 41St Street , Vero Beach ,
Florida on January 20 , 2009 ; and
WHEREAS , the County had recently widened and improved 41St Street in front of
Chesnut ' s property ; and
WHEREAS , the parties have discovered that approximately 1 . 7 feet of the front
porch of the residence located at 4820 41St Street encroaches into the County owned right-
of-way for 41St Street ; and
WHEREAS , the parties agree that the encroachment does not create a safety
hazard and does not otherwise interfere with the flow of the pedestrian or vehicular traffic
on 41 St Street ,
NOW , THEREFORE , in consideration of the sum of $ 10 . 00 , receipt of which is
hereby acknowledged , County does hereby grant unto Kenneth Chesnut a License on ,
over , across , and beneath the following described land in Indian River County , to wit ,
Exhibit A , attached hereto and made a part hereof .
1 . This License is for the purpose of allowing the existing porch that encroaches into
the County owned right- of- way to remain in its current location .
2 . This License shall terminate upon destruction or removal of the porch .
3 . Chestnut shall maintain the property subject to this License .
