A special meeting of the Board of County Commissioners was held in the County
Commissioners Room at the Courthouse at 9:00 A. M., July 29th. All members were present.
Also present were Sherman N. Smith, Jr., County Attorney, Ed Schmucker, County Engineer and
Katherine Morrison, Deputy Clerk.
Robert Graves, Chairman stated this meeting was called for the purpose of meeting
Lwith Mr. Singer and Mr. Carlton of the State Road Department to discuss road matters with
them.
Mr. Singer stated he had called this meeting for the express purpose of deciding
(whether or not a draw span which they have taken out of a bridge at Hallandale could be used
in our Wabasso bridge. He furttier stated they had received some opposition from the Wabasso
Civic Club to this span being put in. He pointed out to the Board that this draw span is a
two lane span and electrically pperated, where the one we now have in the bridge is a hand
operated span and only one lane. He further stated that as far as he can see now a completely
knew bridge could not be started for Wabasso for at least another five or six years and it
lwould take two years to build such a bridge. He further stated that at the time of putting
this draw span in they would rebuild the pier and fenders on the old bridge. That the pier
could go out at any time, and the fenders have already gone. He further stated it would
cost $60,343.00 to put this new draw in and rebuild the pier and fenders but he felt the money
would be well spent because of the length of time before a complete new concrete bridge could
be put in. After some discussion in the matter and upon Motion made by Commissioner Mac-
donald and seconded by Commissioner McCullers and unanimously carried,. the Board approved the
installation of the two lane electrically operated swing span State Road Project #88050-3501.
Several other projects were informalljry discussed, after which the meeting adjourned.

Nero Beach, Florida in a regular meeting held at 9:00 o'clock A. M., Tuesday, August 4, 1959.
All members were present. Also present were Sherman N. Smith, Jr., County Attorney, Ed
Schmucker, County Engineer, and Katherine Morrison, Deputy Clerk.
Upon Motion made by Commissioner Hamilton, seconded by Commissioner Waddell and
unanimously carried, the minutes of July 7th, 21, 28 and 29th were approved as read.

The following Resolution was introduced by Commissioner Macdonald, seconded by
Commissioner McCullers and unanimously carried:
WHEREAS, the Board of County Commissioners did receive and examine and tentatively
adopt a proposed budget of excess receipts and their expenditures for the fiscal year ending
September 30, 1959; and,
WHEREAS, this Board did cause a summary statement thereof to be advertised one time
in a newspaper of general circulation published in Indian River County, Florida, to -fit:
In the issue of July 28, 1959 of the Vero Beach Press Journal as will more fully appear by proof
of publication thereof filed in the minutes of this Board; and,
WHEREAS, this Board did meet at the time and place stated in Said advertisement for
the purpose of hearing requests and complaints of the public regarding acid Supplemental
Budget and for the purpose of holding a public hearing and making whatever revisions in the
budget it may deem necessary; Now, therefore,
BE IT FURTHER RESOLVED that the Board of County Commissioners of Indian River Countv4
rida, does herewith tentatively adopt said Supplemental Budget for the fiscal year ending
30, 1959 in the form heretofore tentatively adopted and duly advertised.
BE IT FURTHER RESOLVED that said Supplemental Budget shall be filed in the dffice
the County Auditor as a public record and the Clerk hereof shall transmit two copies of the
Budget as adopted to the Comptroller of the State of Florida and said Supplemental
shall be considered as finally adopted and official upon approval as to form by the

Sam T. Joyce, Sheriff appeared before the Board and stated he had received a bid
for installing electrical equipment for his new radio set up at the jail in the amount of $305.00.
Upon Motion made by
Commissioner Macdonald,
seconded by Commissioner McCullers and unanimously
(carried, the Board
o.k.ed the bid by Frank
Electric Company in the amount of $305.00 and
ordered the Sheriff proceed with the work.
Mr. Wm. E. Orth appeared before the Board and stated that the Board said they
would let him know at this meeting whether or not they would put 12th Avenue through on the Eas S_
side of his property and put in the base and he would pave same according to County specificati*s.
The County Engineer stated he figured 1t would cost the County approximately $2600.00 plus
labor to do the work Mr. Orth would like to have us do. After considerable discussion in the
matter and Upon Motion made by Commissioner Macdonald, seconded by Commissioner Hamilton
and unanimously carried, the Board decided that they not build road at this time with County
Funds.

WHEREAS, this Board did receive and examine said tentative budget for each fund and
did require such changes to be made as the Board did deem necessary and the auditor's estimate
of receipts other than taxes and of balances to be brought forward not having been revised,
this Board did prepare a statement summarizing all of the tentative budgets showing for each
budget in the total of all budgets the proposed tax millages, the balances, the reserves and
the total of each major classification of receipts and expenditures classified according to
the classification of accounts prescribed by the Comptroller of the State of Florida; and,
WHEREAS, this Board did cause said summary statement to be advertised one time in
a newspaper of general circulation published in Indian River County, Florida, to -wit: In the
issue of July 23, 1959, of the Vero Beach Press Journal, as will more fully appear by proof
of publication thereof filed in the minutes of this Board; and,
WHEREAS, this,Board did meet at the time and place stated in said advertisement for
the purpose of hearing requests and complaints from the public regarding the budgets dnd for
the purpose of holding 4(public hedring.and,,making whatever revisions in the budget it may deem)
necessary; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida,
that this Board does herewith tentatively adopt the budgets for the funds of this Board for
the fiscal year beginning October 1, 1959, and ending September 30, 1960, inthe form as
heretofore prepared and duly advertised; and
BE IT FURTHER RESOLVED that the tentative budgets shall be filed in the office of
the County Auditor as a public record and the County Auditor shall transmit forthwith to the
Comptroller of the State of Florida two copies of each of the tentative budgets as adopted,
certified by the Chairman of this Board and by the County Auditor as a true and correct
copy of the budget as adopted by this Board; and,
BE IT FURTHER RESOLVED that said budgets as tentatively adopted by this Board shall
be considered as finally adopted and as official thirty (30) days from the date the budgets
are transmitted to the State Comptroller and no report of exceptions to the budget as filed
Ihas been made by the Comptroller.
A letter was received from the DeKold Real Estate Agency stating that Mrs. Daphne
Strickland withdraws her offer submitted at the July 14th meeting to sell or lease Lots 24, 25,
26 and 27, Block 35, Original Town. Said letter was ordered filed.
The Clerk stated she had received two bids for putting in the sewer line to the
Porhorsky house. One from Dellerman Plumbing Company for $164.00 and one from Ambrose Plumbing
Company in theamount of $245.00. Upon Motion made by (bmmissioner Waddell, seconded by
Commissioner McCullers and unanimously carried, the bid by Dellerman Plumbing Company in the
amount of $164.00 was accepted. The Board also asked the Clerk to notify the persons who had
(asked to rent the house that the rent would be $45.00 per month and that the Board would not
make any repairs whatsoever to the house but would put the sewer line in.
Mr. Robert E. Thompson appeared before the Board and stated he would like to rent
the Porhorsky house and the Board told Mr. Thompson there were two others ahead of him and if
neither one of them wanted the house they would so notify him.
The Board received copies of a City Ordinance which the City of Vero Beach would
like for the Board to adopt a Resolution going along with their ordinance pertaining to
Subdivisbhs adjacent to the City Limits. Upon Motion made by Commissioner McCullers, seconded
by Commissioner Hamilton and unanimously carried, said City Ordinance was tabled until the Boa
members have time to study the Ordinance.
The County Attorney stated that Mr. H. V. Grumbach will convey a right of way
deed to the County through his property for U. S. #1 if the County will put in a sufficient
dyke along the S right of way line of the N. Relief Canal. Upom Motion made by Commissioner
Macdonald, seconded by-icommissioner Waddell and unanimously carried, the Board agreed to the
following:

without cost to the county, Indian River County, acting -by and through
its Board of County Commissioners, herewith agrees as follows:
. In the course;.of, or prior to construction, proper and sufficient
dyking will be installed along the South right of way line of the North
Relief Canal, as said canal right of way: borders on and affects your
property necessary for highway right of ray.
This agreement is approved by the Board of County Commissioners at
its meeting as shown by its minutes.

The Board upon Motion made by Commissioner Macdonald, seconded by Commissioner

of shrubbery and other plantings now on Lot 21, except for providing a new

R E S O L U T I O N
WHEREAS, House Bill No. 2392 was enacted by.the Legislature of the State of Florida
in the 1959 regular session, which said Act changes the boundary line between Brevard County
and Indian River County, Florida, insofar as it pertains to that property lying between the
Indian River and the Atlantic Ocean in order that said boundary line between said counties
shall be the natural and logical location, that is, the centerline of the Sebastian Inlet; and
WHEREAS, the effectiveness of said Act is contingent upon its approval by the
electors of both counties at the special general election to be held on November 3, 1959; Now
therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida,
that this Board does herewith approve and endorse the change of said boundary line as enacted
in said tet and does herewith urge the electors of this County to approve said Act; and
BE IT FURTHER RESOLVED that this Board does herewith announce that upon the change
of boundary line between said counties, it is the intention of this Board to cause State Road
to be paved from its present Northern terminus North of Wabasso, Florida, and continuing in a
general Northerly direction to the Sebastian Inlet and there by bridge over the Sebastian Inlet
to connect into the existing paved State Road AlA on the North side of said Inlet in order
that said State Road AlA may become a valuable arterial highway permitting traffic and commerce
to flow from the Northern part of Brevard County South through Brevard County and through
Indian River County to Fort Pierce, thus permitting the growth, development and expansion of
this entire island area to the benefit of both counties.
The County Attorney stated Mr. Fred Tuerk had tentatively agreed to the following
in return for the County's abandoning Old AIA right of way not presently used for,the new
right of way and abandoning the present Winter Beach Road from the new right of way to the
Beach and abandoning the old Joh's Island Road.
1st. He will give the County a 70 foot right of way from New AlA to the Ocean North
of the present Winter Beach Road on the Section line.
2nd. That if this right of way is ever used as a Beach it should be designated as
Ia public beach for the Winter Beach area.
3rd. Will convey to the County a 70 foot right of way through all the property he
owns which now is known as the Winter Beach Road to the present new AlA right of way.
Upbn Motion made by Commissioner Macdonald, seconded by Commissioner Hamilton and
carried, the Burd approves this tentative agreement as set forth in a memo by the County
Attorney and dated July 22, 1959.

that the rate of taxation necessary to meet the expenditures of the Board of County Commissionei
of Indian River County, Florida, for the fiscal year ending September 30, 1960, pursuant to the
budget of said Board as heretofore published and approved, is as hereinafter levied and that
the tax rate as hereinafter shown and set forth be and it is hereby levied on all taxable
property in Indian River County, Florida, for the.year 1959 with the rate hereinafter set out,
to -wit
1. In order to meet the estimated expenses of the General Fund, it is determined
and hereby declared that a tax rate of Seven and Three -tenths (7.3) mills upon the dollar be
levied and hereby imposed.
2. In order to meet the estimated expenses of the Road and Bridge Fund, it is
determined and hereby declared that a tax rate of Five and five -tenths (5.5) mills upon the
dollar be levied and is hereby imposed.
3. In order -to meet the estimated expenses of the Fine and Forfeiture Fund,
it is determined and hereby declared that a tax rate of Two and nine -tenths (2.9) mills
jupon the dollar be levied and is hereby imposed.
4. In order to provide funds to the Indian River County Public Health Unit, it
is determined and hereby declared that a tau rate of One (1.0) mill upon the dollar be levied,
assessed and is hereby imposed upon all the property lying and being in the County of Indian
River, the proceeds of which when collected shall be paid to the State Treasurer of theState
of Florida for,the account of the State Board of Health of the State of Florida to be expended
by said State Board of Health as provided by Chapter 154, Florida Statutes.
5. In order to meet the estimated expenses of the Hospital Bor&Interest and
Sinking Fund and to pay the principal and interest of the Seven Hundred Fifty Thousand Dollar
($750,000.00) Indian River County, Florida, Hospital Bonds, dated August 1, 1959, it is
determined and hereby declared that a tax rate of One and Seventy-five hundredths (1.75) Mills
upon the dollar be levied and is hereby imposed.
BE IT FURTHER RESOLVED that the Tax Assessor of Indian River County, Florida, be
and he is hereby directed to assess and levy all of the foregoing taxes as fixed and levied
by this Board upon the taxable property in Indian River County, Florida, just and due taxation,
and the Tax Collector of Indian River County, Florida, be and he is hereby directed to collect
said taxes and pay over the same to theBoard and that a certified copy of this Resolution be
furnished to the County Assessor of Taxes and the County Collector of Taxes.

SOUTHERN FLORIDA FLOOD CONTROL DISTRICT, and a certified copy of the Resolution filed with

mined and hereby declared that a tax rate of Seventy-five Hundredths (.75) mill on the dollar
be levied and is hereby fixed and imposed and assessed for the year 1959, on all of the
property in the County of Indian River lying and being within the boundaries of said Central

as including all of the County of Indian River.
4. Estimates having been made by the BOARD OF PUBLIC INSTRUCTION of Indian River

that a tax rate of Ten (10) mills upon the dollar be levied, and is hereby imposed upon all

hereby fixed and assessed for the year 1959 on all of the property taxable for such purpose as

corner of Section 32, Township 32 South, Range 40 East, then run West along Section line to
Northwest corner Section 31, Township 32 South, Range 38 East, thence South on Range line to
Southwest corner Section 31, Township 33 South, Range 39 .East, thence West along Section line

thence North along Ocean beach to starting point; for the purpose of paying interest upon and
providing a Sinking Fund for bonds of said District dated December 1, 1940.
7. Estimates having been made by the said Board of Bublic Instruction for
SPECIAL TAX SCHOOL DISTRICT NO. 1, and a certified copy of the Resolution filed with this
Board as required by law, it is determined and hereby declared that a tax rate of Four, (4) mil
upon the dollar be levied and is hereby fixed and assessed for the year 1959 on all of the
property in said District, the same being all of the property in Indian River County; for the
purpose of paying interest upon and providing a Sinking Fund for bonds of said District
dated April 1, 1956.

and necessary for the operation of the Public Hospital of the County.

Mrs. Gladys Vigliano gave a report of her activities for the Month of July as
our new County Welfare Case Worker, and said report was ordered filed.
Mrs. Vigliano stated she had been approached by the familty of Nathaniel Miller
for the County to place Mr. Miller in a nursing home at the County's expense. Upon Motion
madd by Commissioner Waddell, seconded by Commissioner McCullers and carried, the Board agreed
to place Mr. Miller in a nursing home for a period of two months, after which his case will
again be reviewed.

The County Engineer told the Board he had received word from Mr. Frazier that he will
take $15,000.00 for the ten acres the Board was trying to get for a marl pita The Board decide
this was too much. The Engineer stated he had been talking to Jeff Waters, local road
contractor and Mr. Waters would sell a five acre tract of land to the Board for $1200.00 an
and that he would take off the over -burden and clear the land. Upon Motion made by Commiss
Macdonald, seconded by G=issioner McCullers and unanimously carried, the Board agreed to
buy this tract from Mr. Waters, and further directs the chairman and clerk to execute such
agreement for the County.
Mrs. Rosemary Richey appeared before the Board and requested she be allowed to attend
a Supervisor's of Registration meeting in Tampa on August 13,14 and 15. Upon Motion made by
Commissioner McCullers, seconded by Commissioner Macdonald and carried, the Board authorized
Mrs. Richey's attending this meeting.

Upon Motion made by (bmmissioner Macdonald, seconded by Commissinner McCullers and
carried, the following Resolutions7_were.'adopted:
RESOLUTION -- Item -to Item Transfers
WHEREAS, there is a total surplus of $745.00 in the Fine & Forfeiture Fund of
Indian River County.under some items and which surplus exists after the payment of all necess
expenditures under such items for the current fiscal year; and
WHEREAS, there is a deficiency in funds necessary to provide for the proper and
authorized expenditures under some items in the Fine & Forfeiture Fund; and
WHEREAS, said items mentioned are a part of the same fund and the transfer from one
item to another item in the same fund and is not a transfer from one fund to another fund;

BE IT RESOLVED that there is herewith transferred the sum of $745.00 from some items
where there is a deficiency, according to detailed statement attached, all in the Fine & For-
feiture Fund of the current budget of Indian River County as provided by law.

River County under some items and which surplus exists after the payment of all necessary ex-
penditures under such items for the current fiscal year; and
WHEREAS, there is a deficiency in funds necessary to provide for the proper and
authorized expenditures under some items in the General Revenue Fund; and
WHEREAS, said items mentioned are a part of the same fund and the transfer from one
item to another item in the same fund and is not a transfer from one fund to another fund;
therefore,

The several bills and accounts against the County, having been audited, were exam -
ined and found correct, were approved and warrants issued in settlement of same. Such bills
and accounts being on file in the office of the Clerk of the Circuit Court, the warrants
so issued from the respective funds being listed in the Supplemental Minute Book as provided
by the rules of, the State Auditor, reference to such record and the list so recorded being
made a part of -these minutes.
The County Depositories filed their monthly statements, showing receipts and
disbursements of the various funds, which have been audited, were found to be correct.
There being no further business, on motion made, seconded and carried, the Board
then adjourned.
