HomeMy WebLinkAbout2008-283 t rr WORK ORDER NUMBER CT= 3 WABASSO BEACH PARK RESTORATION This Work Order Number CT-3 is entered into as of this _th day of September 2008 pursuant to that certain Continuing Contract Agreement for Professional Services entered into as of December 13 , 2005 ("Agreement") , by and between Indian River County , a political subdivision of the State of Florida (" COUNTY") and Coastal Technology Corporation ( " Consultant") . The COUNTY has selected the Consultant to perform the professional services set forth on Attachment 1 , attached to this Work Order and made part hereof by this reference . The professional services will be performed by the Consultant for the fee schedule set forth in Attachment 2 , attached to this Work Order and made a part hereof by this reference . The Consultant will perform the professional services within the timeframe more particularly set forth in Attachment 3 , attached to this Work Order and made a part hereof by this reference all in accordance with the terms and provisions set forth in the Agreement . Pursuant to paragraph 1 . 4 of the Agreement , nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . INTRODUCTION In September 2004 , Hurricanes Frances and Jeanne severely damaged Wabasso Beach Park ( Park) ; the storms destroyed the boardwalk , restroom , pavilions and portions of the parking area and roadway within the Park . Under prior authorization the CONSULTANT provided design and permitting services to provide for restoration of the Park (Project) as related to paving , grading , boardwalk , water service , sewer, beach access stairs , ADA ramp and associated improvements . The work under this Work Order provides for construction phase services in support of overall Construction Contract Administration and day-to-day construction observations to be performed by the COUNTY. Construction is expected to require about 210 calendar days . Services are proposed under the Continuing Contract Agreement for Professional Services between COUNTY and CONSULTANT, dated December 13 , 2005 . CONSULTANT shall sub-contract Task 1 water and sewer related services to Carter Associates , Inc . (CAI ) . The following describes the work to be performed : 2 . SCOPE TASK 1 — CONSTRUCTION PHASE SERVICES — WATER & SEWER In general , CONSULTANT , through its ' subcontractor , Carter and Associates , will provide construction phase services relative to the water & sewer improvements . CONSULTANT will : Task 1a - Project Administration A . Project Management . Regularly confer with the COUNTY and Contractor to monitor the progress of construction . B . Administrative Services . Provide services such as : word processing ; filing ; mailing ; reproduction ; and deliveries to document and support Task 1 services . Task 1 b — Basic Engineering Services A . Construction Administration . Provide clarification via responses to Contractor' s RFI requests if answers are not clearly identified in Contract Documents . Draft , review , comment and document up to 2 Contract Change Orders . B . Shop Drawinq Review . Review and mark up water and sewer shop drawings for conformance to permitted plans and specifications . Forward copies to IRCUD for review , comment and reply . C . Final Certifications . Upon completion of engineering "As- Built' drawings (see Task le) and receipt of required Contractor submittals , file completion certifications to : Florida DOT , Florida DEP water and wastewater , and IRC Utility Department . File completion checklist with attachments to IRC Utilities and assist Public Works to obtain IRCUD completion certificate . Task 1c — Monthly Site Observations/Contractor Pay Application Review 2 of 6 Provide up to 6 monthly and 1 final engineering observations of completed water and sewer work to confirm Contractor' s pay application quantities . Review and comment on 6 monthly and 1 final Contractor' s payment requests . Task 1 d - Site Observations A . Routine Site Observations . Provide periodic construction observations sufficient to assure conformance to permitted plans . Observe : gravity sewer and manhole installation and backfilling ; directional bore gravity sewer : directional bore force main ; wet well installation and grouting ; pump station mechanical equipment installations ; pump station drive ; roadway and easement restoration . Observation time is based upon 3 hrs per daytimes 3 days per week times 8 weeks (total 72 hours , including travel time) . Should Contractor take more than 8 weeks to install the site water and sewer systems , additional services will be required subject to COUNTY authorization beyond this Work Order . B . Water and Wastewater Completion Tests . Attend and witness water and force main pressure tests , gravity sewer exfiltration test , and pump station start- up tests . Task 1e - Engineering As -Builts A . As- Built Drawings . From record documents and survey as-builts provided by the Contractor , revise the utility construction plans to indicate "as-built" utility conditions . Task 2 — CONSTRUCTION PHASE SERVICES — SITE WORK & FDEP In general , CONSULTANT will provide construction phase services to provide a basis for CONSULTANT to : o provide monthly reports and certify the construction to FDEP o address design and /or permitting issues that may arise during construction relative to site work and proposed improvements designed by the CONSULTANT . CONSULTANT will : (a) Schedule , prepare for and attend a pre-construction conference with FDEP , COUNTY and the Contractor to address permit and construction requirements , ( b) Confer with the COUNTY and Contractor to monitor the progress of construction , (c) Prepare up to 7 monthly project status reports and submit reports to FDEP , (d ) Perform up to 1 site visit every other week during construction to check construction for compliance with the FDEP permit and Contract Documents , (e) Conduct a final site visit to check the construction for general compliance with the FDEP permit , (f) Develop (with COUNTY and Contractor) , review and approve up to 2 change orders as may become warranted , (g ) Review and comment on up to 6 monthly and 1 final Contractor' s payment requests . ( h) Provide a final certification of construction and submit to FDEP on behalf of COUNTY . 3of6 3 . DELIVERABLES A . Final Water & Sewer Certification of Construction — "As- Built' drawings , certifications to : Florida DOT , Florida DEP water and wastewater, and IRC Utility Department . Contractor completion checklist . B . FDEP Monthly Status Reports - prepare and submit to FDEP and COUNTY Monthly Construction Project Progress Status Reports , C . Final FDEP Certification of Construction — provide final certification of construction in accordance with FDEP Standard Permit Conditions , END ATTACHMENT 1 4of6 ATTACHMENT 2 to WORK ORDER NO . CT- 3 WABASSO BEACH PARK RESTORATION 1 . COMPENSATION The COUNTY agrees to pay and the CONSULTANT agrees to accept , a not-to-exceed fee of $ 34, 122 for services rendered according to Attachment 2 PROPOSAL of this WORK ORDER , 2 . PARTIAL PAYMENTS The COUNTY shall make monthly partial payments to the CONSULTANT for all authorized work completed per the FEE SCHEDULE and pertaining directly to this project performed during the previous calendar month . The CONSULTANT shall submit invoices monthly for services performed and expenses incurred pursuant to this Agreement during the prior month . The CONSULTANT shall submit duly certified invoices in duplicate to the Director of the Public Works Department . For lump sum line items , the amount submitted shall be the prorated amount due for all work performed to date under this phase , determined by applying the percentage of the work completed as certified by the CONSULTANT , to the total due for this phase of the work . The amount of the partial payment due the CONSULTANT for the work performed to date under these phases shall be an amount calculated in accordance with the previous paragraph , less ten percent ( 10 % ) of the invoice amount thus determined , which shall be withheld by the COUNTY as retainage , and less previous payments . Per F . S . 218 . 74 (2 ) , the COUNTY will pay approved invoices on or before the forty-fifth day after the COUNTY receives the CONSULTANT' s invoice . Per F .
