11i��n sections of the Indian River County Code. The Indian River County Board of

transportation concurrency, traffic impact studies and new development roadway
mitigation improvements. The review will be performed in order to assess and compare
these code requirements and protocol with other areas in South Florida. Comparisons
will be made with other Florida Counties in order to make recommendations for revisions
to the County's code and their requirements, if necessary.
McM attended a meeting in Indian River County where the traffic concurrency
requirements for the County were discussed by County Commissioners, staff and the
general public. An important issue that needs to be investigated is the timing of the
traffic concurrency approval and the timeline of concurrency through the County's land
development process. The specific work program to be completed in conjunction with
this review includes the following:

County Code in order to make a comparative review:

The County will provide the aforementioned procedures and regulations. The major areas of concern
include the following:
• Traffic impact study requirements including scope, traffic analysis methodologies and
traffic engineering practices.
• Roadway mitigation improvements, including right -turn and left -turn lanes, for roadway
links and intersections.
• Trip generation rates.
• Trip distribution models.
• Traffic concurrency and the timing of the concurrency reservation.
• Traffic counting procedures.
• Project impact radius of influence methodology.
• Roadway and intersection capacity analysis methodology.
A. Scoping Meeting — A meeting will be held between McM and County staff that will
finalize the scope of the project. The comparison counties will be selected and the major
areas of concern will be revisited to ensure that the review encompass all of the land
development issues related to transportation.
B. Indian River County Code Review — Those areas of the code that are stipulated by the
County at the scoping meeting will be reviewed by McM. Areas of concern that are not
consistent with general practices or merit comment will be identified.
C. Comparative Review — Three other Florida counties, identified by Indian River County,
will be reviewed and compared to Indian River County's requirements and procedures as
they pertain to the County's areas of concern.
D. Meetings — Four meetings will be held, including the scoping meeting, in order to
coordinate McM's progress on the project with Indian River County staff. Additional
meetings will be billed as additional expenses to Indian River County.
E. Report — The results of the review will be documented in a report that will summarize the
each County's requirements and procedures regarding the areas of concern. It will also
make recommendations and alternatives to Indian River County's current practices,
procedures and regulations. The report will be signed and sealed by a Florida registered
Professional Engineer,
FEE
The fee for the foregoing analysis will be $255366.00, and includes indirect expenses, such as
mileage and reproduction. The cost of this review does not include expenses for the purpose of
attending meetings not stipulated within the scope of this proposal. Such meeting attendance, as
necessary, will be provided on a time and materials basis and will be charged at standard hourly rates
in accordance with the rate schedule attached to this proposal and made part of this contract.

TIMING
We are prepared to initiate work on the project upon receipt of written authorization. We understand
that the County expects this review to take no more than three months and we are prepared complete
this work within this timeframe.
TERMINATION
This agreement may be terminated by the authorized representative effective immediately on receipt
of written notice. Payment will be due for services rendered through the date written notice is
received.
BINDING STATUS
The Client and McMahon Associates, Inc. bind themselves, their partners, successors, assigns, heirs,
and/or legal representatives to the other party to this agreement, and to the partners, successors,
assigns and legal representatives of such other party with respect to all covenants of this proposal.
TERMS
The terms of this Agreement call for execution of this contract in the space provided below. All
changes and/or termination of service are to be made in writing and signed by each of the parties.
Any change in the specific work program described above will result in an adjustment of the
conditions and fees. Each written change order must specify these adjustments. The fee and timing
quoted above is valid for a period of thirty days from the date of this contract.
If the terms of this contract, as contained herein and in the attached Standard Provisions for
Professional Services are agreeable to you, please execute it below in the space provided and return
one of the original signed copies and the retainer referenced above to me. If you have any questions
or require further information, please feel free to me.

McMahon Associates, Inc. reserves the right to make adjustments for individuals within these classifications as maybe desirable in
its opinion by reason of promotion, demotion, or change in wage rates. Such adjustments will be limited to the manner in which charges are
computed and billed and will not, unless so stated in writing, affect other terms of an agreement, such as estimated total cost. The following

TERMS
I . Invoices - Invoices will be provided on a monthly basis and will be based upon percentage of completion or actual hours, plus expenses.
Payment is due to McMahon Associates, Inc. within 30 days of the invoice date. Unpaid balances beyond 30 days are subject to interest
at the rate of 1.5% per month. This is an annual percentage rate of 18%.
2. Confidentiality - Technical and pricing information in this proposal is the confidential and proprietary property of McMahon
Associates, Inc. and is not to be disclosed or made available to third parties without the written consent of McMahon Associates, Inc.
3. Commitments - Fee and schedule commitments will be subject to renegotiation for delays caused by the client's failure to provide
specified facilities or information, or any other unpredictable occurrences.
4. Expenses - Automatic Traffic Recorder equipment usage will be billed at $20.00 per 24-hour count. Incidental expenses are
reimbursable at cost, plus an administration fee of 10%. These include subconsultants, reproduction, postage, graphics, reimbursement
of automobile usage at $.405 per mile, parking and tolls. Expenses which by company policy are not billed as reimbursable expenses to
clients and therefore, will not be billed as part of this contract include the following: air travel, rental car, lodging, meals, and long
distance phone charges between McMahon Associates offices. If it becomes necessary during the course of this project to travel
elsewhere, those travel costs will be treated as reimbursable expenses. These expenses will be reflected in the monthly invoices.
5. Attorney's Fees - In connection with any litigation arising from the terms of this agreement, the prevailing party shall be entitled to all
costs including reasonable attorney's fees at both the trial and appellate levels.
6. Ownership and Use of Documents - All original drawings and information are to remain the property of McMahon Associates Inc. The
client will be provided with copies of final drawings and/or reports for information and reference purposes.
7. Insurance - McMahon Associates, Inc. will maintain at its own expense Workman's Compensation Insurance, Comprehensive General
Liability Insurance and Professional Liability Insurance and, upon request, will furnish the client a certificate to verify same.
8. Termination - This agreement may be terminated by the authorized representative effective immediately on receipt of written notice.
Payment will be due for services rendered through the date written notice is received.

CONSULTANTTRAFFIC IMPACT
Scone of Services
The Indian River County Board of County Commissioners intends to retain a professional
transportation engineering consultant for the purpose of reviewing County procedures
and regulations related to transportation concurrency, traffic impact studies and roadwav
improvements necessitated by new development. ✓
Specifically, the following sections of the Indian River County (IRC) Code are to be
reviewed and compared to practices in other Florida Counties.
A) Chapter 910 Concurrency Management System — all sections related to
transportation
B) Section 952 06 Roadway leve, ofservicestandards
C) Section 952.07 Traffic impact study
D) Section 952.10 Road improvement design
E) Section 952.12 Access control
The consultant will prepare a report addressing each of the Code sections identified
above. The report will identify practices in other local Florida governments, including
applicable regulations. The report will also identify and evaluate options and alternatives
to current IRC practices, and recommend changes to IRC procedures and regulations.
In performing the review, the consultant should also address the following areas of
concern.
1. The proper scope, procedures and traffic engineering practices involved in
preparing traffic impact studies
2. Required roadway and intersection improvements necessitated by the traffic
impact of new development, including right and left turn lanes. r
3. Trip generation rates
4. Trip distribution models
5. Traffic concurrency
6. Timetable for "vesting" project traffic
7. Traffic counting procedures
8. Impact area calculation methodology
9. Capacity determination methodology
