GRACE LUTHERAN CHURCH , in consideration of Ten Dollars ($ 10 . 00) and
other good and valuable consideration , on behalf of itself and its successors and
assigns , grants and gives unto Indian River County, Florida , an opan
space/conservation easement over its property described in Exhibit A attached
hereto and made a part hereof.
The following acts are expressly prohibited under this open space/conversation
easement:
(a) Construction of placing of buildings , roads, signs , billboards or other
advertising , utilities , or other structures on or above the ground , provided ,
however, that this shall not prohibit the erection of a fence , or unenclosed
recreational shelters subject to County site plan approval .
( b) Dumping or placing of soil or other substance or material as landfill or
dumping or placing trash , waste , or unsightly or offensive materials .
(c) Removal or destruction of trees , shrubs , or other vegetation with the
exception of exotic plan species such as Brazilian Pepper, Australian
Pine , etc. , and the mowing of grass .
(d) Excavation , dredging , or removal of loan , peat, gravel , soil , rock, or other
material substance in such manner as to affect the surface .
(e) Surface use except for purposes that permit the land or water area to
remain predominantly in its natural condition .
(f) Activity detrimental to drainage , flood control , water conservation , erosion
control , soil conservation , or fish and wildlife habitat preservation .
(g) Acts or uses detrimental to such retention of land or water areas .
This open space/conservation easement is given with the understanding that
should the owner receive permission for uses , other than as permitted herein ,
from appropriate governmental agencies , then the same shall be permitted .
During the time this conservation easement is in legal existence , the appropriate
representatives of Indian River County, Florida , are hereby authorized and
granted the right to enter the property described in Exhibit A in a reasonable
manner and at a reasonable time to insure compliance with the terms of this
open space/conservation easement.

RELEASE OF EASEMENT
WHEREAS , Indian River County was granted an Open Space/Conservation
Easement by Grace Lutheran Church , over property described in Exhibit "A" attached
hereto and made a part hereof, recorded in O . R. Book 838 , Page 1148 , of the Public
Records of Indian River County, Florida ; and
WHEREAS , in coordination with the interested parties , County staff has determined
a relocation of this Open Space/Conservation Easement is in the public interest; and
WHEREAS , Grantee has executed , simultaneously herewith , a substitute Open
Space/Conservation Easement to Indian River County;
NOW, THEREFORE , this Release of Easement is executed by the Board of County
Commissioners of Indian River County, a political subdivision of the State of Florida ,
whose mailing address is 1840 25th Street, Vero Beach , Florida 32960 , Grantor, to
Grace Lutheran Church ,
its successors in interest , heirs and assigns , Grantee .
Indian River County does hereby release and abandon all right , title , and interest
that it may have in the area described on Exhibit "A" attached hereto .
