MARCH 28, 2005 At the January 4, 2005 BCC meeting, the Board empowered the County Administrator to sign Contracts and Change Orders pertaining to the emergency beach restoration activities . This attached Amendment # 12 to the Contract with Applied Technology & Management Inc. Provides for construction phase engineering services in support of the Sectors 3 &5 emergency beach restoration project now underway. The Amendment adds $ 12,220 . 00 to the Contract amount. The Florida Department of Environmental Protection has agreed to pay 90% of the project costs (FDEP 2004 Hurricane Recovery Plan special appropriated funds Contract No . H5IR1) for the Sectors 3& 5 project. The County will share the remaining 10% of the project costs with funding from the Beach Preservation Fund 128- 144- 572 . This is an amendment to the existing Professional Services Agreement (AGREEMENT) dated April 27 , 1999 , between Applied Technology and Management, Inc . (CONSULTANT) and Indian River County (COUNTY) . This amendment addresses changes in " Section III — Scope of Services" and "Section V — Compensation" . Amendment Description This Amendment includes the following changes to " Section III — Scope of Services" : The CONSULTANT shall complete the modified scope of services items in accordance with tasks described in Exhibit "A" This Amendment includes the following changes to " Section V — Compensation" : Section V is being revised in response to Section III changes . The charges associated with the change in project scope are in accordance with Exhibit "A" . The Section of the original AGREEMENT entitled " Section V- Compensation" shall be revised to include compensation due to CONSULTANT as outlined in Exhibit "A" . This AGREEMENT is hereby amended as specifically set forth herein. All other sections of the AGREEMENT shall remain in full force and effect, and are incorporated herein. AUSTRALIAN AVE. , SUITE 855 WEST PALM BEACH, FL 33401 -5045 (561 ) 659-0041 FAX 659-3733 W W W.APPLIEDTM.COM Scope of Work March 14, 2005 Indian River County Preservation Projects Hurricane Response Plan — Phase II Sectors 3 & 5 Construction Phase Services Introduction To replace the dune sand lost from the Hurricanes Frances and Jeanne , a dune project was designed and permitted as part of the Phase I efforts . The designed project will place approximately 101 , 000 CY and 117 , 500 CY of material along the Sectors 3 and 5 , respectively , shorefronts . The typical fill placement density for this project ranges from 5 to 11 CY/ft. , and the material would be placed solely landward of the mean high water line . A Coastal Construction Control Line ( CCCL) Permit was acquired from the Florida DEP to construct the Sectors 3 & 5 Emergency Beach Restoration project . Indian River County awarded a construction contract to Ranger Construction Industries , Inc. (Contractor) . The Contractor will construct the project by truck- hauling sand from an upland quarry (Stuart Mine ) , and will likely commence construction activities in March 2005 . Due to sea turtle nesting constraints , the Contractor will place beach fill along the Sector 5 shorefront until May 1St , 2005 and will remobilize and recommence construction activities on November 1St, 2005 . This Scope of Work will provide Indian River County with assistance in the construction - phase administration and supervision . Due to potential of additional construction projects for Sectors 1 & 2 and Sector 7 in the 2005/2006 dredging season , this Scope of Work is limited to services through Spring 2005 mobilization — a separate Scope of Work will be developed prior to the recommencement of this project on November 1 St Applied Technology & Management, Inc. (ATM ) proposes the herein described Scope of Work to assist Indian River County ( County) with professional coastal engineering services for the Sectors 3 & 5 Hurricane Response Plan — Phase II . Task 1 — Weekly Inspection and Meetings During the construction phase of this project, ATM will provide construction services to assist the County with site inspections and construction administration . ATM will provide weekly site inspections and assistance with any issue that may arise from the Contractor. ATM will ensure that the project is constructed in accordance with the issued CCCL permit and contract documents . Under this task , ATM will perform the following : 1 ) Attend weekly meetings with the County and Contractor to provide assistance in resolving any issues that the have arisen and provide guidance to the County and the Environmental & Coastal Engineers, Scientists & Management Consultants Scope of Work Hurricane Response Plan — Phase II Page 2 of 2 Contractor for the work planned the upcoming week . ATM will document observations coincident with the site inspections and weekly meetings . 2 ) ATM will review interim submissions from the Contractor, including surveys , photos , and correspondence . 3 ) The County will administer the Contractors payment requests , and ATM will provide the County payment recommendations for the Contractor' s invoices . 4 ) Prepare and submit to the Florida DEP the permit- required monthly progress reports . ATM effort will be commensurate with the hours and cost estimates provided within this Scope of Services .
