MODIFICATION TO
CONTRACT FOR CONSTRUCTION OF REQUIRED IMPROVEMENTS
NO , SD -04-04-15"CFC (2003110238 =41312 )
THIS MODIFICATION , made and entered into this . L day of December
2005 , by and between DILECO DEVELOPMENT , LLC , a Florida limited
liability company, hereinafter referred to as " Developer" , and INDIAN RIVER
COUNTY, a political subdivision of the State of Florida , by and through its Board
of County Commissioners , hereinafter referred to as "County" .
WITNESSETH :
WHEREAS , Developer entered into a Contract for Construction of
Required Improvements No . SD=04-04- 15-CFC (2003110238 =41312
guaranteeing the completion of certain required improvements on or before
October 5 , 2005 ; and
WHEREAS , - Developer wishes to extend the date in which to complete
those required improvements to March 5 , 2006 .
NOW, THEREFORE , IN CONSIDERATION OF THE MUTUAL.
COVENANTS AND PROMISES HEREIN CONTAINED , the parties agree as
follows :
1 . The date for completion of the required improvements as outlined
in the Contract for Construction of Required Improvements No . SD-04-04 - 15-
CFC (2003110238-41312 is extended to March 5 , 2006 .
2 . The existing First National Bank and Trust Company of the
Treasure Coast Irrevocable Letter of Credit No . 2004-20 in the amount of
$ 582 , 375 . 02 has been amended to extend the expiration date to three months
beyond the extended completion date (June 5 , 2006 ) .
3 . All other terms set out in the Contract for Construction of Required
Improvements No . SD-04-04- 15-CFC (2003110238-41312 remain in full force
and effect.
