The Board of County Commissioners of Indian River County, met at
the Courthouse, Vero Beach, Florida in a regular meeting held at 9:00
o'clock A. M., Tuesday, February 2, 1960. All members were present.
Also present were Ed Schmucker, County Engineer, Sherman N. Smith, Ji.,
Attorney, and Katherine Morrison, Secretary.
The Chairman asked if there were any changes or additions to be made
to the m:�nutes of January 5th and 19th. There were none and upon Motion
made by Commissioner Hamilton, seconded by Commissioner Waddell and
unanimously carried, the minutes were approved as read.
Mr. Red Blanton appeared before the Board aixd stated that at the
last meeting the Board said they would look over the parcel on U. S. #1
right of way at Winter Beach where the Primitive Baptist Church is located
and give him an answer as to whether or not they would comply with his
request to pay an amount of 75500.00 for the r.i,ht of way. Commissioner
Macdonald stated that the Beard members had viewed the property ar_d in his
opinion the building proper =could be some forty feet from the pavement,
and -that further the construction of the road would have a very marked
effect on the value of the property, in other words would increase the
value greatly. Further that in -his opinion, the damage would be little,
and not as great as the cost of a new church and that it would be an 5.n -
justice to the tax -payers by approving such an amount as 75500.03 for
this right of way. Commissioner Waddell concurred �,7)_th Mr. Macdonald.
The Chairman asked the Attorney if he had obta i.ned an appraised value
of this 'property and the Attorney stated he had but only on the small
piece that the county would take. The Board requested. Attorney Smith. to
get an appraisal for the whole piece which the Church owns for the next
meeting.
Sam Bradley appeared before the Board and stated that the St. Lucie
County Commissioners had received a full valuation report from the appraisers
on all the land in St. Lucie County and again requested that this Board
do the same. The Board said they would think it over.
Mr. Al Forney, Chairman of the Indian River County Planning and
honing Commission appeared before the Board and submitted the resignation
of Mr. J. S. Holmes, which had been sent to him., as a member of the Planning
and Zoning -Commission. Upon Motion made by Commissioner. Macdonald, seconded
by Commissidner Hamilton and unanimously carried, the resignation of Mr.
J. S. Holmes as a member of the Planning & Zoning Commission was accepted
with appreciation for his services. The -Secretary wap further instructed
to write Mr. Holmesa letter expressing the Board appreciation for his
past service. The Board requested that Commissioner Hamilton appoint some-
one to take Mr. Holmes place.
The County Attorney presented two bills from Vocelle and Vocelle;
one for Attorney's fees representing McGriff on right of way and one for
Attorney's fees for representing Martin on right of way. Upon Motion made
by Commissioner McCullers, seconded by Commissioner Macdonald and carried,
the Board approved' these bills for payment.
The County Attorney discussed the Lateral Ditch on South Gifford Road
to the River and upon Motion made by Commissioner Hamilton, seconded by
Commiss _or_er YcCul.lers and unanimously carried, the following Resolution
was adopted:

3. That C. heed Knight has conveyed several parcels of right
in
of way to the County for State Road 5 without cost, and that/consideration
for digging the South Gifford Road ditch the County will pay the sum of
$600.00 to C. Reed Knight for this right of way to partially reimburse
him for digging this ditch.
Sherman N. Smith, Jr. then -introduced Mr. !Harold Scott of Reynolds,
Smith & Hills who had been retained by the Board to represent Indian River

the proposed plan of the Flood Control District and answered questions
asked by the Board members and interested parties:
Commissioner' Hamilton stated he had been 4tpproach6d' by the Rod & `Gun
Club. to request a donation of $500.00 for their fishing tournament. The
other Board members were of the opinion that at the time the budget was
set that the only donations the Board would make was to the Chambers'of
Commerce and therefore we had nothing, set in the budget.
Mr. Bart Collard appeared before the Board and stated that he was
platting a new section of Whispering Palms which 4bbuts on the County
Dump property. The County Engineer stated that he and Mr. Collard had
worked the plat out and that if the County would deed 35 feet of the County
Dump property for one-half a road that Mr. Collard would be able to
straighten out 8th Avenue. Upon Motion made by Commissioner Macdonald,
seconded by Commissioner McCullers and unanimously carried, the Board
approved the County Engineer's recommendation to deed to Mr. Collard the
East 35 feet of the County Dump Property in Section 24, Twp. 33, Rge. 39,
with the understanding that Mr. Collard will move 8th Avenue from the
quarter Section line to a point approximately 100 feet East.
Southern Gulf Utilities, Inc. filed a petition for a franchise and
notice of public hearing shall be published for a hearing on the application
to be conducted.by the Board on February 16th.
The County Attorney stated that the Florida Railroad and Public
Utilities Commission had adopted regulations for water and sewer rates.
Upon Motion made by Commissioner Waddell, seconded by Commissioner Mc -
Cullers and carried, the Clerk was requested to make copies of the re-
gulations with respect to water and sewer systems and mail copies to all
those interested andnow operating water and sewer systems and request
they study the regulations and meet with the Board on March 1st.
The County Attorney stated he had received deed descriptions per-
taining to Oslo Road right of ways and will be contacting the property
owners.

The.Chairman said he would like to see the trucks from the West
routed around Vero Beach and after some discussion and upon Motion made
by Commissioner McCullers, seconded by Commissioner Macdonald; and unaai
mously carried the Board requested the Attorney ask the State Road Department
make a feasability traffic* survey for rerouting all truck traffic coming
from Tampa going North be routed via King's Highway and .South Gifford Road,
and traffic from Tampa going South be routed via King's Highway and Glendale
Road, and that traffic from U. S. #1 going to the center of the State be
routed the same. (This is the change as ordered at Meeting of March 1, 1960.)
Mrs.,Anne Christensen, Welfare Case Worker gave a report of her
activities for the month of January. She also informed the Board that
the payment to Charlotte'Atkin should be reduced from $100.00•to $51.75
starting the first of March.
A letter from Roland Miller was read requesting this Board pass a
resolution and request the Corps of Engineers to deny the request of
John J. Lloyd for a chain ferry across the Sebastian Inlet. No action
was taken.
The County Engineer stated we had some houses to be moved off the
right of way some he thought should be destroyed and others that could
be sold for the materials or to be moved off the property. After going
over the list and upon Motion made by Commissioner Macdonald seconded by
Commissioner McCullers and.unanimously carried, the Board ordered the
following houses destroyed:
SRD #2 - Campbell
SRD #3 - Jungworth
SRD #30 - Powell
SRD 419R - Colley
and further ordered the following to be put up for bids to be removed
from the property:
SRD #24 - Walter Jackson
SRD #55 - Eddie McGriff
SRD #164 - Gerhard Hans Facklam
SRD #110 - Walter Arnold
A letter was read from Indian River County Contractors Association
requesting the Board oppose any effort to bring some houses from Miami
in to Indian River County. No action was taken.
