ONE THIS AMENDMENT made and entered into this day of 20 , by and between the STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION , an agency of the State of Florida , hereinafter called the Department, and INDIAN RIVER COUNTY with offices located at 1840 25TH Street , Vero Beach , Florida , hereinafter called the COUNTY . W I T N E S S E T H WHEREAS , on SEPTEMBER 22 , 1998 , the parties entered into a Joint Participation Agreement, hereinafter referred to as AGREEMENT, wherein the DEPARTMENT agreed to contribute toward certain improvements , described as follows , and hereinafter referred to as the PROJECT: The enhancement of computerized Traffic Signal System operations , located in Indian River County (WPA 4115463 ) State FM No . 228613/1 /54/01 ; and , WHEREAS , the Original Agreement estimated $ 100 , 000 . 00 per year for five (5 ) years beginning in Fiscal Year 1998/ 1999 . WHEREAS , both parties agreed to extend this agreement and provide additional funding up to Fiscal Year 07/08 ; NOW, THEREFORE , in consideration of the mutual covenants , promises , and representations herein , the parties agree to amend that certain Joint Participation Agreement dated SEPTEMBER 22 , 1998 , as follows 1 . The recitals set forth above are true and correct and are deemed incorporated herein . 2 . Funding for Fiscal Years 98/99 , 99/00 , 00/02 , 01 /02 and 02/03 is decreased to FOUR HUNDRED THOUSAND DOLLARS AND 00/100 ($400 , 000 . 00) . 2 . The DEPARTMENT'S additional contribution for this project to cover fiscal years 2003/2004 through 2007/2008 is EIGHT HUNDRED SEVENTY THOUSAND TWO HUNDRED EIGHTY EIGHT AND 00/100 ($ 8701288 . 00 ) . 4 . Pursuant to section 287 .0582 , Florida Statutes , the DEPARTMENT's obligation to pay under this section is contingent upon an annual appropriation by the Florida Legislature . A Maximum Limiting Amount of $ 870 , 288 . 00 shall be paid as follows : FISCAL YEAR Maximum (Commencing July 1 of each year) Contribution 2003/2004 $ 157 , 500 . 00 2004/2005 $ 165 , 375 . 00 2005/2006 $ 173 , 644 . 00 2006/2007 $ 182 , 326 . 00 2007/2008 $ 1919443 . 00 TOTAL $ 870 , 288 . 00 1 of 2 5 . The DEPARTMENT agrees to pay the COUNTY only after receipt and approval of goods and services by the DEPARTMENT's Project Manager, 6 . All provisions , covenants , terms and conditions of the AGREEMENT between the parties theretofore entered into under the date of SEPTEMBER 22, 1998 , as originally set forth therein and that are not amended hereby, are hereby ratified and confirmed and shall remain the same and be unaffected by these presents .
